WHEREAS, SKYPORT ASSOCIATES, INC.,
Pennsylvania, hereinalter called "Owner", has executed an Agreement with JACK BARTON CONSTRUCTION,INC"
a domestic corporatlq~, with a place of husiness at 4401 Carlisle Pike, Suite J, Camp Hill, Cumberland County,
Pennsylvania, herelnalter called "Contractor" to install partitlunlng, install ceiling panels, lighting fixtures, new store
front, lloor coverings and uverhead garage duor to existing office suites (No. 106, No, 108 and No. 110) situate in
a commercial/retail building ("Building") upon real estate situate In Hampden Township, Cumberland County,
Pennsylvania, being more particularly hounded and described as follows:
BEGINNING at a point, said point being at the Intersectlun of the north side of a SO,O
foot wide right-of-way and the east side of Gustin Drive; thence by the east side of
Gustin Drive North IS degrees 02 minutes 47 seconds East 278,55 feet to a point at
land of Wu Chon Ho; thence by same South 63 degrees 41 minutes 43 seconds East
ISO,OO feet to a point; thence hy the same North 26 degrees 37 minutes 26 seconds
East 162,25 feet to a rolnt on the south side of the Carlisle Pike; thence by same and
a curve to the lelt having a radius of 11,409,19 feet an arc length of 173.82 feet to a
point at lands of the Pep Boys; thence hy same South 26 degrees 23 minutes 48
seconds West 432,45 feet to a point on the north side of a 50.00 foot wide right-of.
way; thence by same North 64 degrees II minutes West 269.6S feet to the place of
BEGINNING.
CONTAINING 2,S04 acres,
BEING municipally known and numbered as 6108-10 Cariisle Pike, Mechanlcsburg,

NOW, THEREFORE, TillS AGREEMENT WITNESSETH: That the said Contractor, for and In
consideration of the sum of ($1.00) Dollar to ConlraclUr In hand paid by Owner, the receipt whereof Is hereby
acknowledged, and the further consideration mentioned In the Agreement. for Itself and Its suhcontractors, and all
panics acting through or under Contractor and Its suhconlraclors. covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the said Building and the above described real estate for
or on account of any work done or materials furnished by them or any of them under said Agreement or otherwise,
for, towards. In, or about the erection and construction of said renovations and Improvements to said Building on the
real estate above descrlhed and the said Contractor, for Itself, Its subcontractors and others under them hereby expressly
waive and relinquish the right to have, file. and maintain any mechanic's liens or claims against the said Building and
the real estate above described, and agree that this Inslrument, waiving the right of lien, shall be an independent
covenant,
