KITZMILLER, Defendant/Reepondent PROTECTION FROM ABUSE PLAINTIFF'S PETITION TO EXTEND PROTECTION ORDER Pursuant to 23 Pa.C.S.A. 56108, Plaintiff Mary B. Moritz, by her attorney, Theresa Barrett Male, Esquire, requests the court to extend the protection order as follows: 1. Following the institution of this protection from abuse action, this court entered a protection order on March 16, 1995. A true and correct copy of the order is attached as Exhibit "A". 2. On May 30, 1995, after hearing, the court found Defendant in contempt on the March 16 order and sentenced him to ninety days' incarceration in the Cumberland county Prison. 3. Following his release from prison on or about August 28, 1995, Defendant again engaged in conduct which violated the protection order. 4. At a contempt hearing on December 12, 1995, this court again found Defendant in contempt of its March 16, 1995 protection order and placed Defendant on six months' unsupervised probation. 5. Since entry of the March 16, 1995 protection order, Defendant has engaged in numerous instances of abuse, as that term is defined the statute, including but not limited to the following: a. threatening to kill Plaintiff; b. stalking Plaintiff as that term is defined in 18 Pa, C.S. S 2709; c. placing Plaintiff and the minor children in reasonable fear of imminent serious bodily injury; and d. knowingly ,engaging in a course of conduct or repeatedly committing acts toward Plaintiff including following Plaintiff without proper authority under circumstances which placed Plaintiff in reasonable fear of bodily injury. 6. This court has authority to extend the March 16, 1995 protection order pursuant to 23 Pa.C.S.A. S 6108(e). WHEREFORE, Plaintiff requests the Court to extend the extant protection order in accordance with the statute. Defendant PROTECTION FROM ABUSE PETITION FOR PROTECTIVE ORDER 1. This Petition is filed pursuant to the "Protection from Abuse Act", 23 P.S. S6101 et seq. 2. The plaintiff is an adult individual who resides at 705 Allenview Drive, Upper Allen Township, Mechanicsburg, Pennsylvania. 3. The Defendant is an adult individual who resides at 300 East Main street, Mechanicsburg, Pennsylvania. 4. Plaintiff and Defendant were formerly wife and husband with a divorce decree being granted on December 21, 1994 in Cumberland county to Number 3657 civil 1992. A copy of said divorce decree is attached hereto as plaintiff's "Exhibit 1". 5. The parties are the natural parents of three minor children: Katie E. Kitzmiller, born July 10, 1981, Maggie B. Kitzmiller, born October 15, 1982, and sarah C. Kitzmiller, born June 16, 1987. By a Court Order signed by the Honorable J. Wesley Oler, Jr. on September 14, 1993, the parties were granted shared legal custody with primary physical custody of the children awarded to Plaintiff, Mary B. Kitzmiller. A copy of said order is attached hereto as Plaintiff's "Exhibit 2". . . 6. Since the entry of the divorce decree, the Defendant has attempted to cause and has intentionally, knowingly, or recklessly threatened to cause bodily injury to the Plaintiff and to her children, and by physical menace has placed the Plaintiff and her i '. children in fear of imminent serious bodily injury. This has included, but is not limited to the following specific instances of abuse: A. On or about 1:00 p.m. January 28, 1995, Defendant came to Plaintiff's house to pick up the children for visitation. Defendant initiated an argument about Plaintiff and a man she had been dating. Plaintiff asked Defendant to leave but he refused. Plaintiff eventually had to push Defendant out the front door. Defendant stood outside of the house Shouting derogatory things about her which caused several neighbors to step outside to investigate. B. After 11:00 that night, Defendant called asking about clothing for daughter, Katie. He told Plaintiff that he knew that she was with a man that evening at her house, at a theater in carlisle and that they stopped at a restaurant to eat. Plaintiff realized that the only way Defendant would have this information was if he followed her for the entire evening. c. At approximately 9:00 a.m. on January 29, 1995, Defendant utilized a child's house key and gained access to the house. He ransacked the house, cleaning out most of the children's clothing. D. At approximately 9:20 a.m. on January 29, 1995, Defendant came to Plaintiff's parents' house, pounded on the front door and demanded to talk to Plaintiff. He pronounced that he was going to take the girls and never return them to Plaintiff. E. Later that Sunday morning, January 29, 1995, Defendant went to st. Elizabeth Ann Seton Church where he confronted I i I I I I I , , Plaintiff's father. A loud tirade followed in which Defendant pronounced to everyone within earshot that Plaintiff was having sex with another man. F. On the evening of January 29, 1995, Defendant called Plaintiff's house approximately 10 times. Defendant then arrived at the front door of Plaintiff, pounding on the door and screaming obscenities. Defendant said "I'm going to get you". Plaintiff then called 911 and the Upper Allen Township poU ce responded. The police intercepted Defendant as he was cirCling the neighborhood in his car. G. Defendant refused to return clothing for the children. This clothing included uniforms necessary for the parochial school in which the children are enrolled. The children were forced to go to school without proper clothing, their books, and their lunch boxes. Daughter, Sarah, was returned without shoes which had to be replaced by her grandmother. H. On January 30, 1995, when Plaintiff took her children to st. Joseph'S School in Mechanicsburg, she was accosted by Defendant, who screamed at her, accusing her of having sexual relations with the man she had dated. I. On January 30, 1995, the security services of Seidle Memorial Hospital, the place of employment of Plaintiff, were summoned to assist Plaintiff in discouraging Defendant from continuing his verbal abuse of her. Defendant was seen on many occasions throughout the day walking around the hospital grounds. Despite requests by security personnel, Defendant appeared unwilling to cooperate with their requests. J. On or about February 1, 1995, there was an open house at the children's school. Defendant stood at the end of a school hallway and, while not participating in any activities, conspicuously was staring at and following Plaintiff. K. On or about February 13, 1995, Defendant made several telephone calls to Plaintiff, accusing her of ruining their marriage. He intimated that he was going to physically take the children and not return them to custody of Plaintiff. He also indicated that he would continue to contact and confront Plaintiff with his demands that she not have any further relationship with other men. L. On or about February 21, 1995 and on several other previous occasions, Defendant has delivered notes or mailed letters to Plaintiff expressing his displeasure with Plaintiff's relationship with other men. Those items of correspondence indicate that Defendant might take physical action against her if Plaintiff fails to respond to his demands. M. On numerous occasions, Defendant has followed Plaintiff and has positioned himself to observe her activities. Defendant has conveyed this information to Plaintiff by telling her in great detail when, where and with whom she has been. 7. The Plaintiff believes and therefore avers that she and her children will be in immediate and present danger of abuse from the Defendant, and that she and her children are in need of protection from such abuse. 8. The Plaintiff desires that the Defendant be restrained from entering her place of employment or the school of her minor children. 9. The Plaintiff desires that the Defendant be restrained from having any contact with her at her place of employment. 10. The Plaintiff desires that the Defendant be restrained from harassing the Plaintiff and the Plaintiff'S minor children. Kitz- miller. In December of 1995 Mr. Kitzmiller plead guilty to a PFA violation and was pleced on (6) six months probation. A few weeks ago I discovered that because of an oversight on mY part Mr. Kitzmiller was never fingerprinted on this charge. On March 13, 1996 I phoned Mr. Kitzmiller end attempted to set up a date to fingerprint him. During our conversation Mr. Kitzmiller hung up on me. Although dates in Merch were discussed, Mr. Kitzmiller never made an attempt to be finger- printed. My hopes ere that an order can be issued so that Mr. Kitzmiller will have to make being fingerprinted a priority. Any assiatance in this matter would be greatly appreciated.
