AND NOW, comes PlalntHr, JoAnn Heyer, by and through her attorneys, The
Law Offices of Darral1 C. Dethlefs and represents as follows:
1. Plaintiff, JoAnn Heyer, Is an adult individual residing at 4173 Grouse
Court, Apartment 105, Hechanlcsburg, Cumberland County, Pennsylvania 17055.
2. Defendant, Jam L Blymler, is an adult IndiVidual residIng at 39
Regency South, Carlisle, Cumberland County, Pennsylvania 17013.
3. On November 15, 1990, PlaIntiff and Defendant purchased a moblle
home located at 39 Regency South, Carlisle, Cumberland County, Pennsylvania
(hereln~fter "Noblle Home") for $36,720.00. (The Purchase Agreement Is attached
hereto as EKhlblt "A".l
<t. At the time of the purchase of the mobile home, Plaintiff and Defendant
paid $5,606.00 as a down payment.
5, At least one-half (1/2) ofthe down payment money was proY1ded by
the Plalnl1ff, Joann Hel-ler.
6. From November IS, 1990 throogh the date the PlaIntIff was forced to
move out of the mobile home, PlaIntiff made moothlY payments 00 the loan whIch was
used to flnance the remainder of the plr'chase price of the trailer.
7, FollowIng an epIsode where the Defendant threatened to kl1l the
Plaintiff, the PlaintIff moved out of saId mobile home on October 26, 1993.
6. The mobile home Is presently valued at $42,900.00.
9. The payoff for the mortgage for saId mobIle home as of December 16,
1994 was $29,979.16.
10. Defendant has been unjustly enriched due to his actions which forced
Plaintiff fl1lm the mobile home.
WHEREFORE, Plaintiff respectfully requests Judgment against Defendant In
the amount of $6,460.41, which represents one-half (1/2) of the equity presentlY In
the trailer, plUS costs and Interest
