By way of further answer, however, Defendant, CAROL KERSTETTER, denies being responsible for payment for any services rendered to Defendant, WILLIAM KERSTETTER. By way of further answer, however, it is speoifically denied that the unpaid balance alleged by Plaintiff is the responsibility of Defendant, CAROL KERSTETTER. 6. It is admitted that Defendant, CAROL KERSTETTER, has refused to pay any sum of money to Plaintiff. By way of further answer, however, it is averred that there is no responsibility or legal liability on Defendant, CAROL KERSTETTER, to make any such payment for anesthesia services allegedly rendered to her ex-husband. After reasonable investigation, Defendant, CAROL KERSTETTER, is without knowledge or information sufficient to form a belief as to the truth of the allegation that Defendant, WILLIAM KERSTETTER, has failed and refused to pay any balance he owes to Plaintiff. The same is therefore specifically denied, and proof thereof is demanded at trial. 7. Admitted as to Defendant, CAROL KERSTETTER. After reasonable investigation, Defendant, CAROL KERSTETTER, is without knowledge or information sufficient to form a belief as to the truth of the allegations of paragraph 7 as to Defendant, WILLIAM KERSTETTER. Defendants, WILLIAM KERSTETTER and CAROL KERSTETTER, were formerly married, but were divorced by decree of the Court of Common Pleas of Cumberland County, Pennsylvania, docketed to No. 3541 civil 1993 and entered on December 29, 1993. 9. Defendants, WILLIAM KERSTETTER and CAROL KERSTETTER, resided separate and apart from one another continuously subsequent to May, 1991. 10. FOllowing the separation of Defendants in May, 1991, they at all times maintained separate finances and did not commingle their funds or engage in any joint financial transactions. 11. At no time during the separation of the Defendants was an Order of Court entered requiring Defendant, CAROL KERSTETTER, to provide support of any nature for Defendant, WILLIAM KERSTETTER, nor was she at any time required to provide medical insurance coverage for his benefit. 12. Defendant, CAROL KERSTETTER, instituted divorce proceedings in the Court of Common Pleas of Cumberland county, Pennsylvania, docketed to No. 3541 civil 1993, following the expiration of the two-year period of separation required by the Divorce Code, 23 Pa.C.S. A3l01 et seq., for her to obtain a no- , . ,-;"", ,,<"' ,"" .", '" ",,'" " "'r--~--_ .,~...- . fault divorce without her husband's consent. 13. In connection with the divorce of the parties, they entered into a Marital settlement Agreement, dated August 3, . 1993, whereby they settled and resolved their respective rights and responsibilities vis-a-vis each other. A true and correct copy of the said Agreement is attached hereto as Exhibit "A" and made a part hereof. 14. Pursuant to Paragraph 4 of the said Marital Settlement Agreement, Defendant, WILLIAM KERSTETTER, assumed full responsibility for any and all debts or liabilities he incurred following the separation of Defendants in May, 1991, and he further promised to indemnify and save Defendant, CAROL KERSTETTER, harmless from any and all claims and demands reSUlting from such debts or obligations. 15. The said Marital Settlement Agreement also contained mutual releases, whereby each party waived and released any claim against the other except those rights set forth in the said Agreement. 16. Defendant, CAROL KERSTETTER, was never involved with any treatment or medical services that the Plaintiff may have rendered to Defendant, WILLIAM KERSTETTER, and was completely unaware of such treatment or services or of any charges therefor until she was served with a Complaint filed by Plaintiff with District Justice Charles Clement on January ]9, 1995. 17. Defendant, CAROL KERSTETTER, at no time entered into any contract or agreement, oral or written, with Plaintiff whereby she agreed to pay for any services rendered to Defendant, WILLIAM KERSTETTER, or to guarantee his payment for such services. 18. The Plaintiff has never issued any billing in any amount to Defendant, CAROL KERSTETTER, related to the services allegedly performed for Defendant, WILLIAM KERSTETTER. 19. SEPARATION. It shall be lawful for Husband and Wife at all times hereafter to live separate and apart from each other and to reside, from time to time, at such place or places as they shall respectively deem fit, free from any control, restraint or interference, direct or indirect, by each other. Neither party shall molest the other or compel or endeavor to compel the other to cohabit or dwell with him or her by any legal or other proceedings. The foregoing provision shall not be taken to be an admission on the part of either party of the lawfulness or unlawfulness of the caUses leading to their living apart. 2. SUBSEOUENT DIVORCE. Should a decree, judgment or order of separation or divorce be obtained by either of the parties in this or any other state, country or jurisdiction, each of the parties hereby consents and agrees that this Agreement and all of its covenants shall not be affected in any way by any such separation or divorce; and that nothing in any such decree, judgment, order or further modification or revision thereof shall J alter, amond or vary any I:orm of this Agreement, whether or not .ithor or both of the parties shall remarry, it being understood by and between the parties hereto that this Agreement shall lIurvlvo and oha11 not be merged into any decree, judgment, or order of divoroe or separation. Notwithstanding the provisions of the Pennsylvania Divorce Code or of any law to the contrary, none of the terms and provloions of this Agreement shall be subject to modification by tho, Court or in any fashion other than asset forth hereinafter. It is specifically agreed, however, that this Agreement shall be subject to enforcement under the provisions of the Pennsylvania Divoroe Code or, at the option at the aggrieved party, by a suit against the alloged breaching party either in law or in equity. 3. EFFECTIVE DATE. The effective date of this Agreoment shall be the "date of execution" or "execution date", defined as the date upon which it is executed by the parties if they have each executed the Agreement on the same date. 4 otherwise, the "date of execution" or "execution date" of this Agreement shall be defined as the date of execution by the party last executing this Agreement. 4. DEBTS AND OBLIGATION/!. Husband represents and warrants to Wife that since the separation he has not, ana in the future he will not, contract or incur any debt or liability for which Wife or her estate might be responsible, and he shall indemnify and save Wife harmless from any and all claims or demands made against her by reason of such debts or obligations incurred by him since the date of said separation, except as otherwise set forth herein. Wife represents and warrants to Husband that, since the separation, she has not, and in the future she will not, contract or incur any debt or liability for which Husband or his estate might be responsible, and she shall indemnify and save Husband harmless from any and all claims or demands made against him by reason of such debts or obligations incurred by her since the date of said separation, except as otherwise set forth herein. 5. Husband and I~ife do hereby mutually remise, release, quit-claim or forever discharge the other and the estate of such othe~, for all time to come, and for all purposes whatsoever, from any and all rights, title and interest, or claims in or against the estate of such other, of whatever nature and wherever situate, which he or she now has or 5 at any time hereafter may have against such other, the estate of suoh other or any part thereof, whether arising out of any former aots, oontracts, engagements or liabilities of such other or by way of dower or curtesy; or claims in the nature of dower or curtesy, or widow's or widower's rights, family exemption or similar allowance or under the intestate laws; or the right to take against the spouse's will; or the right to treat a lifetime conveyance by the other as testamentary; or all other rights of a surviving spouse to participate in a deceased spouse's estate, whether arising under the laws of pennsylvania, any state, commonwealth or territory of the United states, or any other country; or any rights which either party may now have or at any time hereafter have for past, present or future support or maintenance, alimony, alimony pendente ~, counsel fees, costs or expenses, whether arising as a result of the marital ~elation or otherwise, except, and only except, all rights and agreements and obligations of whatsoever nature arising or which may arise under this Agreement or for the breach of any provision hereof. It is the intention of Husband and Wife to give to each other by the execution of this Agreement a full, complete and general release with respect to any and all property of any kind or nature, real, personal or mixed, which the other now owns or may hereafter acquire, except, and only except, all rights and agreements and obligations of whatsoever nature arising or which may arise under this Agreement or for the breach of any provision hereof. 6 6. DIVISION OF HOUSEHOLD AND PERSON~L PROPERTY. The parties hereto have divided between themselves, to their mutual satisfaction, all items of tangible and intangible marital property. E~cept as otherwise set forth hereinafter, neither party shall make any claim to any such items of marital property, or of the separate personal property of either party, which are now in the possession and/or under the control of the other. Should it become necessary, the parties each agree to sign, upon request, any titles or documents necessary to give effect to this paragraph. Property shall be deemed to be in the possession or under the control of either party if, in the case of tangible personal property, the item is physically in the possession or control of the party at the time of the signing of this Agreement, and in the case of intangible personal property, if any physical or written evidence of ownership, such as passbook, checkbook, policy or certificate of insurance or other similar writing is in the possession or control of the party. Anything to the contrary contained herein notwithstanding, Husband and Wife shall be deemed to be in the possession and control of any pension or other employee benefit plans or other employee benefits of any nature to which either party may have a vested or contingent right or interest, apart from the provisions of the Divorce Code, at the time of the signing of this Agreement. 7. REAL ESTATE. The parties acknowledge that they are the owners of two parcels of real estate, one situate at 415 7 Third street, tlew Cumberland, Cumberland County, Pennsylvania, and one situate at Lot 4A, 242 Stetler Road, Fairview Township, York county, pennsylvania. The parties agree that the said properties shall be sold as soon as practicable at a mutually agreeable selling price, and they shall hereafter be listed with a reputable licensed real estate broker at all times until sold. The parties shall cooperate in any necessary fashion to expedite the sale of such properties. Because of Husband's extended absence in Canada, Husband shall immediately execute special Powers of Attorney, granting Wife all necessary powers to act on his behalf in connection with the sale of these aforesaid properties. Upon the settlement on the sale of the said properties, the net proceeds, after payment of any outstanding liens, shall be divided into two equal shares, one for each of the parties. From Husband's share, IHfe shall be reimbursed for one-half of all expenses she may have paid in connection with the sale of either property, and for one-half of all payments made by her since the separation of the parties at the end of May, 1991, on account of the Hamilton Dank loan obtained in connection with the purchase of I,ot 41\, 242 Stetler Road, Fairview Township, York County, Pennsylvania, and on account of any real estate taxes or other expenses associated with that property. After reimbursement to Wife as aforesaid, the shares shall be distributed to the parties, who shall thereafter retain them as their sole and separate property. B 8. AFTER-ACQUIRED PROPERTY. The parties specifically waive and relinquish any claims in any property hereafter acquired by the other, including without limitation by specification, the property at 239 Seneca street, Harrisburg, Dauphin county, Pennsylvania, or any other property which Wife intends to purchase. 9. ADDITIONAL INBTRUM~. Each of the parties shall, from time to time at the request of the other, execute, ack- nowledge and deliver to the other party any and all further instruments or documents that may be reasonably required to give full force and effect to the provisions of this Agreement. 10. MODIFICATION AND WAIVER. A modification or waiver of any of the provisions of this Agreement shall be effective only if made in writing and executsd with the same formality as this Agreement. The failure of either party to insist upon the strict performance of any of the provisions of this Agreement shall not be construed as a waiver of any subsequent default of the same or similar nature. 11.
