Coutt, Apt. 4, Mechanlcsburg, County of Cumberland, Pennsylvania, 17055, and has
resided there since April 1, 1994, the parties having separated on April 1, 1994.
3. Plaintiff has been a bona fide resident In the Commonweaith for at
least six months Immediately previous to the filing of this Complaint.

Newville, Pennsylvania.

From Aplill, 1994 to present, at 12 Oak JUdge Road, Carlisle, Pennsylvania,
with the Plaintiff, Sharon M, Peoples, the natural son of Sharon M, Peoples, Michael

15, The mother of the child Is the Plaintiff, She Is married to the
Defendant and resides with the child and her son, Michael Frownfelter.
16, The father of the child Is the Defendant. He Is married to the
Plaintiff and does not reside with Plaintiff or the child,
17, Plaintiff has not participated as a party or witness, or In another
capacity, In other litigation concerning the custody of the child In this or another
Court.
18, Otherthan as stated above, Plaintiff has no Infonnatlon of a custody
proceeding concerning the child pending In a Court of this Commonwealth.
19. Plaintiff does not know of any other person or party to the
proceedings who has physical custody of the child or claims to have custody or
visitation lights with respect to the clllld,
20. The best Interest and pennanent welfare of the child will be served
by granting the relief requested because the Plaintiff is a loving parent able to care for
the child and custody will afford the clllld the maximum stability In his home
environment.
21. Each parent whose parental rights to the clllld have not been

PETITION FOR PROTECTIVE ORDER RELATING TO CHILD CUSTODY
COMES NOW, the natural mother, Plaintiff above, by her
attorney, Samuel W. Milkes, Jacobsen & Milkes, and requests of
this Honorable Court that it enter a protective order, directing
the natural father, Defendant above, from bringing to the child's
attention, eertain confidential information, which the natural
father has threatened to do as a leverage tactic in the eontext
of divorce negotiations. In support of this request, Plaintiff
avers as follows:
1. Plaintiff and Defendant are the natural parents of
an eight-year-old child, Kyle A. Peoples, born February 10, 1987.
2. By stipulation dated April 25, 1995, and by Order
dated April 27, 1995, legal eustody of the above child is shared,
while the mother has primary physical custody.
3. Through eounsel, the parties have undertaken
negotiations regarding settlement of their divoree action,
docketed at 95-1241.
4. On July 17, 1995, the date pre-hearing statements
were to be supplied the Divorce Master, the parties informed Mr.
Elieker that they were sufficiently close to a settlemen~ that

they agreed to generally defer the submission of statements.
5. Since this date, through counsel, the Defendant has
notified Plaintiff that he is no longer willing to agree to the
terms previously negotiated.
6. Since this date, the Defendant has stated direetly
to Plaintiff that if she did not agree to his new terms for
settlement of the divorce, he would divulge eertain confidential
and sensitive information to the ehild, Kyle. The information to
be divulged is of no benefit or interest to the child and its
revelation would serve only to alienate the ehild from his
mother. The information to be divulged is mentioned in an August
11, 1995 letter from Defendant's counsel, Ellen Wargo, Esq., to
Plaintiff's counsel (although the threat to divulge is not
contained in this letter).
., 7. On this date, the Plaintiff has written the Divoree
Master, informing him that a new deadline needs to be established
for the submission of pre hearing statements, since a settlement
has not in fact been reaehed.
B. Plaintiff believes, and therefore avers, that in
light of the above, unless directed to do otherwise, the
Defendant will reveal this sensitive information to the child and

By order of Court of President Judge Harold E. Sheely
dated June 6, 1995, the full-time Master has been appointed in
the above referenced divoree proceedings.
A divorce complaint was filed on March 9, 1995, raising
grounds for divorce of irretrievable breakdown of the marriage
and the economic claim of equitable distribution.
I am unable to determine from the file as to whether or
not the parties are willing to sign affidavits of consent to
allow the divoree to proeeed under Section 3301(c) of the
Domestic Relations Code; however, based on the assumption that
grounds for divorce are not at issue, I am directing Mr. Milkes
and Mr. Peoples, who apparently represents himself, to eaeh file
a pre-trial statement in accordance with P.R.C.P. 1920.33(b) on
or before Friday, June 30, 1995. Upon receipt of the pre-trial
statements I will immediately schedule a pre-hearing conference
with Mr. Milkes and Mr. Peoples, if he remains unrepresented, to
diseuss the issues and, if necessary, schedule a hearing.

Plaintiff lists all property in whieh either or both spouses
have a legal or equitable interest individually or with any other
person as of the date this action was eommeneed:
1. Real property located at 12 Oakridge Road,
Carlisle, Cumberland County, Pennsylvania was purchased in
October 1993. The parties separated April 1, 1994. Sinee the
date of separation, wife has assumed full responsibility for
mortgage and related payments. $142,900.00 was financed on this
home. As of May 1, 1994, the balanee owing was $141,617.00. As
of June 29, 1995, the balance owing was $140,385.00. As of the
date of separation, the home had less value than the obligation
on the home, less antieipated closing eosts, were the home to go
to sale.
2. Two vehicles exist: one 1991 Jeep, currently in
the possession of Scott Peoples, and one 1989 Tempo, currently in
the possession of Sharon Peoples. Both vehieles are titled in
joint names.
3. Household furnishings. Miscellaneous household
furnishings exist; most of which have already been divided up by
agreement of the parties. Items on whieh agreement has not been
reached inelude a washing machine and dryer (having a value of
$300 each), eurrently in wife's possession; guns (having a value
of $2,100), eurrently in husband's possession; and a living room
set and eoueh (having a value of $600.00), eurrently in husband's
possession.
4. Musical equipment, currently in possession of
Defendant, having a value of approximately $3,500.00.

NON-MARITAL PROPERTY
Plaintiff lists all property in which a spouse has a
legal or equitable interest which is elaimed to be excluded from
marital property:
1. Motoreycle, in Defendant's name, whieh is the
possession of Michael, the minor son of the Plaintiff, and which
has a value of $300.00.

2. Various items of personal property and furnishings
purchased by Plaintiff since the date of separation.
EXPERTS
The Plaintiff anticipates the possible need to call an
expert for the purpose of evaluating the value of the real estate
and to appraise some personal property.
WITNESSES
Wife will be a witness and she anticipates the possibility
of calling other witnesses, such as family members, if the
existence of any of the items of personal property is disputed.
EXHIBITS
Attached are exhibits whieh Plaintiff would intend to offer
at the Master's hearing. Plaintiff reserves the right to
supplement this list of exhibits.
GROSS INCOME. NET INCOME. AND EXPENSES
The minor child of the parties resides primarily with wife
and wife's 14-year-old son, not of the marriage also resides with
wife.
Wife's current gross income is approximately $538.00 per
week, or an annual gross of $27,976.00. Her net ineome is
approximately $421.00, or an annual net of $21,898.00. She also
reeeives monthly ehild support of $320.00 from the Defendant
toward the support of their child, Kyle.
Wife's regular monthly expenses are:

PENSION/RETIREMENT
Until the date of separation, each party has a retirement
available through his or her present or prior employment. The
values are not clear at the present time but are estimated to be
approximately the saros.
COUNSEL FEES
Eaeh party has been incurring his or her own counsel fees.
TANGIBLE PERSONAL PROPERTY
Plaintiff elaims entitlement to various items of marital
tangible personal property and non-marital property as described
above.
MARITAL DEBTS
The primary marital debts inelude the mortgage eonnected
with the purchase of the real estate deseribed above, and the
following additional debts:
Federal Ineome Tax past due: in exeess of $600.00 eurrently
owing.
One bank loans with Farmers Trust Co.: Total of $4,414.00.
Payment on these loans totals $316.00 per month. Plaintiff to be
credited with payments made on this account since the separation
of the parties.
Montgomery Wards eharge cards, with separate accounts held
by each of the parties.
Ford Citibank VISA, jointly held: eurrent balanee of
approximately $2,400.00. Plaintiff to be credited with payments
made on this aceount since the separation of the parties.
PROPOSED RESOLUTION
Wife proposes that she assume ownership of the home, by
financing the same in her name only within four years of the date
the Master's Deeision, or any appeal, becomes final. Under this
provision, wife assumes any equity or shortfall, should the home
be foreed to sale, due to her inability to finanee. Should the
home be forced to sale immediately, the parties would assume
equal responsibility for any shortfall needed to be made up at
settlement and wife will have distributed to her, from husband,
the increased value in the residence from date of separation to
date of sale. If a profit is realized from the immediate sale,
wife would receive any profit attributable to increased value
sinee the date of separation, the parties would share equally the
closing eosts.
with respsct to the marital debts, wife proposes that the
parties split equally the liability on the income tax, Farmers
Trust, and VISA debts set forth above, dating back to date of
separation, or incurring of debt, in the case of the case of the
tax debt. Husband is to aeeount for one half the interest on
these debts paid by wife since the separation.
Each party will retain the respeetive vehicle now in his or
her possession.
Personal property will remain with the person now possessing
the same but husband will be directed to pay to wife one-half the
value of the property retained by him, to the extent this value
exceeds the value of the property retained by wife. The two guns
currently registered in wife's name will be registered in
husband's name.

The Defendant, Scott peoples, does hereby file the following
pre-trial statement:

B. Non-Marital Assets
1. Any property acquired by either party since date of
separation on April 1, 1994.
(2.) EXPERT WITNESSES - At this time Defendant has not hires any
experts I Defendant reserves the right to call as an expert
witness an appraiser of the fair market value and rental value of
the parties' real property and an appraiser of the parties
personal property.
b. Copies of Defendant's Income Tax and/or W-2 state-
ments for 1994;
c. A copy of Defendant's year-to-date net and gross
as of the date of the special Master's Hearing.
d. A copy of the Blue Book valuation of the parties'
vehicles.
(3.) WITNESSES - Defendant docs not know of any other witnesses
at this time, but reserves the right to call such witnesses.
Defendant might possibly expect to call witnesses with regard to
the issue of economic matters.
(4.) EXHIBITS - ~t this time, the plaintiff expects to provide
the following exhi~its at trial:
a. A copy of the deed, mortgage, and payoff spreadsheet for
the parties' marital residence.
e. A copy of the parties' Request for Tax Payment for the
tax peliod 1993, dated August 21, 1995.
f. A copy of the Montgomery Ward spreadsheet detailing
appliance purchases dated January 1993.
g. A copy of Ford citibank Visa statement, dated 5/19/94.
(5.) GROSS INCOME - 1994 Tax information plus year-to-date net
and gross will be supplied at the time of the hearing. In 1994
Defendant's gross income was $ 40,192.50.
(6.) EXPENSES - An Income and Expense Sheet on the form provided
by the. Domestic Relations Office of Lebanon County will be
presented at the time of the hearing.
(7.) RETIREMENT BENEFITS - Neither plaintiff nor the Defendant
have any retirement benefits which accrued during marriage.
(8.) COUNSEL FEES - plaintiff has not requested counsel fees and
expenses in her Complaint, nor has she requested the Special
Master to resolve this issue. d
(9.) PERSONA! PROPERTY - It is believed the plaintiff and
Defendant are satisfied with the distribution of the personal
property located within the home except for some minor items of
personal property the Defendant desi~es, inclUding his mother's
hutch, non-marital property.
10. pEBTS - The parties have a mortgage on the jointly owned
premises. The approximate balance of the mortgage is $139,545.
In addition, the parties were indebted to Ford citibank Visa for
$2,419.10 at the time of separation, Farmers Trust for $6,224 as
of June 1995, the Internal Revenue Service for $648.00 as of
~ugust 1995, and Montgomery Ward for approximately $987.00 at

the time of separation.
(11.) PROPOSED RESOLUTION - Defendant proposes
1. Plaintiff retains the marital home and personal household
property in exchange for a credit of $8,000 to Defendant,
APproximately one-half the down-payment on the home, and the
release of Defendant on the mortgage;
2. An even exchange of credits to plaintiff for the maintenance
of the marital residence post-separation and to Defendant for
rental credits for plaintiff's family's use of the marital home;
3. A SO/50 division of the Farmer Trust, Ford Citibank Visa,
Internal Revenue, and Montgomery Ward marital debts;
4. Each party retains the vehicle in his/her possession and the
respective vehicle's lien;
To achieve this distribution, plaintiff retains the marital
residence, personal household property, and the 1989 Ford Tempo
and plaintiff releases Defendant from the marital debts (except
the lien on the 1991 Jeep Wrangler) and pays Defendant $2,278
($2,419 + $648 + $6,224 + $987 - $8,000). Defendant retains the
1991 Jeep Wrangler along with its lien.

I am writing in response to Mr. Milkes' letter of August
23, 1995, advising that the parties are apparently unable to
resolve the outstanding issues and would like to proceed through
the Master's office.
As counsel are aware, my previous directive to file
pre-trial statements on July 14, 1995, was withdrawn pending
settlement. Since settlement negotiations have broken down, Mr.
Milkes has requested that I direct the filing of pre-trial
statements again.
In accordance with P.R.C.P. 1920.33(b) I am directing
each counsel to file a pre-trial statement on or before Monday,
September 25, 1995. Upon receipt of the pre-trial statements I
will immediately schedule a pre-hearing conference with counsel

PETITION FOR ENFORCEMENT OF MARITAL AGREEMENT
COMES NOW, the Plaintiff in the nbave-referenced action, SHARON M.
PEOPLES, by her attorney, Samuel W. Milkes, and requests of this court that it issue
a rule upan the Defendant to show cause why a judgment should not be entered
against him in the amount of $314.00 for his failure to pay Plaintiff, as provided for
under this Agreement. Plaintiff further avers as follaws:
1. The parties entered into a Marital Separation Agreement on the 4th day
of December, 1995.
2. Under the terms of this Agreement, by February 29, 1996, the Defendant
was to pay to Plaintiff, SHARON M. PEOPLES, the amount of $900.00.
3. The Plaintiff was to utilize $653.00 of this amount toward delinquent
taxes awed by the parties in the name of the Defendant, but representing a liability
of both parties.
4. When the payment was due by Defendant, Plaintiff was unable ta
determine for certain where to forward the IRS past due taxes. Defendant failed ta
pay Plaintiff $653 of the amaunt that he owed Plaintiff.
5. Since the filing of her tax return for 1995, the Plaintiff has had deducted
against her refund, an amount of $514,00, representing the past due taxes which were

addressed in this Agreement and which were to be paid by the Defendant.
6. To date, the Defendant has failed to and continues ta fnll to pay Plaintiff
the amount owing under the Marital Separation Agreement.
WHEREFORE, for the abave-refel'encedreasons, Plaintiff asks that judgement
be entered against the Defendant in the amount of $314.00, together with interest,
costs, and attorney fees represented In the pursuit of this enforcement action.

WHEREAS, it is the desire oC the parties, aCter careful consideration, to adjust amicably,
compromise and seltle all property rights in, to or against each other's property or Estate including
all property heretoCore or subsequently acquired by either party, and to settle all disputes c.'dsting
between tllem. including any and all claims Cor equitable distribution oC marital property and Cor
spousal maintenance and/or support, alimony, counsel Cees and costs; and
WHEREAS, Husband and Wife are represented by legal counsel who have advised him and
her oC their respective rights, privileges, duties and obligations relative to tlleir property rights and
interests, relative to alimony and spousal support. and relative to child support; and
NOW, THEREFORE. the parties hereto, intending to be legally bound hereby, do covenant
and agree as Collows:
1. VOLUNTARY AGREEMENT: The parties acknowledge and agree that this
Agrt!ement is entered into voluntarily snd aCter due deliberation by each oC them.
2. DIVORCE ACTION: The parties acknowledge their intention thattht! action Cor
divurce betwt!t!n them will bt! finulized upon thdr mutual const!nt 10 the entry oC a Cinal decree in
divorct! on the grounus that their marriage is irretrievably broken. und thut all the claims which have
been or might be raised by either party in the divorce action will be seltled in accordunce with the
terms oC this Marital Settlement Agreement. TIle parties acknowledge that they have executed
simultoneously herewith the necessary Affidavits oC Consent Cor the entry oC a final divorce decree

3. SURVIVAL OF AGREEMENTl TIlis Agreement and all warranties and
representations herein shall survive any divorce proceedings between the parties or any Divorce
Decree which muy be entered nnd shull continue to be enforceable in uccordance with its terms.

Except as otherwise set forth herein, no Court may change tho terms of this Agreement, and it shnll
be binding and conclusive upon the parties as though entered as in 0 final Order of Court resolving
all economic issues between the parties in a divorce action. An action may be brought at low, in
equilY or pursuant to the provisions of the Divorce Code to enforce this Agreement by either
Husband or Wife. [n the event of a reconciliation, or attempted reconciliation of the parties after
the date hereof, this Agreement shall remain in full force 6nd effect in the absence of a written
Agreement signed by the parties expressly stating that this Agreement has been revoked or modified.
No Court may change the terms of this Agreement, except as may herein otherwise be expressly
provided.
4.. REAL PROPERTYI
o. The parties acknowledge that they are Mortgagors on a home which they are
purchasing located at12 Oak Ridge Road, Carlisle, Pennsylvania. In consideration of the terms set
forth in this Agreement, and in further consideration os set forth within this paragraph. the parties
agree os follows.
i. Sharon 1\1. Peoples will assume full and sole responsibility for payment on
the first mortgage connected with this real property. She has made said payments since the
separation of the parties and will continue to do so. This responsibility includes, payment on any
tones due in connection with the property itself. Within a period of two years from the date of this
Agreement, Sharon Peoples sholl obtain independent financing of the real property. thereby releasing
Scott D. Peoples from his stVlus os a Mortgagor on this property. If within the two year period.
Sharon Peoples is unable to obtain independent financing then the parties agree that the home would
then be sold, in order to satisfy the debt on the property, and that any excess funds realized out of

the sole would become the sole property of Sharon Peoples, reflecting her continued payment on the
Mortgage,
ii. At such time os Sharon M. Peoples is able to rcfinonce or sell the real
property described above, Scott D. Peoples sholl convey and deed to Sharon M. Peoples, her
successor or assign, his interest in the real property described, so long os the refinance or laic by
Sharon M. Pcoplcs will also hove the effecl of releasing Scott D. Peoples from the current mortgage
on this property.
iii. If the within described property is to go to sole, due to expiration of the
two year period described above, each of the parties agrees to execute any ond all documents
necessary to sell ond convey said property at fair market value. If the property is to be sold at on
amount less than the costs of sole, including the mortgage, the Sharon M. Peoples sholl assume this
deficiency amount.
iv. If at any time before sole of the home or refinancing by Sharon M.
Pcoples, she should become delinqucnt in payment of any mortgage payment by thirty days or more,
the home sholl then immediately be listed for sole, ond sold at the first reasonable offer.
5. PERSONAL PROPERTY: It is agreed that as of the dote of execution of this
Agreement, any and all other property, whether il considered marital or otherwi~e, sholl be and
considered fully owned by the party currently in possession of said property.
6. MOTOR VEHICLES:
a. TIle parties agree that the 1991 Jeep sholl be and remain the sole property of
Scott D. Peoples and that he sholl continue to make payment on said vehicle until it has been
completely paid off.

7. DEBTS OF THE PARTIESl TIle parties agrce that Ihe Collowing marital debts
exist:
a. Citibank Visa Card.
b. Fonner's Trust ,econd mortgage or Home Equity Loon.
c. Uability for post Federal Income Taxalion, for Ihe year 1993.
The marital debls are to be divided as followsl payment in the amount of four tllousand four
hundred dollars (54,'lOO) Crom Scotl D. Peoples 10 Sharon M. Peoples, 53,500 on the date oC signing
of Ihis Agreement, and 5900 by February 29, 1996. Sharon M. Peoples agrees to assume full
respunsibility Cur completion oC paymenl on the IWO bank deb IS and the income tax debt.
The parties ore aware of no other maritol debts and ugree lhut each will assume full
respunsibility Cor any olher debts incurred in his or her name since the date of separation.
TIle parties agree lhat they will not in the Cuture contract or incur any debt or liability Cor
which the other party, his or her property or eslate, might be responsible and each Curther agrees 10
indemniCy and save hannless Ihe olher party against any claims that may be asserted by anyone
againsl the olher party by reason lhereof.
8. BONUS PAYMENTS I Scotl D. Peoples may receive Crom time 10 lime, bonus
payments through his employment. TIle parties agree lhat Sharon M. Peoples disclaims any right

or claim to such bonus paymcnts. Further, such paymcnts will not be considered as a factor In
detennining Scott D. Peoples' income, for purposes of calculoting child support obligations, so long

9. EXECUTION OF DOCUMENTSI Each of the parties shall, from time to time at
the request of each other, execute, acknowledge and deliver to the other party any and all further
insln1ments that may reasonably be required in order to give full force and effect 10 the provisions
of this Agreement.
10. COUNSEL FEESI Each party agrees to be individually responsible for all court
costs, filing fees, aUomeys fees and other costs and expenses he or she may have incurred in
connection with the divorce action between the parties, the support action between the parties and
the preparation of this Agreement.
11. MUTUAL RELEASEI Except as provided for in this Agreement, the parties hereby
remise, release, quil-claim and forever discharge each other and the estate of each other, for all time
to come, and for all purposes whatsoever, from any and every claim, Including alimony, alimony
pendente lite, equitable distribution of marital property. counsel fees or costs under the Divorce
Refonn Act or spousal support, excepting only such rights of inheritance or other claims that they
may make or hereafter make in and to or against each other's estates or any parts thereof, by way
or dower or curtesy, or under Ihe intestate laws, or Ihe right to take or elect against the other's will,
except as expressly limited by Ihe tenns of this Agreement.
12. NON. WAIVERI The failure of either party to insist in anyone or more instances
upon the stricI perfonnance of any of the tenns hereof in this Agreement shall not be conSlnled as

a waiver or relinquishment of such tenn or tenns "I the future.
13. BREACH: [n the event that either party breaches any provision of this Agreement,
he or she sholl be responsible for any and all costs inculTed to enforce the Agreement, including,
but not limited to, court costs and counsel fees of the other party. In the event of breach, the other
party shall hove the right, at his or her election, to sue for damages for such breach or to seck such
other and additional remedies os may be available to him or her.
14. ENFORCEMENT: The parties agree that the terms of this Agreement particularly
including the custody agreement, may be entered os separale Orders of Court, and that any port or
ports hereof may be enforced in any court of competent jurisdiction.
15. FURTHER ACTS OFTHE PARTIES: TIle parties agree that they will take such
acts or execute such documents os are necessary to effectuate the tenns of Ihis Agreement.
16. APPLICABLE LAW AND EXECUTION: The parties hereto agree thai this
Agreement shall be construed under the laws of the Commonwealth of Pennsylvanio, and shall bind
the parties hereto, and their respective heirs. executors and assigns. TIlis Agreement shall be
executed os original in triplicate.
17. ENTIRE AGREEMENTI TIle parties acknowledge and agree that this I\IAIUTAL
SETILEMENT AGREEI\IENT con to ins the entire understanding of the parties'and supersedes
sny prior agreement between them. TIlcre ore no other representations, won-antics, promises,
covenants or understandings between the parties other than those expressly set forth herein.
18. INCORPORATION IN JUDGMENT FOR DIVORCE: In the event that either
Husband or Wife at any time hereafter obtain a divorce in the action for divorce presently pending
between them, or otherwise, this MARITAL SETILE:vIENT AGREEMENT and all of its

provisions shall be incorporatcd into any such judgment for divorce, either directly or by reference.

each have detennined to complete this MARITAL SETTLEMENT AGREEMENT and that each

SETTLEMENT AGREEMENT is in the circumstances, fair and equitable, and that it is being
entered into rreely and voluntarily after Wife has consulted with her attorney, SAMUEL W.
MILKES, ESQ., and Husband has consulted with ELLEN O. WARGO, ESQ. The enecution of
the MARITAL SETTLEMENT AGREEMENT is not the result or any duress or undue influence,
and it is not the result of any collusion or improper iJlegal agreement or agreements. The ponies
acknowledge that each has been rully inronned with the wealth, property state, and income or the
other, and each party is hereby satisfied that such inronnation is true and correct.
