WHEREAS, MICHAEL G. MACIVOR and DENISE Z. MACIVOR, his wife, has
executed a contract with S & A CUSTOM BUILT HOMES, INC., for the erection of a residential
dwelling upon a tract of land situate on 10 Meadowood Place, Boiling Springs, CUMBERLAND
COUNTY, PENNSYLVANIA 17007, more particularly described in the deed of S & A CUSTOM
BUILT HOMES, INC. granted and conveyed to MICHAEL G. MAClVOR and DENISE Z.
MACIVOR, his wife, dated July 31, 2002, and recorded in the Office of the Recorder of Deeds
for Cumberland County, Pennsylvania in Deed Book , Page , and being a vacant
lot in the South Middleton Township, Cumberland County, Pennsylvania.
NOW, July 31, 2002, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owners to the said Contractor to
commence work on said building, or to purchase materials for the same in consideration of the
making of the said contract with the said Contractor and the further consideration of the sum of
One and no/100 ($1.00) Dollar to Contractor paid by said Owners, it is agreed that no lien shall
be filed against the building by the contractor, or any subcontractor, nor by any of the material
men or workmen or any other person for any labor or materials purchased or extra labor or
materials purchased for the erection of said building, the right to file such liens being expressly
waived.
