6. Plaintiff avers that Defendants are in default of the terms and conditions of
the aforementioned Contract by having not made payments as agreed, thereby rendering the
entire balance immediately due and payable.
7. Plaintiff avers that all conditions precedent to Defendants' duty under said
Contract have been performed.
8. Plaintiff avers that the balance due under the Contract as of February 10, 1995
is $3,652.86, of which $3,631.34 is principal and $21.52 is interest as evidenced by
Plaintiff's Statement of Account attached hereto as Exhibit "2".
9. Plaintiff avers that it is entitled to continuing interest at the rate of 12.50
percent per annum.
10. Plaintiff avers that the Agreement between the parties provides that Defendants
will pay Plaintiff's reasonable Attorneys' fees.
11. Plaintiff avers that such Attorneys' fees will amount to $1,210.45.
12. Although repeatedly requested to do so by Plaintiff, Defendants have willfully
failed and refused to pay the aforesaid balance, interest, attorney fees or any part
thereof to Plaintiff.
WHEREFORE, Plaintiff demands judgment against Defendants, jointly and severally, in
the amount of $4,863.31 with continuing interest at the rate of 12.50 percent per annum
plus costs.

STIPULATION OF THE PARTIES FOR SETTLEMENT AND FOR THE ENTRY OF ,lUDGMENT
UPON FILING AFFIDAVIT OF DEFAULT
AND NOW comes the plaintiff, by counsel, and the Defendants, to stipulate to
Settlement and for the Entry of Judgment upon Filing of Affidavit of Default, as follows:
1. Defendants admit indebtedness to plaintiff in the amount of $4,145.18, of which
$3,631.34 is principal owing as of April 12, 1995, $123.62 is interest through May 4, 1995
plus continuing interest at the rate of 12.50 percent per annum, plus Court costs
of $80.22 and $310.00 attorneys fees.
2. To secure the repayment of said indebtedness, Defendants agree that upon
Plaintiff's counsel's filing of Affidavit of Default of the following payment schedule,
Judgment will be entered in favor of the Plaintiff in the amount then due, including
interest and Court costs, giving credit for any payments made.
3. Plaintiff agrees not to enter Judgment so long as Defendants cause to be
delivered into the hands of the plaintiff the following payment in full by 4:30 the close
of business, on the following dates:
a) $500.00 on or before May 14, 1995;
bl $171.00 on or before June 14, 1995 and continuing or before the 14th day of each
consecutive month thereafter until the balance of $3,645.18 plus additional accrued interest
on the outstanding principal balance has been paid in full.
4. All payments should be in the form of a check or money order made payable to
"NationsCredit" and mailed directly to NationsCredit at 1853 Data Drive, Birmingham, AL
35244, Attn: Renee Baldwin.
5. Time is of the essence in this agreement and the failure to make any payment to
Plaintiff by the date and time due shall allow Plaintiff to immediately enter Judgment upon
the filing of an Affidavit of Default and to issue Execution or pursue all other remedies
at law or in equity to collect the full balance of the Judgment entered hereunder plus
appropriate additional interest and costs.
