COMPLAINT
1. Plaintiff is Avco Financial Services Coneumer Diecount
Company One, a pennsylvania corporation organized under the lawe of
Pennsylvania and doing businees at 5205 Simpson Ferry Road.
Mechanicsburg, PA.
2. Defendants are Robert L. Arnold and C. Michelle Arnold. a
adult individuals. who reside at 347 Middlesex Road. Carlisle. PA.
3, On October 11. 1990, defendants executed a written mortgage
agreement to plaintiff having an initial advance of $10.000,09, plus
additional advances with intereet thereon up to a maximum of $29.000.00,
the same being recorded on October 16, 1990 in Cumberland County Mortgage
Book 993. Page 992, the same being incorporated herein by reference
thereto, as fully as though said mortgage were set forth herein ae an
exhibit,
4, The real estate subject to the mortgage is described and
located as per the deed deecription attached hereto as Exhibit "A".
5. Defendants are the real owner of said real estate.
6, Defendants have defaulted in their repayment obligations as
per the terms of the mortgage which mortgage incorporates a loan
agreement dated October 11, 1990, for which said mortgage is security,
in that they have failed to make the payment due July 16, 1994 and all
paymente thereafter. A copy of the aforesaid loan agreement is attached
hereto as Exhibit "B", the same being a wri tten agreement calling for
monthly payments of $347.53.

8. The requirements of Act 6 of 1975, 41 P.S, ~403 and Homeowner
Mortgage I\ssistance Act of 1983 (I\ct 91) have been complied with in thie
case by virtue of letters dated and mailed to defendant on January 4,
1995 containing the information required by said statutes. An exact copy
of said notices are attached hereto as Exhibit "e" and Exhibit "D",
reepectively.
9. To the best of plaintiff's knowledge, information and belief,
defendants are not in the military service ae defined and covered by 50
U.S.e.A. App. ~501 et seq.
WHEREFORE, plaintiff demands jUdgment against defendants in
mortgage foreclosure in the total amount of $3,642.08 (with the in rern
limitation as to the real estate herein involved), plus whatever
additional interest, late charges, service charges andlor attorney feee
which accrue hereafter and which may be allowed by the terms of the
contract sued upon,

NOTICE OF INTENTION TO FORECLOSURE MORTGAGE
The MORTGAGE held by Avco Financial Services Consumer Discount
Company One (hereafter we, us or oure) on your property located at 347
North Middlesex Road, Carlisle, Cumberland County, PA per Cumber1aud
County Record Book 993, Page 992 IS IN SERIOUS DEFAULT (because vou have
not made the monthl.l!...pament of $347,.53 for the months of July. 1994
throuqh December. 19,91 inclusive and/.or because N/A. Late charges (and
other charges) have aJso accrued to this date in the amount of $1,499.55,
'rhe total amount now required to cura thie default, or in other words,
get caught up in your payments, as of the date of this letter is
$3,473,28.
You may cure this default within THIRTY (30) DAYS of the date
of the receict of this letter. bv u<lvinq to u.s the above amount of
!J.473.2B. plus anv additional monthlv payments and late charqe which may
full due durinq this period. Such payment muet be made either by cash,
cnehier's check, certified check or money order, and made at P.O. BOX
1010, 5205 Simpson Ferry Road, Mechanicsburg, Ph 17055.
If you do not cure the default within THIRTY (30) DAYS, ~
intend to exercise our riqht tu accelerate the mortqaqe paments. This
means that whatever is owing on the original amount borrowed will be
considered due immediately and you mny loee the chance to payoff the
original mortgage in monthly inetallments. If fuJ I payment of the amount
of default is not made within THIRTY (30) DAYS, we also intend to
inetruct our attorneys to start a lawsuit to foreclose your mortqaqed
property. If the mortqaqe is foreclosed your mortqaqed property will be
sold by the Sheriff to pay off the mortqaqe debt. If we refer your case
to our attorneye, but you cure the default before th<:>y begin legal
proceedings against you, you will still have to pay Lhe reasonable
attorney's fees, actually incurred, up to $50,00. However, if legal
proceedings are started against you, you will have to pay the reaeonab1e
attorney's fees even if they are over $50.00. Any attorney's feee will
be added to whatever you owe ue, which may also include our reasonable
coets. If yOU cure the default within the thirty day period. yOU will
not be required to pay attorney's fees,
We may also sue you personally for the unpaid principal
