COMPLAINT FOR MONEY DUE NOW COMES THE PLAINTIFF, Universal Forest Products, Inc. and states for its cause of action against Defendant, Component Building Systems, Inc., the following: 1. Plaintiff is a Michigan corporatbn, and is authorized to transact business in the State of Pennsylvania. 2. Defendant is a Pennsylvania corporation with a principal place of business at 355 Green Spring Road, County of Cumberland, State of Pennsylvania. ~ 3. On November 18, 1994, Plaintiff agreed to sell and deliver certain goods to Defendant as more particularly shown on the invoice attached hereto and incorporated herein as Exhibit" A". The terms of payment were in full within 30 days of the invoice with a 1 % credit if payment was within 10 days of invoice date. 4. Defendant agreed to timely pay for the goods delivered pursuant to the terms on the invoice. 5. That Plaintiff has fully performed its duties under the above mentioned agreement in that on November 18, 1994, it did sell and deliver to Defendant the lumber products ordered by Defendant. 6. On December 27, 1994, without notice, Defendant stopped payment on check #7667, drawn against Defendant's account at Farmer's Bank in favor of Plaintiff in the amount of $13,412.71. . 7. That as of today's date, Defendant is indebted 10 the Plaintiff in the amount of Thirteen Thousand, Four Hundred Twelve Dollars and 71/100 Dollars ($13,412.71), plus imerest, the principal balance being evidence by the Customer Statement attached as Exhibit "B". 8. Plaintiff has made demands upon Defendant for payment of the $13,412.71, including interest. 9. Plaintiff. Defendant has failed, refused and neglected 10 pay the amount demanded by 10. Said balance due is subject 10 an annual rate of interest of 18% on the unpaid balance from 30 days after the date of each invoice until the date of judgment as expressly provided on the invoices. WHEREFORE, Plaintiff requests that judgment be entered against the Defendant as follows: 1. The principal amount of $13,412.71, plus accrued interest at the rate of 18% per annum from 30 days after the date on each invoice until the date of judgment. 2. Maxey, of full age, being duly sworn, according to law, do depose and say: 1. I am the Vice President of Administration of Universal Forest Products, Inc., a Michigan corporation, Plaintiff in this action, and am familiar with the transactions between Plaintiff and Defendant. 2. On November 18, 1994, Defendant ordered and Plaintiff shipped to Defendant various building products for the sum of $13,412.71. 3. The invoice was shipped on the invoice date, and demand for payment was made by said invoice. 4. The terms of the sales were 1 %/10 days, net 30 with interest at the rate of 1.5% per month on the unpaid balance 30 days after the date on the invoice. 5.
