COMPLAINT
l. The plaintiff is DAUPHIN DEPOSIT BANK AND TRUST COMPANY, a
Pennsylvania Banking Corporation, with its principal place of
business at 213 Market Street, Harrisburg, Pennsylvania 17l05.
2. The Defendant, KENWOOD W. LOSH, "R.. is a adult individual
whose last known address is 404 crossland School Road, Carlisle,
Pennsylvania l70l3.
3. The Defendant, SUSAN K. LOSH, is an adult individual whose
last known address is 404 Crossland School Road, Carlisle,
Pennsylvania 170l3.
4. On or about February 1, 1994, the Plaintiff advanced the sum
of Twenty"one Thousand Three Hundred Sixty"seven Dollars and Four
Cents ($21,367.04) to the Defendants at an interest rate of Eleven
and Ninety One Hundredths percent (ll.90) per annum resulting in a
finance charge of Seven Thousand Two Hundred Twenty-seven Dollars
and Sixteen Cents ($7,227 .l6) for a total repayment amount of
Twenty-eight Thousand Five Hundred Ninety-four Dollars and Twenty
Cents ($28,594.20). hereinafter called the "Loan".
5. As evidence of the Loan, Defendants. as co"makers, executed
and delivet'tJu to Plaintiff a Pennsylvania Motor Vehicle Installment
Sale Contract dated Fcbruary 1, 1994, by which Defcndants promised
to pay to Plaintiff the sum of Twenty-eight Thousand Five Hundred
Ninety-four Dollars and Twenty Cents ($28,594.20). hereinafter
called the "contract". A copy of the Contract is attached hereto
as Exhibit "A" and made part hereof.
6. As security for the Loan, the Defendants, KENWOODW. LOSH, oPR.
and SUSAN K. LOSH, granted to plaintiff a security interest in a
1993 Mercury Sable Station Wagon hereinafter cal led the "Vehicle".
7. By the terms of the Contract, Defendants agreed to pay to
Plaintiff the sum of Four Hundred Seventy-six Dollars and Fifty-
Seven Cents ($476.57) per month, beginning March l8, 1994, and
monthly thereafter for a period of Sixty (60) months.
8. Pursuant to the terms of the contract, failure to make any
payment on or before the date it is due constitutes a default.
9. The Defendants defaulted under the Contract by failing to make
the payments due and owing on Jul y l8, 1994 and all monthl y
payments thereafter.
10. By virtue of Defendants' default, Plaintiff took possession of
the Vehicle which was then held in storage in Dauphin County,
Pennsylvania 170l8.
11. On or about November 28, 1994, pi ainti f f sent a Notice of
Repossession of the Vehicle, to the Defendants. A copy of said
Notice of Repossession to the Defendant, KENWOOD W. LOSH, SR., is
attached hereto as Exhibi t "B" and made part h.Heof. A copy of
said Notice of Repossession to the Defendant, SUSAN K. LOSH, is
attached hereto as Exhibit "e" and made part hereof.

12. Defendants failed to take any timely action in accordance with
said Notice of Repossession.
l3. The Vehicle was sold at public sale on January 7, 1995, in
Dauphin County, Pennsylvania 17018.
l4. After sale of the Vehicle and application by Plaintiff of the
proceeds of the sale of the Vehicle to the Loan, a deficiency
balance in the amount of Eleven Thousand Eight Hundred Seventy-five
Dollars and Sixty-five Cents ($ll,875.65), plus interest as stated
in the Contract, remained due and owing on the Loan.
15. On or about January 20, 1995, Plaintiff notified the
Defendants of the deficiency balance on the Loan and requested
payment of same. A copy of said Notice to the Defendant, KENWOOD
W. LOSH, .1R., is attached hereto as Exhibi t "0" and made part
hereof. A copy of said Notice to the Defendant. SUSAN K. LOSH, is
attached hereto as Exhibit "E" and made part hereof.
16. The Defendants have failed to make any payment to Plaintiff on
account of the deficiency balance of the Loan.
l7. Pursuant to the terms of the Contract, the Defendants are
obligated to pay Plaintiff the deficiency balance on the Loan plus
Fifteen (15%) percent of the balance due as reasonable attorney's
fees.
18. The total amount due and owing from Defendants to Plaintiff
on the Loan is:
