l. The Plaintiff is DAUPHIN DEPOSIT BANK AND TRUST COMPANY, a
Pennsylvania banking corporation, with its principal place of
business at 213 Market Street, Harrisburg, Pennsylvania l7105.
2. The Defendant, CHRISTOPHER A. MARTIN, is an adult individual
whose last known address is 117 old Mill Road, Camp Hill,
Ponnsylvania l70ll.
3. On or about september 29, 1993, the Plaintiff advanced the sum
of Thirteen 'rhousand Eight Hundt'ed Fifteen Dollars and Eighty Cents
($l3,8l5.80) to the Defendant at an interest rate of Eight and one
half percent (8.50~) per annum resulting in a finance charge of
Three Thousand One Hundred Ninety-one Dollars and Twenty Cents
($3,19l.20) for a total repayment amount of Seventeen Thousand and
Seven Dollars ($17,007.00), hereinafter called the "Loan".
4. As evidence of the Loan, Defendant executed and delivered to
Plaintiff a Pennsylvania Motor Vehicle Installment Sale Contract
dated September 29, 1993, by which Defendant promised to pay to
Plaintiff the sum of Seventeen Thousand and Seven Dollars
($17,007.00), hereinafter called the "contract".
A copy of the
Contract is attached hereto as Exhibit "A" and made part hereof.
5. As security for the Loan, the Defendant, CHRISTOPHER A.
MARTIN, granted to Plaintiff a security interest in a 1993
Chevrolet Coupe Automobile, hereinafter called the "Vehicle".
6. By the terms of the Contract, Defendant agreed to pay to
Plaintiff the sum of Two Hundred Eighty-three Dollars and Forty-
five Cents ($283.45) per month, beginning october 29, 1993, and
monthly thereafter for a period of Sixty (60) months.
7. Pursuant to the terms of the Contract, fai lure to make any
payment on or before the date it is due constitutes a default.
8. The Defendant defaulted under the Contract by failing to make
the payments due and owing on July 29, 1994 and all monthly
payments thereafter.
9. By virtue of Defendant's default, Plaintiff took possession of
the Vehicle which was then held in storage in Dauphin County,
Pennsylvania 17018.
10. On or about October 25, 1994, Plaintiff sent a NotJ.ce of
Repossession of the Vehicle, to the Defendant. A copy of said
Notice of Repossession to the Defendant, CHRISTOPHER A. MARTIN, is
attached hereto as Exhibit "B" and made part hereof.
11. Defendant failed to take any timely action in accordance with
said Notice of Repossession.
12. The Vehicle was sold at public sale on December 3, 1994 in
Dauphin County, Pennsylvania l70l8.
l3. After sale of the Vehicle and application by Plaintiff of the
proceeds of the sale of the Vehicle to the Loan, a deficiency
balance in the amount of Eight Thousand Four Hundred Thirty-six
- 2-
Dollars and Twenty-seven Cents ($8,436.27), plus interest as stated
in the Contract, remained due and owing on the Loan.
14. On or about January 25, 1995, Plaintiff notified the Defendant
of the deficiency balance on the Loan and requested payment of
same.
A copy of said Notice to the Defendant, CHRISTOPHER A.
MARTIN, is attached hereto as Exhibit "c" and made part hereof.
15. The Defendant has failed to make any payment to Plaintiff on
account of the deficiency balance of the Loan.
l6. Pursuant to the terms of the Contract, the Defendant is
obligated to pay Plaintiff the deficiency balance on the Loan plus
Fifteen (15%) percent of the balance due as reasonable attorney's
fees.
17. The total amount due and owing from Defendant to Plaintiff on
the Loan is;

WHEREFORE, Plaintiff demands judgment against the Defendant,
CHRISTOPHER A. MARTIN, in the amount of Nine Thousand Seven Hundred
One Dollars and Seventy-one Cents ($9,701.71), plus interest and
all other sums due under the Contract, together with costs of this
action.
