COMPLAINT
1. Plaintiff is Margaret Dyarman, an individual
residing at 1030 Trindle Road, Carlisle, Cumberland County,
Pennsylvania, 17013.
2. Defendant is a Pennsylvania Corporation known as
Koolvent Aluminum Products, Inc., doing business at 1981
Fulling Mill Road, Middletown, Pennsylvania, 17057.
3. On or about October 17, 1994, plaintiff Margaret
Dyarman received a phone call regarding home improvements.
4. On or about October 17, 1994, Plaintiff agreed to
accept a visit at her home from a Koolvent salesman.
5. On October 17, 1994, Plaintiff signed a Home
Improvement Contract for windows and doors for her home and
the home occupied by her granddaughter. A copy of the
contract is attached hereto and made a part hereof as
Exhibit A.
6. The contract was in the amount of $14,569.20 for
work which a reputable contractor has estimated can be
performed for one-half that amount.
7. Plaintiff is 78 years of age and is unable to read
ordinary print unless using a strong magnifying glass.
8. Plaintiff told the Koolvent salesman that she was
unable to sign the contract unless she used the large
magnifying glass.
9. Even with the large magnifying glass Plaintiff was
unable to read the contract and the salesman did not read it
to her.
10. The salesman filled out the Plaintiff's check for
$5,000 and Plaintiff then used the magnifying glass to sign
the check for the required deposit.
11. The check was dated October 17, 1994 and was
deposited by Defendant on October 17, 1994. A copy of the
cancelled check is attached hereto and made a part hereof as
Exhibit "B".
12. On or about November 1, 1994, Plaintiff advised
Defendant to cancel the contract.
13. Plaintiff has requested return of her check for
$5,000 and defendant has refused.
14. Defendants did not com~ly with the Unfair
Practices and Consumer Protection Law, 73 P.S. Section 201-
7(2)(h) in negotiating Plaintiff'S check during the three
(3) day cancellation period.
15. Defendants did not comply with the Plain Language
Consumer Contract Act, 73 P.S. 2205 (d)(l)(i) in not stating
that Plaintiff could lose her house or property if she did
not meet the contract obligations.
16. Defendants were overreaching and the contract is
unconscionable in causing a consumer with a disability to
