NOW COMES, plaintiff, Rose Elizabeth Brehm, by and through her
attorney, John L. Perry, Esquire, and states the following:
1. plaintiff is Rose Elizabeth whose current residence is
212 ponderosa Roa~, Carlisle, pennsylvania, 17013.
2. Ddtendan):' is James Irvin Brehm, Jr., whose current
residence is 306 East Pomfret street, York, Pennsylvania, 17403.
3. plaintiff and Defendant have been bona fide residents of
the commonwealth for at least six months immediately preceding the
filing of this complaint.
4. The plaintiff and Defendant were married on December 31,
1992 in Carlisle, pennsYlvania.
5. There has been no prior actions of divorce filed in this
matter.
6. The marriage is irretrievably broken, and the parties are
proceeding under section 3301 (c) of the Divorce code

3. Defendant has threatened to remove furnishings, household
goods and other personal property belonging to Plaintiff/Petitioner
and her minor children from a prior marriage.
4. Based upon Defendant's past practice of removing items of
personal property from the marital residence, Petitioner believes,
and therefore avers, that Defendant will remove, or attempt to
remove, additional furnishings and personal property prior to a
final determination of this case.
5. The status quo should be maintained in order to preserve
the marital estate for ultimate disposition by this Court in a fair
and equitable manner.
6. Neither party should be permitted to employ self-help or
any other means to remove or otherwise convey assets of the marital
estate.
WHEREFORE, Petitioner/Plaintiff respectfully requests this

for Injunctive Relief, it is hereby ordered and decreed as follows:
1. The Emergency petition for Injunctive Relief filed by the
plaintiff/Petitioner on october 6, 1995 is hereby dismissed.
2. The Order of Court entered on October 6, 1995, enjoining
the Defendant/Respondent from removing certain property from the
marital residence and setting a date for a hearing on the merits of

NOW COMES, plaintiff/Petitioner, Rose Elizabeth Brehm, by and
through her attorney, John L. Perry, Esquire, and states the
following:
1. On or about October 6, 1995, plaintiff/petitioner filed
an Emergency petition for Injunctive Relief with this Court.
2. At the time of the filing of this Emergency petition,
plaintiff/petitioner and Defendant/Respondent were residing at the
marital residence at 212 Ponderosa Road, Carlisle, pennsylvania.
3. plaintiff/Petitioner requested that this Court enjoin
Defendant/Respondent from removing any furniture, household goods
or other property other than property individually owned by!him,
from the marital residen~e.
4. On October 6, 1995, this Honorable Court issued an Order
enjoining the Defendant/Respondent from removing furniture,
household goods or other personal property, other than property
owned individually by him, from the marital residence.
5. This Order further scheduled a hearing on the merits, to
determine whether or not this preliminary Injunction should be
continued, to be held on November 20, 1995 at 9:30 a.m. in.
courtroom 5, Cumberland county Courthouse.

6. On or about November 9, 1995, Defendant/Respondent moved from
the marital residence, taking with him only that property which was
individually owned by him.
