who currenUy reside at 521 Reno Ave, Apartment B, New Cumberland,
Cumberland County, Pa.
(2) Plaintiff Is PNC Bank. N.A. With a listed address of 4242 Carlisle Pike, Camp
Hili, Cumberland County, Pa.
(3) James Lovett and Robin Villarreal have been a tenant of plaintiff since
September 199:", pursuant to a written lease agreement In his and her name for
the premises with a monthly rental of $ 365.00
(4) Plaintiff filed a LandlordfTenant Complaint against Defendant with District
Justice Charles A. Clement Jr. Seeking possession of the leased premises plus
rent allegedly in arrears. Following a hearing on February 21, 1995, plaintiff
was awarded judgment in his/her favor, including possession of the rental
property.
(5) Defendant hereby wishes to appeal from the award of possession and
damages, and believes and therefore avers that he/she has valid defenses to
said action.

1. The plaintiff, PNC Bank, N,A., is a national banking associa-
tion with a principal place of business at 4242 Carlisle Pike, Camp
Hill, Cumberland County, Pennsylvania 17011,
2, The defendants, Jim Lovett and Robin Villarreal, are adult
individuals residing at 521-B Reno Street, New Cumberland, Cumberland
County, Pennsylvania 17070,
3. The plaintiff is agent of the owner of the real property at
52l-B Reno Street, New Cumberland, Pennsylvania,
4, The defendants are the tenants in the property pursuant to a
lease agreement of October 12, 1993, a copy of which is attached
hereto as Exhibit "A",

The defendants have breached the terms of the lease as
A, Failure to pay rent for the months of January, February,
March and April, 1995, at a monthly rental of $365,00.
B, Failure to pay Constable charges due in connection with
a prior eviction action in the amount of $45,00.

TO THE HONORABLE, THE JUDGES OF SAID COURT:
The petitioner, PNC Bank, N,A., the plaintiff in the above
proceeding, petitions your Honorable Court for an order striking the
supersedeas in the above captioned matter, and in support thereof
relates as follows:
1, The petitioner, PNC Bank, N,A., is the plaintiff in the above
captioned matter,
2, The defendants, Jim Lovett and Robin villarreal, are adult
individuals residing at 521-B Reno Street, New Cumberland, Cumberland
County, Pennsylvania 17070.
3. The petitioner/plaintiff filed an action befor.e District
Justice Charles A. Clement, Jr" District Court 09-1-01, for money
damages and for possession of real property arising out of defendants'
breach of a lease between the plaintiff and the defendants.

4. District Justice Charles A. Clement, Jr" entered judgment for

1. On April 5, 1995, your petitioner filed with this court a
petition to strike supersedeas to the above term and number,
2. On AprilS, 1995, this Court issued a rule to show cause why
the supersedeas should not be stricken, A Rule was issued on the
Respondents returnable within twenty (20) days after service.
3, On April 7, 1995, the rule wae served on the respondents by
first class mail, postage prepaid.
4, The respondents have failed to respond to the rule,
WHEREFORE, your petitioner respectfully requests this Court to
enter an order striking the supersedeas and directing the Constable to
continue eviction proceedings against the respondents.
