WAIVER OF RIGHT TO FILE MECHANICS' LIENS

OWNER
WHEREAS, RICHARD J. ROBERTS, Owner, of Harrisburg, Dauphin
county, Pennsylvania, entered into a contract with ROBERTS HOMES/
INC. Contractor, of 4400 Linglestown Road, Harrisburg,
Pennsylvania, to provide materials and perform labor necessary
for the construction of a dwelling house upon a tract of land
situate in Dickinson Township, Cumberland County, Pennsylvania,
more particularly bounded and described as follows:
SEE ATTACHED EXHIBIT "A"
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties, as part of the said contract and for
the consideration therein set forth, that neither the undersigned
contractor, any subcontractor or material man, nor any other
person furnishing labor or materials to the said Contractor under
his contract, shall file a lien, commonly called a mechanics'
lien, for work done or materials furnished to the said building,
improvements or any part thereof.
THIS STIPULATION is made and intended to be filed with the
Cumberland County prothonotary within ten (10) days after date,
in accordance with the requirements of Act of Assembly of
Pennsylvania, in such case provided.
IN WITNESS WHEREOF, the said parties hereto, intending to be
legally bound hereby, have hereunto set their hands and seals
this l3th day of March, 1995.

ALL that certain lot of land situate in Dickinson Township,
Cumberland County, Pennsylvania, bounded and described in
accordance with Final Subdivision Plan of Kings Gap Estates,
recorded on April 10, 1992, in the hereinafter named Recorder's
Office in Plan Book 64, Page 4S, etc. as follows:
BEGINNING at a point on the western line of 60 feet wide Chelsea
Lane at, the dividing line between Lots Nos. 17 and 1S; thence
along said dividing line between said lots Nos. 17 and 18, South
62. 39' 34" West a distance of 3S7.19 feet to a point; thence
North OS. 36' 27" West a distance of 277.66 feet to a point at
the dividing line between Lots Nos. 16 and 17; thence along said
dividing line between Lots Nos. 16 and 17, North 74. 50' 45" East
a distance of 347.26 feet to a point on the western line of 60
feet wide Chelsea Lane; thence along the western line of said 60
feet wide Chelsea Lane the fOllowing two courses and distances:
(1) South OS. 36' 27" East a distance of 95.43 feet to a point;
and (2) by a curve to the left an arc distance of 100.65 feet to
a point at the dividing line between Lots Nos. 17 and 1S at the
place;?f BEGINNING.
The above described lot of land is all of Lot No. 17 as shown on
said Final Subdivision Plan of Kings Gap Estates recorded as
aforesa~d, and contains an area of S3,212 square feet or 1.91
acres. .~
BEING~he same premises which L. B. Phillips, Jr. and Edna
Lucilf~ Phillips, his wife, by their deed dated
1995 and recorded in the Office of the Recorder of Deeds in
and for Cumberland county, Pennsylvania, in Deed Book
Page , granted and conveyed to Richard J. Roberts,
Mortgagor herein.
