1. The plaintiff is an adult individual. Mary M. Paden,
residing at 103 Walnut street. Boiling Springs, Cumberland
County, Pennsylvania 17007.
2. The defendant, David Jumper, is an adult individual
whose last known address is 3 Earl Street, Boiling Springs,
Cumberland County, Pennsylvania 17007.
3. The location and address of rental property upon which
this claim for unpaid rent and property damage is based is 119
First Street, Boiling Springs, Cumberland County, Pennsylvania
17007.
4. The plaintiff, Mary M. Paden, is the owner of said
rental property.

The plaintiff. Mary M. Paden, rented said rental
to the defendant, David Jumper, without written lease or
deposit on a month-to-month tenancy.
6. A notice to remove was given to the Defendant (on
September 30, 1994) as set forth in the copy of said notice and
affidavit of service attached hereto. made a part hereof, and
marked Exhibit "A," requesting Defendant to vacate the rental
premises by the end of the next term of this month-to-month
tenancy, October 31. 1994,
7. Defendant surrendered said rental premises by returning
keys via U.S. mail to Plaintiff on or about October 21. 1994.
Copy of letter of transmittal by Defendant's agent is attached
hereto. made a part hereof and marked Exhibit "B."
8. Rent for the month of October 1994 in the amount of Four
Hundred Twenty-five and No/10D ($425,00) Dollars remains due and
unpaid to date, despite repeated demand.
9, Injury to the rental premises in the amount of Two
Hundred Sixty-two and 95/100 ($262.95) Dollars remains due and

WHEREFORE, plaintiff claims damages from Defendant and
requests judgment against Defendant in the sum of Six Hundred
Eighty-seven and 95/100 ($687,95) Dollars together with costs
plus interest thereon at the statutory rate from Decemher 8,
1994.

TO-MONTH TENANCY WHICH HAS APPLIED TO YOUR OCCUPANCY OF THIS

AND NOW, comes Defendant, DAVID JUMPER, by and through his attorney, Paul
Bradford Orr, Esquire, and files the following Answer and states as follows:

5. Admitted in part and denied in part. It is admitted that Plaintiff rented said rental
property to Defendant without written lease. However, it is strictly denied that answering
Defendant did not have a security deposit with Plaintiff and, therefore, strict proof thereof is
demanded at time of trial.
6. Admitted.
7. Denied. To the contrary, Plaintiff contends that he in fact gave notice to Plaintiff
that he was removing himself from the premises no later than October 15, 1994.
8. Admitted in part and denied in part. It is admitted that Plaintiff owes one-half of
the rent due for October 1994 in the amount of $212.50. However, it is strictly denied that
answering Defendant owes Plaintiff for the entire month of October 1994 and, therefore, strict
proof thereof is demanded at time of trial.
9. Denied. The averments in this paragraph are denied generally in accordance with
Pennsylvania Rule of Civil Procedure 1029(e).

WHEREFORE, Defendant requests that the Complaint be dismissed with the exception
of Defendant's admission of owing one.half of one month's rent to Plaintiff.

the Arbitrators appointed Is John Weigle, I just spoke with Jim Jones, Esq. who shared an office with
him and he Informed me that John has moved to Michigan. I called Sandy at J. Hoffe~s chambers and
she wasn't aware of that either, She wants to know If you have any suggestions of another attorney that
