Dear Mr. Spare and Ms. Heffernan:
By order of Court of President Judge Harold E. Sheely
dated April 22, 1997, the full-time Master has been appointed in
the above referenced divorce proceedings.
A divorce complaint was filed on March 7, 1995, raising
grounds for divorce of irretrievable breakdown of the marriage.
The complaint also raised the economic claim of equitable
distribution.
In accordance with p.R.e.p. 1920.33(b) I am directing Mr.
Spare on behalf of Mr. Heffernan and Ms. Heffernan who is
representing herself to each file a pre-trial statement on or
before Monday, May 19, 1997. Upon receipt of the pre-trial
statements I will immediately schedule a pre-hearing conference
with Mr. Spare and Ms. Heffernan, if she remains unrepresented,
to discuss the issues and, if necessary, schedule a hearing.

Present for the Plaintiff, Edward J. Heffernan,
III, is attorney Philip H. Spare, and present for the Defendant,
Miriam G. Heffernan, is attorney Samuel L. Andes.
A divorce complaint was filed on March 7, 1995,
raising grounds for divorce of irretrievable breakdown of the
marriage. Counsel have indicated that the parties will sign and
file affidavits of consent so that the divorce can be concluded
under Section 3301(c) of the Domestic Relations Code.
The complaint raised the economic claim of
equitable distribution. Mr. Andes has advised that today he is
going to file, on behalf of the Defendant, a petition for
economic relief raising the claims of alimony, alimony pendente
lite, and counsel fees and expenses. Counsel have indicated
that there will not be any testimony on the factor of marital
misconduct as that factor relates to wife's alimony claim.
The parties were married on August 24, 1985, and
according to wife separated in August 1996. Husband indicates
that the parties separated in March 1995. Apparently wife's
date of separation is tied in to the time when the parties
physically separated, since in March 1995 the parties were
residing in the same residence.
The parties are the natural parents of one
Sahara A. Heffernan, who was born on February 23, 1986.
has two sons to a prior relationship.
Husband is 40 years of age and resides at 139 North
Enola Drive, Enola, Pennsylvania, where he lives with an
emancipated son to a prior relationship. He is a high school
graduate and works as a pressman for Fry Communications.
According to information wife provided to attorney Andes, his
income is around $35,000.00 to $45,000.00 per year. Mr. Spare
indicated that he would be filing an income and expense
child,

statement with current income information regarding Mr.
Heffernan's wages. Mr. Heffernan is paying child support to
wife for Sahara in the amount of $190.00 every two weeks. H~ is
not under any order or agreement to pay spousal support or
alimony pendente lite. Mr. Heffernan has not raised any health
issues.

wife is 35 years of age and resides at 108
Beechcliff Drive, Carlisle, Pennsylvania, where she lives with
the child and another family member in that family member's
household. According to Mr. Andes she is being subsidized by
her family. She is a high school graduate and works part-time
for G&L Glass which is a business in her family. She reported a
net income in 1996 of $6,966.82. Wife has not raised any health
issues. Counsel are requested to provide information regarding
the status of wife's health issue benefits and whether or not
she is entitled to COBRA benefits through husband's employment
upon the entry of a divorce decree. In any event, the cost of
benefits to her would be relevant to the Master's consideration
of her expenses.
The parties own a property at 139 North Enola
Drive, Enola, Pennsylvania, where husband is residing. The
property has been appraised by Karen Darney on July 10, 1997,
for $53,500.00. The property is subject to a mortgage with
Inland Mortgage. The payoff in July of 1997 was $35,597.51.
Wife has indicated, though, that in her opinion the property has
a value of $55,000.00 but Mr. Andes stated that he will review
the appraisal with her and perhaps the parties can stipulate to
the value on the appraisal.
Husband has a 1991 Chevrolet Baretta GT vehicle
which has not been valued, although counsel have provided
information that as of March 1995 the car was subject to a lien
in favor of GMAC in the of $5,590.00. Counsel are going to
attempt to arrive at a value for the vehicle, and considering
the loan amount, the vehicle may have a negative value for
purposes of equitable distribution.
Counsel reported on the pre-trial statement a joint
checking account with no balance with First Bank and Trust in
Mechanicsburg.
The Massachusetts Mutual life insurance policy
reported on husband's pre-trial statement had a value as of July
1997 of $1,398.85.
Husband is a participant in a pension plan with his
employer which counsel believe is a 401(k) plan. Mr. Spare has
provided statements of the plan which perhaps need some
clarification. His pre-trial statement indicated that the plan
had a value on June 25, 1997, of $19,159.88 and a value in March
1995 of $11,765.73. One of the issues is whether from the date
of separation (whichever date counsel determine the date of
separation to be) the employer and/or Mr. Heffernan made any
contributions to the plan or whether or not the increase in
value is simply a result of the growth of the marital portion to
the date of June 25, 1997, which is the last stated value
reported.
Counsel have not specifically addressed the
household tangible personal property as far as value or whether
or not wife desires to have any of the items, which apparently
have, for the most part, remained with the house and husband.
If wife desires to have any items, she should provide Mr. Spare
a list and counsel should determine whether or not they intend
to obtain a value for the household tangible personal property
to use in an equitable distribution computation.
Both pre-trial statements list various creditors.
Wife has listed accounts which were apparently in her name
during the marriage and of which Mr. Heffernan has little or no
knowledge. The question arises as to whether or not the debt is
properly characterized as marital depending on what wife used
the credit for, and Mr. Andes is requested to provide statements
as of the date of separation and if possible prior statements
showing what purchases were made on the accounts. Mr. Spare's
concern is whether or not the charges were for the use of the
marital estate.
In order to determine what, if any, credit should
be given to either of the parties for any payment of marital
debts since the date of separation, counsel should provide
statements of what debt was owed at time of separation and the
balance of any debt owing at the time of the hearing and a
statement as to which of the parties paid on account of the
marital debt from the date of separation. It appears as if wife
made little or no contribution to the marital debt payments
based on the fact that her income is fairly small. However,
since the credit cards that were listed on her pre-trial
statement were in her name, it may be reasonable to assume that
she was making some payments on those cards. If it is
determined that those charges were marital then perhaps wife
will also be entitled to credit on account of payments as well
as husband.
Apparently husband has been making payments on some
charges involving improvements to the home to Security Pacific
and Blazer Consumer Discount company.
Mr. Spare has requested that Mr. Andes provide
verification of the status of any pension benefits which wife
mayor may not have with her place of employment.
There is some question as to whether or not wife is
working up to her earning potential and Mr. spare has indicated
that he may want to pursue the question as to whether or not
wife should be charged with an earning capacity in excess of
what she is currently reporting. This issue goes to wife's
claim for alimony specifically. Mr. Spare can, if he decides,
have her evaluated by a vocational expert although Mr. Andes
stated that after he talks with his client she may be willing to
agree to some earning capacity even though at present she is
earning a small sum from part-time work with the family business
operation.
A hearing is scheduled for Thursday, March 5, 1998,
at 9:00 a.m. Notices will be sent to counsel and the parties.

DEFENDANT'S PETITION FOR ECONOMIC RELIEF
AND NOW comes the above-named Defendant, by her attorney, Samuel L. Andes,
and makes the following Petition for Economic Relief:
COUNT I . ALIMONY
1. Defendant lacks sufficient property to provide for her reasonable needs in
accordance with the standard of living of the parties established during the marriage.
2. Defendant is unable to support herself in accordance with the standard of living
of the parties established during the marriage through appropriate employment.
3. The Plaintiff is employed and enjoys a substantial income from which he is able
to contribute to the support and maintenance of Defendant and to pay her alimony in
accordance with the Divorce Code of Pennsylvania.
WHEREFORE, Defendant prays this Honorable Court to enter an Order awarding
Defendant from Plaintiff permanent alimony in such sums as are reasonable and adequate
to support and maintain Defendant in the station of life to which she has become
accustomed during the marriage.
COUNT II - ALIMONY PENDENTE LITE
4. Defendant is without sufficient income to support and maintain herself during the
pendency of this action.

against Plaintiff and cannot adequately litigate her rights in this matter.

Defendant's attorney and the expenses of this litigation.
WHEREFORE. Defendant prays this Honorable Court to order Plaintiff to pay the legal
fees and expenses incurred by Defendant in the litigation of this action.

IJ62. Procedural Requirements. All applications for permita,
pursuant to this Part shall be submitted to the Zoning Officer, who has the
option of submitting such applications to the Planning Commission or the
Township Commissioners for a recommendation prior to issuing a permit. All
applications, other than for one- and two- family dwellings, shall be
reviewed by the Plan Review Board. (Ordinance J78-BO, Harch 18, 1980,

IJ6J. Permitted Uses. A building may be erected or used and a lot
may be used or occupied for any of the following purposes and no other.
All such uses shall be in conformity with the Performance Standards in the
part on General Regulations. [Part 19 of this ordinance]
I. Single-family detached dwellings in existence at the time of
adoption of this ordinance.
2. Conversion apartments meeting the requirements of Section 574(1)
to (4) and Part 21. The Building Official shall grant a building permit
when the above conditions are satisfied without hearing or approval of the
Board of Commissioners.
J. Branch banks, studios and professional offices, for professional
occupations.
4. Apartments. included within any apartment building containin~ not
less than thirty (JO) apartments, retail shops, restaurants, beauty
parlors, barber shops, drug stores and bakeries pro\'ided that any baked
goods prepared on the premises ore offered ror sale only on the premises.
5. Retail shops. including shops selling groceries. meats, vegetables
and produce, sundries, and baked goods provided that any baked goods
prepared on the premises arc offered for sale only on the premises.
6. Public utility facilities.
7. Drug stores and pharmacies, which may contain a soda fountain.
8. Office buildings. medical cliniCS. medical buildings, pharmacies
located in a medical clinic or medical building, where limited to the
diapensing of medicine, drugs, and prescriptions.

9. Dry cleaning and laundry establishments, provided that:
a, No dry cleaning or laundering is done on the premises, or
b. The laundry is a patron-operated service.
10. Si~OA - identification ~nd business signs not exceeding four (4)

other permitted use, provided, however, that a neighborhood shopping center
under single ownership or management containing four (4) or more stores or

You have been sued in court. If you wish to defend against
the claims set forth in the following pages, you must take prompt
action. You are warned that if you fail to do so, the case may
proceed without you and a decree of divorce or annulment may be
entered against you by the Court. A judgment may also be entered
against you for any other claim or relief requested in these
papers by the Plaintiff. You may lose money or property or other

COMPLAINT
COUNT I - DIVORCE
1. The Plaintiff in this action is EDWARD J. HEFFERNAN,
III, an adult individual residing at 139 N. Enola Drive, Eno1a,
Cumberland county, Pennsylvania 17025.
2. The Defendant in this action is MIRIAM G. HEFFERNAN, an
adult individual residing at 139 N. Enola Drive, Enola,
Cumberland county, Pennsylvania 17025.
J. Both the plaintiff and Defendant have been bona fide
residents of the Commonwealth of Pennsylvania for at least six
(6) months immediately previous to the filing of this Complaint.
4. The plaintiff and Defendant were lawfully joined in
marriage on August 24, 1985 in New Cumberland, Cumberland County,
Pennsylvania.
5. There have been no prior actions of divorce or
for annulment between the parties hereto in this or any other
jurisdiction since the date of the marriage averred in Paragraph
4, above.
6. Neither party is a member of the armed forces of the
United states of America.
7. The marriage between the parties hereto is irretrievably
broken.
8. The Plaintiff has been advised that counseling is
available and that Plaintiff may have the right to request that
the Court require the parties to participate in counseling.
9. The Plaintiff requests the Court to enter a decree of
divorce.
COUNT II - EOUITABLE DIVISION OF PROPERTY
10. The Plaintiff and Defendant have legally and
beneficially acquired property both real and personal during
their marriage from August 24, 1985.
11. The Plaintiff requests the Court to equitably divide
all marital property pursuant to the applicable provisions of the
Pennsylvania Divorce Code.
WHEREFORE, the Plaintiff, EDWARD J. HEFFERNAN, III, prays
your Honorable Court to:
(a) enter a decree of divorce, divorcing the Plaintiff
from the bonds of matrimony heretofore existing between
the Plaintiff and the Defendant;

(b) order equitable distribution of marital property;
and
(c) order such other relief as the Court deems just
and reasonable.

non-marital assets to Defendant's knowledge.
