the within Plaintiff's Motion To Dissolve supersedeas And/Or
Schedule Hearing And Plaintiff's Objections To Defendant's Request
For Additional Time To Answer Complaint and Rule To Show Cause,
it is hereby
ORDERED, that the Supersedeas issued by the Prothonotary on
or about March 3, 1995 is hereby terminated as the Defendant has
failed to pay her May 1995 rent into escrow with the prothonotary
and the Plaintiff is hereby permitted to proceed with its
recovery of possession of the real estate.
Furthermore, the rent currently being held by the
Prothonotary shall forthwith be paid to the Plaintiff.
Defendant shall be permitted to continue to contest her
obligation to pay the amount of rent being claimed in this
action.

PLAINTIFF'S MOTION TO DISSOLVE SUPERSEDEAS
AND/OR SCHEDULE HEARING AND PLAINTIFF'S OBJECTIONS
TO DEFENDANT'S REOUEST FOR ADDITIONAL TIME TO ANSWER COMPLAINT
AND ROLE TO SHOW CAUSE
AND NOW comes the Plaintiff and avers the following:
1. On May 22, 1995 the Defendant served upon the plaintiff
by ordinary mail a "Motion To Continue Answer To Complaint And
Order To Show Cause".
2. Defendant acknowledges in said Motion that she has
failed to pay her May 1995 rent.
3. Plaintiff assumes that Defendant filed a copy of her
Motion to Continue with the Prothonotary and therefore she could
have paid her May 1995 rent at the same time that the Motion was
filed but did not.
4. Since a continuation of the Supersedeas in this matter
is dependent upon the Defendant paying her rent when due and she
has failed to do so, the Supersedeas should be lifted by the
Court.
5. Although the Defendant alleges in her Motion to Continue

that she has valid and meritorious defenses to the complaint, she
did not even bother to attend the District Justice Hearing and
present any defenses.
6. Although the Defendant avers in her Motion to Continue
that she has valid and meritorious defenses to the Complaint, she
avers that these mav occur in the future if she takes some other
action but does not aver any present defenses to the Ejectment
action,
7. In the event the Court will not dissolve the Supersedeas
that has been issued regarding possession of the premises by
Plaintiff, the Plaintiff hereby requests that your Honorable
Court schedule a prompt hearing regarding the Plaintiff's
Complaint in Ejectment in order to resolve the issues as quickly
as possible.
8, On May 10, 1995, this Court issued a Rule To Show Cause
on Defendant regarding Plaintiff's request to dissolve
Supersedeas which was served on Defendant.
9. Defendant has not yet answered the Rule To Show Cause
nor paid her May 1995 rent therefore, at the very least, the
Court should make the Rule absolute as to the dissolving of the
Supersedeas.
WHEREFORE, the Plaintiff requests your Honorable Court deny
the Defendant's Motion or, in the alternative, dissolve the
Supersedeas because the rent for May 1995 has not been paid and
permit the Defendant to present her defenses as to the obligation

to pay the past due rent or promptly schedule a hearing on
plaintiff's Complaint in Ejectment.

AND NOW comes the Plaintiff, pro se and avers the following:
1. On April 29, 1995, your defendant received a Landlord
and Tenant Complaint requesting possession of the real property
and payment of unpaid rent.
2. An Answer to the Complaint is due on or before May 19,
1995.
3. On May 12, 1995, the Honorable Edgar B. Bailey, Judge,
issued an Order to Show Cause why Plaintiff's Application to
Terminate Supersedeas should not be granted. Said Rule was
returnable seven (7) days after service, to-wit, May 12, 1995.
Rule is returnable on May 19, 1995.
4. Your defendant, acting pro se in this action, has had
certain medical/psychological problems which are a continuing
nature and has necessitated her departure from this jurisdiction.
5. Time limits to respond to various landlord and tenant
actions should be construed liberally, especially where defendant
is acting without the benefit of an attorney.
6. Defendant believes that she has certain valid and
meritorious defenses to the Complaint, including jurisdictional
problems since she intends to file certain post petition debts
with the United States Bankruptcy Court, Defendant fully intends
to pay her May 1995 rent into the escrow account with the
Prothonotary as soon as she returns to this jurisdiction

APPLICATION TO TERMINATE SUPERSEDEAS
AND NOW comes the Plaintiff by and through its attorney,
Edward S. Finkelstein, Esquire who moves and avers as follows:
1, The Plaintiff had filed a Landlord and Tenant Complaint
before District Justice Charles A. Clement, Jr. on December 15,
1994 for collection of unpaid rent and recovery of possession of
the apartment rented by Defendant at 1465 Hillcrest Court,
Apartment 607, Camp Hill, Lower Allen Township, Cumberland
County, pennsylvania.
2. A hearing had originally been scheduled on the aforesaid
Complaint for January 3, 1995 at 2:00 p.m.
3. A continuance of the aforesaid hearing was requested by
the Defendant and rescheduled for January 9, 1995 at 1:30 p.m.
4, On January 12, 1995 the Plaintiff requested a
continuance of the hearing and it was rescheduled for February 1,
1995.
5, At the hearing on February 1, 1995, Plaintiff appeared
and the Defendant did not,
6. At the hearing on February 1, 1995 judgment was entered
in favor of plaintiff in the amount of $1,359.50 and possession
of the apartment was also granted by the District Justice to the
plaintiff.
7. On February 17, 1995 the Plaintiff filed a Request for
Order For possession with District Justice Clement for the
apartment at 1465 Hillcrest Court, Apartment 607, Camp Hill,
Pennsylvania.
8. On March 3, 1995 the Defendant filed an Appeal of the
District Justice Judgment of February 1, 1995 granting possession
of her apartment to the plaintiff and requiring the Defendant to
pay past due rent of $1,359.50. On March 3, 1995 the Defendant
also paid her rent for the month of March of $695,00 in escrow
with the prothonotary of Cumberland County.
9. The Appeal by Defendant and the payment of rent into
escrow with the Prothonotary cancel the Prothonotary to issue a
Supersedeas stopping the Plaintiff from obtaining possession of
the apartment.
10. On March 15, 1995 the Plaintiff filed a Complaint in
Ejectment pursuant to the Appeal filed by Defendant in this
matter.
11. The Plaintiff's Complaint in Ejectment was given to the
Sheriff of Cumberland County on or about March 15, 1995 to serve
upon the Defendant.
12, Although repeated efforts were made by the Sheriff of
Cumberland County to serve the Complaint in Ejectment upon the
Defendant, the Defendant made herself unavailable and the Sheriff
of Cumberland County was unable to serve the Complaint in
Ejectment on the Defendant.
13. The Sheriff of Cumberland County then transferred the
Complaint in Ejectment to the Sheriff of Dauphin County for
service upon the Defendant however the Sheriff of Dauphin County
was also unable to serve the Defendant because she took an
extended leave from work.
14. The Plaintiff had the Complaint in Ejectment reinstated
and eventually served upon the Defendant by private process
server on April 29, 1995.
15, On April 3, 1995 the Defendant paid her April rent in
the amount of $695.00 to the prothonotary of Cumberland County.
16. The Defendant has failed to pay her May rent of $695.00

17. Pursuant to Cumberland county Rule 357(3) the Plaintiff
may have the supersedeas terminated that was issued by the
Prothonotary of Cumberland County as the Defendant has failed to
pay her May 1995 rent in escrow,
WHEREFORE, the Plaintiff prays your Honorable Court issue an
Order withdrawing the Supersedeas that has been issued by the
Prothonotary of Cumberland County in order that the Plaintiff can
proceed to retake possession of the Defendant's apartment at 1465
Hillcrest Court, Apartment 607, Camp Hill, Pennsylvania.

1. Plaintiff, Shaffer & Salkin, is a Pennsylvania
partnership, t/a Country Walk Apartments maintaining a place of
business at 1400 Hillcrest Court, Camp Hill, Cumberland County,
Pennsylvania 17011,
2. Defendant, Theresa M, Ulen, is an adult individual
residing at 1465 Hillcrest Court, Apartment No. 607, Country Walk
Apartments, Camp Hill, Cumberland County, Pennsylvania 17011,
She has also been known by the name of Theresa M. Simonton.
3. Plaintiff leased the premises at Apartment 607, Country
Walk Apartments, Camp Hill, Pennsylvania to Defendant under
residential lease agreement, a true and correct copy of which is
attached hereto as Exhibit "Aft,
4. The Lease provided for a term of eleven months and
twenty-six days beginning the 6th day of October 1993 until the
30th day of September 1994 (In November 1994, the lease amended
to automatically extend the term of the lease on a month-to-month
basis commencing on the 1st day of October 1994 and expiring on
the 30th day of September 1995,) at a monthly rental of Six
Hundred Ninety-five ($695.00) Dollars payable in advance on or
before the first of the month,
5. Tenant is in possession of leased premises pursuant to
the terms of the Lease,
6. Beginning June 1994 the Defendant ceased to pay rent due
under the Lease as she owes rent of $390.00 for part of June and
has paid nothing since,
7. The Defendant filed a Chapter 13 Bankruptcy proceeding,
i.e., wage earner plan, on February 9, 1994.
8. On December 6, 1994 the Defendant converted her
Bankruptcy to a Chapter 7 Bankruptcy.
9. The Defendant has failed to pay any rent since the
conversion to a Chapter 7 Bankruptcy,
10. The Plaintiff filed suit at District Justice Charles A.
Clement, Jr. for the rent owed by Defendant to Plaintiff post-
bankruptcy and judgment was rendered on February 1, 1995 by the
District Justice in favor of Plaintiff for said rent in the
amount of One Thousand Two Hundred Fifty-five Dollars and Fifty
Cents ($1,255.50) plus costs of One Hundred Four ($104.00)
Dollars for a total due of One Thousand Three Hundred Fifty-nine
Dollars and Fifty Cents ($1,359.50) which was a default judgment
against Defendant as Defendant failed to show for the hearing.
11. On March 3, 1995 the Defendant filed an appeal of the
District Justice verdict and paid her March 1995 rent in escrow
with the court,
12. The Defendant's rent is due on or before the first of
each month. Defendant has refused to remove herself from the
premises although requested in writing by Plaintiff to do so.
WHEREFORE, Plaintiff demands judgment for possession against
Defendant and judgment for the balance of rent due of One
Thousand Three Hundred Fifty-nine Dollars and Fifty Cents
($1,359.50) plus such additional interest as is due after March
1, 1995 plus costs of suit,

The original lease agreement made on the 5th day of October A.D.
1993, between Shaffer/Salkin, hereinafter called the Lessor, and
Theresa M. Ulen
hereinafter called Lessee for. Apartment No, 607, country Walk
Apartments, Camp Hill, penneyl vania, is on this day of
November A, D. 1994 hereby amended to automatically extend the
term of this lease on a month-to-month basis
commencing on lat day of October A,D. 1994

The monthly rental payments to Lessor during the term of this

AND NOW comes the Plaintiff, pro se and avers the fOllowing:
1, On April 29, 1995, your defendant received a Landlord
and Tenant Complaint requesting possession of the real property
and payment of unpaid rent,
2, An Answer to the Complaint is due on or before May 19,
1995,
3, On May 12, 1995, the Honorable Edgar B, Bailey, Judge,
issued an Order to Show Cause why Plaintiff's Application to
Terminate Supersedeas shOUld not be granted, Said Rule was
returnable seven (7) days after service, to-wit, May 12, 1995,
RUle is returnable on May 19, 1995,
4, Your defendant, acting pro se in this action, has had
certain medical/psychological problems which are a continuing
nature and has necessitated her departure from this jurisdiction,
5, Time limits to respond to various landlord and tenant
actions should be construed liberally, especially where defendant
is aoting without the benefit of an attorney,
6, Defendant believes that she has certain valid and
meritorious defenses to the Complaint, including jurisdiotional
problems since she intends to file certain post petition debts
with the United States Bankruptcy Court. Defendant fully intends
to pay her May 1995 rent into the escrow account with the
Prothonotary as soon as she returns to this jurisdiction

presently scheduled for May 25, 1995,
7, Plaintiff will not be unduly prejudiced by the granting
of this Motion to Continue the time to respond to the Complaint
and pay the rent for Msy 1995, Defendant paid rent in a timely
manner for March and April 1995,
WHEREFORE, Your Defendant respectfully prays your Honorable
Court grant Defendant's Motion to Continue Time To Answer
Complaint and Show Cause why Plaintiff's Application to Terminate
Supersedeas should not be granted,
