MOTION FOR SERVICE PURSUANT TO
SPECIAL ORDER OF COURT
AND NOW, comes the plaintiff, by his attorneys, Fowler,
Addams, Shughart & Rundle, and moves Your Honorable Court in
accordance with Pa. R.C.P. 430 for a special order directing an
alternative method of service and in support thereof asserts the
following:
1. On March 20, 1995 a praecipe for writ of summons was
filed as a result of an automobile accident occurring in
CUmberland County on April 24, 1993.
2. According to the Pennsylvania State Police report and
all subsequent investigation, the Defendant, Scott W.
Finkenbinder, is a resident of Cumberland County, Pennsylvania.
3. The affidavit of the undersigned pursuant to
Pa. R.C.P. 430(a) is attached as Exhibit 1.
4. As indicated in the affidavit, the Sheriff has attempted
service at three different addresses in Cumberland County. The
Defendants lists a post office box for his address, and his own
insurance company has been unable to get him to respond to its
correspondence to him.

AFFIDAVIT
AND NOW, comes William A. Addams and deposes and says that:
1. He is counsel for the plaintiff, Brad Kozak, having been
retained on November 10, 1994 as a result of an automobile
accident in cumberland County on April 24, 1993.
2. The Plaintiff is a resident of Toronto, ontario, Canada.
3. The Defendant is Scott W. Finkenbinder. According to
the pennsylvania State police report attached as Exhibit "A" his
date of birth is December 31, 1967. His address on his vehicle
registration and driver's license was P.O. Box 623, carlisle, PA,
and his telephone number was 776-6029.
4. On March 20, 1995 the undersigned commenced an action by
Praecipe for Writ of Summons listing both the address and
telephone number for the Defendant.
5. The Sheriff filed a "not found" return after advising
the undersigned that the telephone had been disconnected.
6. The undersigned retained American Research Bureau
Incorporated to obtain a street address for the Defendant, and
received the letter of April 7, 1995, attached as Exhibit "B",
advising that he resided at 1125 Harrisburg pike, Carlisle, PA.
7. The Writ was reinstated for service, but the Sheriff
filed another "not found" return attached as Exhibit "C" stating
Exhibit 1
that the address "is a row of houses. No one at any of the
houses had ever heard of Defendant."
8. The undersigned asked American Research Bureau
Incorporated for additional investigation and received the letter
of May 18, 1995 attached as Exhibit "D" indicating a valid
address for the Defendant could not be obtained.
9. The undersigned subpoenaed the claim file of the
Defendant's insurance company which indicated an address of
1831 Walnut Bottom Road, Newville, PA on medical forms for the
Defendant's wife and child.
10. Again the Sheriff attempted service, but filed another
"not found" return, attached as Exhibit "E", stating, "Defendant
moved and left no forwarding address."
11. The undersigned was advised that there is no support
action pending against the Defendant.
12. The insurer's file also indicated that a certified
letter was sent to the Defendant on October 13, 1993, addressed
to the post office box denying coverage because the Defendant
failed to communicate with the company. It is not known if the
latter was received.
13. The undersigned wrote to the Defendant's insurance
company on January 17, 1996 offering to settle the claim, but
received no reply.

COMPLAINT
AND NOW, comes the Plaintiff, Brad Kozak, by his attorneys,
Fowler, Addams, Shughart & Rundle, and makes the following
complaint:
1. The Plaintiff is Brad Kozak, an adult individual
residing at 191 Lynedock Crescent, Toronto, ontario,
Canada M3A 2B3.
2. The Defendant is Scott W. Finkenbinder, an adult
individual residing in Cumberland County, Pennsylvania.
3. The accident described below occurred at about 7:30 p.m.
on April 23, 1993 in Dickinson Township, Cumberland county,
Pennsylvania, about 3 miles west of Carlisle.
4. The Plaintiff was a passenger in a motor vehicle which
had been traveling west on Pa. Route 465 and ~hich was turning
left into a private driveway.
5. At said time and place the Defendant was operating an
automobile traveling west on Route 465 when he negligently,
carelessly and recklessly attempted to pass the vehicle in which
the Plaintiff was riding, and collided with the left side of the
vehicle.
6. The Defendant was reckless, negligent and careless in:
A. Attempting to pass in a no passing zone;
B. Attempting to pass when said movement could not be
made in safety;
c. Failing to observe that the other vehicle was
turning left;
D. Traveling too fast for conditions;
E. Failing to have his vehicle under control.
7. As a result of the recklessness, negligence and
carelessness of the Defendant, the Plaintiff sustained strains of
the cervical and lumbar areas of his spine, and contusions of his
chest and ribs.
8. The Plaintiff has incurred medical expense for the
treatment of his injuries.
9. The Plaintiff has undergone considerable mental and
physical pain and suffering as a result of his injuries.
10. The Plaintiff has incurred expenses for lodging and
return transportation in the amount of $357.
WHEREFORE, the Plaintiff demands judgment against said
Defendant for an amount not in excess of $25,000 and within the
jurisdiction of arbitration under the local rules of court.
