COMPLAINT
1. The plaintiff, Paul D. Wilson, Is an individual residing at 602 Belle
Vista Drive, Enola, Cumberland County, PennsylvanIa.
2. The defendant, Family Rent-A.Car of Dlllsburg, Is a corporation
having a place of business at 630 U,S. Route 15, DlIIsburg, York County,
Pennsylvania.
3. The defendant, Alfred Leroy MIller, Jr., is an Individual residing at
5 South Main Street, Marysvllle, Perry County, PelUlsylvanla,
4. The defendant, United States Fidelity & Guaranty Company,
hereinafter called "U.S.F.&G", is an Insurance company having a place of
business at 3211 North Front street, Harrisburg, Dauphin County, Pennsylvania.
5. On August 17, 1994, the Defendant MlIIer was driving a 1987
Subaru, which he had leased from the defendant, Family Rent.A.Car of
DIlls burg.
6. As of August 17, 1994, the Defendant Miller carried his own
liability Insurance with the defendant, U.S.F,&G.
7. On the aforesaid date, at or about 2 P.M., the Defendant Miller
pulled from the Summerdale Plaza onto U,S. 11 & 15, where he was Involved In a
collision with the plaintiff, Margaret A. Wilson.
8. Both the defendant, Family Rent-A-Car of DiIlsburg, and the
defendant, U.S,F.&G, have refused to provide a defense to the plaintiffs.
WHEREFORE, the plaintiffs pray that the Court enter a declaratory
Judgment, declaring whether one or both Family Rent.A-Car of Dlllsburg and
U,S,F.&G, owe coverage to the plaintiffs for the aforesaid accldent.
