COMPLAINT
AND NOW COMES plaintiff, JFC Temps, Inc" by and through
its attorney, cheryl A, Pazak, Esquire, and files this
Complaint and specifically avers the following in
support thereof:
1. plaintiff, JFC Temps, Inc, is a corporation
organized and existing by virtue of the laws of the
commonwealth of pennsylvania with a principle place
of business located at 1520 Market street, P.O, Box 869, Camp
Hill. Cumberland county, Pennsylvania,
2, Defendant, Freestech International Ltd, is a
corporation organized and existing by virtue of the laws of
the commonwealth of pennsylvania with a principle place of
business located at 33 Glenola Drive, Leola, Lancaster
county. Pennsylvania,
3, On various dates and times throughout July 1994
through August 1994, as further described in the time sheets
and invoices attached hereto, Plaintiff provided Defendant,
at Defendant's request, temporary employees for Defendant's
company,
4. Plaintiff provided temporary employees to Defendant
on an "as needed" basis whereby the number of temporary
employees desired was determined by the Defendant and
Plaintiff provided temporary employees to fulfill their
requests,
5. Time sheets for the hours worked by the temporary
employees provided by Plaintiff were submitted on a weekly
basis to Defendant for approval,
6, An agent, apparent agent, employee, apparent
employee, servant, apparent servant, or legal representative
of Defendant approved and signed each of the aforementioned
time sheets before they were forwarded to Plaintiff for
billing purposes,
7, Defendant has been billed for said employees'
services, at the terms agreed upon by the Plaintiff and
Defendant, according to the hours worked by those employees
as represented by the time sheets approved by the Defendant,
True and correct copies of said time sheets and invoices sent
to Defendant are attached hereto and incorporated herein by
reference as Exhibit "A",
8, Defendant contracted for and accepted said temporary
employees and has been billed for their services in
accordance with acceptable billing practices,
9, Defendant accepted and agreed to the terms
established by Plaintiff for the employees whereby a set rate
was to be paid for each employee on a per hour basis and
overtime was to be due for any employee working over forty
(40) hours per week.
10, Invoices for employee's services were to be paid
upon receipt and Defendant has failed to comply with this
requirement,
11, Defendant has never disputed the balance due and
owing to plaintiff,
12, Although demand has been made by Plaintiff,
Defendant has failed and/or refused to pay the past due
invoices, which reflect a balance owing to Plaintiff in the
amount of $759,08, plus the additional service charges of
$37.94,
13, Plaintiff's invoices to Defendant have been
outstanding since issued and total $759,08, and per the terms
agreed to, Defendant is subject to a charge of l,8% interest
for each month the invoices are outstanding, Therefore,
Defendant is currently responsible for interest in the amount
of $81,98,
14, Said interest continues to accrue on a monthly
basis,
15, By accepting Plaintiff's employees and by signing
the time sheets for their services, each of which contain the
terms as agreed and accepted by the parties, Defendant has
agreed to be responsible for interest charges, as well as all
collection expenses including attorney's fees and court costs
incurred, in any action for non-payment of invoices submitted
by Plaintiff. A true and correct copy of the aforementioned
terms is attached hereto and incorporated herein by reference
as Exhibit "B",
16. The outstanding balance due and owing JFC Temps,
Inc, to date, excluding costs, can be broken down as follows:

17, Defendant's failure and/or refusal to pay said
balance owed for services received constitutes breach of
contract for such services, and results in an unjust
enrichment to said Defendant and injury to Plaintiff,
WHEREFORE, Plaintiff, JFC Temps, Inc" demands judgment

in its favor for the past due amount of One Thousand
Two Hundred Fifty-eight and 00/100ths Dollars ($1258.00)
in addition to all applicable late charges and interest,
attorney fees, collection expenses and all costs related to
this action.
