You have been named as the Defendant in a Complaint in a divorce proceeding filed
in the Court of Common Pleas of Cumberland County. This notice is to advise you that in
accordance with section 3302(d) of the Divorce Code, you may request that the court
require you and your spouse to attend marriage counseling prior to a divorce being
handed down by the court. A list of professional marriage counselors is available at
the Domestic Relations Office, 13 North lIanover street, Carlisle, Pennsylvania. You are
advised that this list is kept as a convenience to you and you are not bound to choose
a counselor from this list. All necessary arrangements and the cost. of counseling
sessions are to be borne by you aud your spouse.
If you des he to pursue counseling, you must make your request for counseling
within twenty days of the date on which YOIl receive this notice. Failure to do so w111
constitute a waiver of your right to request counseling.

AND NOW comes the above-named Plaintiff, BRADLEY L. SELTZER, by his attorneys,
Andes, Vaughn & Bangs, and makes the following Complaint in Divorce:
1. The Plaintiff is BRADLEY L. SELTZER, an adult individual who currently resides

at 3rd MP Company, Unit 26601 Box 4, APO AE 09036.
2. The Defendant is WENDY D. SELTZER, an adult individual who currently resides
at 4605 Bryan Road, Mechanicsburg, Cumberland County, Pennsylvania 17055.
3. Both the Plaintiff and Defendant have been bona fide residents of the Common-
wealth of Pennsylvania for at least six months immediatelY Ilrevious to the filing ,?f
this Complaint.
4. The Plaintiff and Defendant were married on 21 March 1992 in Altoona,
Pennsylvania.
5. There have been no prior actions of divorce or annulment between the parties.
6. This marriage is irretrievablY broken.
7. Plaintiff has been advised of the availability of marriage counseling and the
plaintiff may llave the right to request that the Court require the parties to partici-
pate in counseiing.

I. A Complaint in Divorce under Section 3301(c) of the Divorce Code was
flied on March 10, 1995, and was served upon the Defendant on or about
March 21, 1995.
2. The marriage of Plaintiff and Defendant Is Irretrievably broken and ninety
days have elapsed from the date of filing the Complaint and the date of service of
the Complaint on the Defendant.
3. I consent to the entry of a final Decree In Divorce either after service of a
Notice of Intention to Request Entry of the Decree or upon filing of my Waiver of
tha Notice of Intention to Request Entry of the Decree.
4. I understand that I may lose rights concerning alimony, division of
property, lawyer's fees or expsnses If I do not claim them before a divorce Is
granted.
5. I have been advised of the availability of marriage counseling, understand
that the Court maintains a list of marriage counselors and that I may request the
Court require my spouse and I to participate in counseling and, being so advised, I
do not request that the Court require that my spouse and I participate In counseling
prior to the divorce becoming final.

Dear Mr. Bangs and Ms. Daley:
By order of Court of President Judge Harold E. Sheely
.j dated october 2, 1996, the full-time Master has been appointed
in the above referenced divorce proceedings.
A divorce complaint was filed on March 10, 1995, raising
grounds for divorce of irretrievable breakdown of the marriage.
No economic claims have been raised in the action.
The motion for appointment of Master indicates that the
statutory grounds for divorce are 3301(d) of the Domestic
Relations Code. I cannot find any affidavit filed averring a
two year separation. I am not certain, therefore, whether the
separation date is an issue and, therefore, I request that
counsel give me clarification with respect to how you want me to
proceed with this case. Obviously, since no economic claims
have been raised, I am not going to direct the filing of
pre-trial statements; however, we will schedule a hearing on
grounds for divorce issues if necessary.

I received a letter dated December 4, 1996, from Kathleen C, Daley, Esquire,
attorney for Wendy 0, Seltzsr. In that letter (a copy of which I am not enclosing),
Attorney Daley Indicated thst your services ware not needed In this case and that
we were trying to resolve the outstanding issues. While that may be the case, it
appears, at least from the demands made by Ms. Seltzer in the most recent letter
from Kathleen C. Daley, Esquire, that the issues will not be resolved. Many of the
issues that are being raised at this point are not related to the divorca itself.
I am requesting that you schedule a four party conference as soon as
possible so that we can get this matter resolved. My client should not be delayed
in obtaining his divorce given the fact that there is really no outstanding issues to
be resolved In the casa.
I look forward to receiving a date for ths four party conference at your
earliest convenience.

I am In receipt of your letter of October 9, 1996. I wanted to offer some
clarification In response to that letter.
From my client's perspective, there Is nothing to resolve In this case except for
finalization of the divorce. My client is In the military and ths partlas were stationed In
Germany, The parties separated when his wife came back to the states In November of
1994. Therefore, from our perspective, there Is no Issue ss regard to ths separation date
and the two year separation will occur within the nsxt month.
All economic Issues In this case were resolved by separate egreement entered Into
by the parties through the sttorneys In the JEAG Corps. Consequently, there are no
economic Issues to resolve In this case.
I do not know what the position of the Defendant Is In this case. I simply need to
move this case forward to a resolution for my client. In that regard, if there Is any other
filing that you believe Is necessary In order to bring this matter to a hssrlng, plesse advise
me accordingly.

physical custody of or claims to have custody or visitation rights with the said child.
13. The best interest and permanent welfare of the child will be served by
granting the relief requested by Pell tioners because Respondent has denied any access
to Petitioner, Bradley I.. Seltzer who is stationed in Germany or to the paternal
grandmother, Bhelby Beltzer, who resides ]ocall y, because the minor child is bonded
with the paterna] grandmother, and paternal grandmother will ensure that the father
will have regl\lar contact with the child, and because the child's best interests are
served by having reguiar contact with his father and patllrnal grandmothllr.

B. For a period of two weeks in the summer. Father
shall advise Mother at least by May 1 of each year
as to when he intends to exercise the two weeks
vacation.
C. Over the Christmas holiday for a period of at
least three days to be arranged between the

D. A sharing/alternating of other major holidays as
agreed upon by the parties.
E. At such other times as may be agreed upon by the
parties and subject to Father's ability to be in
the Cumberland County area.
