COMPLAINT
1. Plaintiff, Walkers General Contractors, Inc., operates
its principal place of business at 15 Conifer Lane, Mechanicsburg,
Pennsylvania 17055.
2. At all times pertinent herein, Defendant, Charles Crone,
Jr., had his principal place of business at 312 Bridge street, New
Cumberland, Pennsylvania, 17070.
3. On or about April 11, 1994, Plaintiff and Defendant
entered into an oral agreement whereby Plaintiff agreed to excavate
property located at 333 High Mountain Road, South Newton Township,
Pennsylvania, and erect concrete walls and footers thereon in
exchange for payment as follows:
(A) $55.00 for each hour Plaintiff's loader was in operation;
(B) $45.00 for each hour Plaintiff's backhoe was in use;
(C) $18.00 per hour for Plaintiff's layout time;
(D) $7.00 per linear foot of footer poured;
(E) $27.00 per linear foot of 8' x 8" walls poured;
(F) $18.00 per linear foot of 4' x 8" walls poured;
(G) $37.50 per linear foot of 11' x 8" walls poured;
(H) $41.00 per linear foot of 13' x 8" walls poured;
(I) $55.00 per linear foot of 16' x 8" walls poured; and
(J) sill ties at $0.50 each.
4. The total cost for materials and labor furnished by
Plaintiff at the request of Defendant is Eight Thousand Fourteen
Dollars ($8,014.00).
5. On or about June 20, 1994, Defendant paid Plaintiff the
sum of Two Thousand Dollars ($2,000.00), leaving a balance of Six
Thousand Fourteen Dollars ($6,014.00).
6. Plaintiff's performance pursuant to the Agreement was
completed on or about June 25, 1994.
7. Defendant has breached the Agreement by refusing to pay
the balance due and owing to Plaintiff in the amount of Six
Thousand Fourteen Dollars ($6,014.00) together with interest
thereon from July 5, 1994.
8. Despite repeated requests by Plaintiff for Defendant to
make payment of said amount, Defendant has willfully refused to
satisfy Plaintiff's invoice.
WHEREFORE, Plaintiff, Walkers General Contractors, Inc., prays
for judgment against Defendant for the sum of six Thousand Fourteen
Dollars ($6,014.00) with interest thereon from July 5, 1994, for
attorney's fees and cost of suit, and for such other relief that
this Court may deem just and proper.
