Appellant CIVIL ACTION JURY TRIAL DEMANDED PRAECIPE TO mE PROmONOTARY TO MARK APPEAL STRICKEN FROM mE RECORD AND NOW, comes the appellee, Thomas 8, York, and tiles this praecipe to the prothonotary to strike the appeal pursuant to Pa. R.C,P. No. 1006, and avers the following: I. The appellant, Gregg Carignan/Gregg's Nursery, tiled an appeal from the judgment entered by the District Justice on March 8, 1995. 2. The appellant did not tile the proof of service of his notice of appeal until March 22, 1995. 3. Pa, R.C.P, No, 10058 requires that proof of service be tiled within ten (10) days after filing the notice of appeal. 4. The appellant has violated the requirements of Pa, R.C,P, 10058. 5. Pa, R.C,P. 1006 directs that "the prothonotary shall, upon praecipe of the appellee, mark the appeal stricken from the record. "
