This court has jurisdiction to entertain this action under Rules
of Ctvll Procedure, Rule 1092 (c)(2).

And Now comes Plaintiff Michael L. Etter, acting as.counsel pro-se
and avers as follows:
1. Plaintiff Is Michael L. Etter, an adult Individual, residing
at 501 Mall Road, Harrtsburg, Dauphin County, Pennsylvania 17111.
2. Oefendant Is R.J. Shadday, an adult Individual, employed as a
Collection Coordinator for the Domestic Relations Section of Cumberland
Courts, located at 13 North Hanover Street, Carllse, Cumerland County,
Pennsylvania 17013.
3. Plaintiff was arrested on July 1,1994, on unrelated charges.
and has remained Incarcerated since at the Dauphin County Prison,
Harrisburg, Penna. 17111.
4. Plaintiff served notice, via US Mail, of his Imprisonment on
R.J. Shadday on the 20th day of July 1994.
5. R.J. Shadday lodged a detainer against Plaintiff's prison
status on the 21st day of July 1994, In the form of a "contempt bench
warrant". See attached exhibit -B- line 3.
6. October 30,1994, Plaintiff contacted R.J. Shadday, via US Mall,
and requested: " Please accept this as formal request for Immediate
disposition of this detainer". See exhibit -C- pragraph 2
7. November 10,1994, R.J. Shadday, In response to Plaintiff's
request for final disposition, stated In pertinent part: "This contempt
petition and bench warrant will be disposed of when you are released
from Incarceration." See attached exhibit -A-
8. It Is virtually Impossible to dispose of a bench warrant upon
release, when In fact, your Plaintiff cannot be released prIor to
disposition of said detainer.
9. This statement made by R.J. Shadday, as quoted above In
paragraph 7, defies all common logic and clearly disregards your
Plaintiff's rights protected under the equal protection clause of the
United States Constitution, USCA Canst. Amend. 14, and the Commonwealth
Constltutlon,42 Pa. CSA Section 8528; Const. Art. 3 Section 18: Pa.
R. Clv P. 1910.21-6(a)i 1910.13(d) i 1910.21(c).
10. This court should Issue a Writ of Mandamus which Orders and
Olrects R.J. Shadday to purge this contempt bench warrant from Plaintiff's
prison status.
11. This Petition for a Writ of Mandamus Is supported by an attached
Memorandum of Law.

Pat R. Clv. P. Rule 1910.13-1, comment, states In pertinent
part: "The new rules apply only to a party who fails to appear at a
support conference or h~aring as directed by the court".
Although Plaintiff does not acknowledge reclept of NOTICE TO APPEAR,
he has been advised by prison staff that the petition for contempt and
bench warrant stem from failure to appear, therefore, these rules of
court wtll be relevant In this matter.
Pat R. Civ. P. Rule 1910.21(c) Civil Contempt, states: If the
defend~nt f~fls to appear, the court shall continue tbe hearing and
may order personal service of the petition and nottce of a new hearing
date by the sheriff or may issue an bench warrant for production in
court and not for Imprisonment pursuant to Rule 1910.13...."
Pa. R. Civ. P. Rule 1910.21, Note Section, "Courts should strive

Pa. R. Clv. P. Rule 1910.21-6(a) "No respondent may be Incarcerated
as a sanction for contempt without an evidentiary hearing before a judge.".
Finally, Plaintiff refers to Pa. R. Clv. P. Rule 1910.13-1(d),
FAILURE OR REFUSAL TO APPEAR PURSUANT TO ORDER OF COURT. This rule Is
very specific with respect to the time frame of which a defendant Is to
be taken before a Judge. Section (d) quoted as follows: The bench
warrant shall direct that If the court Is unavailable at the time of the
party's arrest, the party shall be lodged In the county jail until such
time as court Is opened for business. The authority In charge of the
county jail must promptly notify the sheriff's office and the director
of domestic relations section that defendant is being held pursuant to

The DRS of Cumberland Courts were, In fact, notified of Defendant
being In custody of the county jail. Evidence of this is overwhelming,

Further, Defendant formally requested Immediate disposition of
this matter on October 30,1994. This passage of time, by far. exceeds
the seventy-two hour period as allowed by law.
As the State Llglslature enacted the Rules of Court. To wit.
Pa. R. Clv. P. Rule 1910.13-1(d) they Imposed clear mandatory language.
The Law they Imposed clearly states; "Under no cl~cumstances shall the

Our elected offlciils chose this language, "Under no circumstances".
they did not Imply nor mention that the party must be Incarcerated solely
as a result of the bench warrant; they did not Implyuor mention that
the party must be In a particular county jail; net did they provide for
allowance or deviation from this Rule In unusual or extraordinary
circumstances. The message they sent is very clear.
The courts have ruled on Interprebatlon of our Rules and Laws In
the past.
"Nonetheless. we must also adhere to established principles of
statutory construction which dictate that when the words of a statute
are clear and free from ambtgulty, the letter of tt Is not to be
disregarded under the pretext of pursuing Its spirit". The statutory
Construction Act of 1972. I Pa. Const. Stat. Ann. Section 1921(b)
(Purdon. Supp. 1986); construed In ~lmm~~~~_0'8~~~J 497 Pa. 551,
442 A.2d 674 (1982)
"Moreover, a court cannot Insert words Into a statutory provision
where the legislature has failed to supply them." Qlam9nd._Y.:-Qlam9nd.
519 A.2d 1012 (1987)
"This court may not under the guise of construction intrued upon the
exclusive provInce of the legislature." See ~aeb9~, 289 A.2d at441
Yoor Plaintiff enjoys an absolute right, as a US and Penna. citizen,
to be equally protected by the Rules and Laws which govern this Commonwealth.
This has long been established.
Cumberland County's DRS, to wit, R.J. Shadday. has deprived
and violated the rights of Defendant as clearly listed above.

WHEREFORE, based on the facts. Rules, Case Laws, as set forth herein
your Plaintiff prays this Court issue a Writ of Mandamus which Directs
and Orders R.J. Shadday to purge the contempt bench warrant for His
prison status, due to violation of above mentioned rights.

above. 1 have a hearing scheduled in your Court for March 30.
1998. regarding a civil matter. and have no funds to retain
counsel. 1 write seeking information concerning who 1 could
