Berlin of 31 Elm View Court, Wernersville, Berks County, Pennsylvania 19565 (hereinafter referred to as "Wife") and Carl M. Berlin of 8 Slate Hill Roadr Camp Hillr Cumberland County, Pennsylvania 17011 (hereinafter referred to as "Husband"). WHBREAS, the parties hereto are Husband and Wife, having been married on June 26, 1982 at Franklintown, York County, Pennsylvania, and are the parents of two minor childrenr namely Carl M. Berlin, born February 1r 19821 and Ashley N. Berlin, born July 3, 19851 and WHEREAS, difficulties have arisen between the parties as a result of which they now desire to live separate and apart and by this Agreement to settle all financial and property rights between them1 and WHEREASr in preparing this Agreement and negotiations contemporaneously therewith, Wife was represented by Matthew J. Eshelman, Esquire, and Husband was represented by Keith o. .. ... . Brenneman, Esquire, each of whom have given a full explanation of the same to their respective clients; and WHEREAS, Husband and Wife respectfully acknowledge that before signing this Agreement they have been fully advised by their respective counsel of their rights and obligations, have read carefully and understand the terms of this Agreementr a~d have freely consented to this Agreementr believing it to be fairr just and equitable; and WHEREAS, Husband and Wife are satisfied that they understand the value and extent of all property which would be considered "marital property" under the Pennsylvania Divorce Reform Actr whether titled or owned separately or jointly as well as the value and extent of nonmarital property held or expected to be held by each other; and NOW, THEREFOREr in consideration of the mutual promises and undertakings set forth herein and intending to be legally bound hereby, the parties hereto do hereby agree as follows: 1. Mutual Separation. Husband and Wife shall be free from constraint or control by the other as fully as if he or she were unmarried. Neither shall disturb, trouble and interfere in any way with the other or with any person for associating with the other. 2. Mutual Release. Husband relinquishes his inchoate intestate right in the estate of Wife, and Wife relinquishes 2 ~ . her inchoate intestate right in the estate of Husband, and each of the parties hereto by these presents, for himself or herself, his or her heirs, executors, administrators or assigns, does remise, release, quit claim and forever discharge the other party hereto, his or her heirs, executors, administrators or assigns, or any of themr of any and all claimsr demandsr damagesr actions, causes of action or suits at law or in equity, or whatsoever kind or nature, for or because of any matter or thing done, admitted or suffered to be done by said other party prior to and including the date hereof; further, the parties acknowledge that all rights under the Pennsylvania Divorce Code that are not specifically incorporated herein are hereby expressly waived. Notwithstanding the foregoing language of this paragraph, this release shall in no way exonerate or discharge either party hereto from the obligations and promises made and imposed by reason of this Agreement and shall in no way affect any causes of action in divorce which either party may have against the other. 3. Effect of Divorce. Nothing contained in this Agreement shall be deemed to prevent either party from pursuing a divorce on the grounds permitted by law in this or any other jurisdiction, nor to bar the other from defending any such 3 . . suit. In the event any such action is pursued or initiated, the parties shall be bound by all the terms of this Agreement. 4. Effect of Divorce Decree. This Agreement shall continue in full force and effect after such time as a final decree in divorce may be entered with respect to the parties. 5. Aareement to be Incorcorated in Divorce Decree. The terms of this Agreement shall be incorporated into any divorce decree which may be entered with respect to the parties. The Court of Common Pleas which may enter such divorce decree shall retain continuing jurisdiction over the parties and the subject matter of the Agreement for the purpose of enforcement of any of the provisions thereof. 6. Date of Execution. The "date of execution" or "execution date" of this Agreement shall be defined as the date upon which it is executed by the parties if they have each executed the Agreement on the same date. otherwiser the "date of execution" or "execution date" of this Agreement shall be defined as the date of execution by the party last executing this Agreement. 7. Debts. During the course of the marriage, Husband and Wife have incurred certain bills and obligations and have amassed a variety of debts. It is hereby agreedr without the necessity of ascertaining for what purpose and to whose use each of the bills were incurredr that both parties are equally 4 . . responsible for all such billsr obligations, and debts. Husband and Wife each agree to hold the other free and harmless from any and all liability which may arise from any outstanding bills, obligations and debts incurred after the date of separation, and further agree to indemnify and defend the other from any claim regarding same. Both parties agree that, in ~he futurer neither shall cause or permit to be charged to or against the other any purchase or purchases which either of them may hereafter make and shall not hereafter create any engagements, debts, or obligations in the name of or against each other. 8. Real Propertv. The parties have divided the proceeds from the sale of the marital residence at 72 South pin Oak Drive, Boiling Springsr Cumberland County, Pennsylvania l7007r after the payment of certain marital debtsr to the satisfaction of both Husband and Wife. 9. Personal Propertv. The parties have agreed between themselves to a division of all household furnishings and personal property which wOllld be considered "marital property" under the Pennsylvania Divorce Code. 10. Alimonv. Husband shall pay unto Wife alimony in the amount of three hundred dollars ($300.00) per month for a period of thirty-six (36) months. It is the intention of the parties hereto that such alimony shall be included in the 5 . taxable income of Wife and shall be deductible from the taxable income of Husband. Payment of alimony shall commence as of the date of any Divorce Decree. The parties agree that liability for current spousal support shall terminate as of the date of any Divorce Decree. The parties agree that any arrearages shall continue to be paid pursuant to the terms of any existing Support Order until paid in full. Payment terms for any arrearages still outstanding thirty-six (36) months after the date of any Divorce Decree may be modified by agreement of the parties or by petition to the Domestic Relations Office. Husband's obligation to pay alimony for the thirty-six (36) month period shall end upon the earlier occurence of anyone of the following events: (1) the death of Husband~ (2) the death of Wife~ (3) the remarriage of Wife~ or (4) the cohabitation by Wife with an individual of the opposite sex not related to Wife. 11. Medical Insurance. Husband shall continue to provide medical insurance coverage for his aforesaid children such as is presently maintained by him. The same coverage will be maintained by him for Wife for three (3) years following the date of any Divorce Decree or until Wife remarries, whichever comes first. 12. Pension. Each of the parties agrees that all property rights and benefits of each party under any pension, profit- 6 . sharing, employee benefit or retirement plan, and all insurance on the life of either party, is now and shall continue to be the separate property of the respective parties and is not and shall not become marital property, community property or quasi- community property, without regard to where in the world the parties may reside. 13. Consent to Divorce. Both parties agree to pursue a no-fault divorce under section 3301(c) of the Pennsylvania Divorce Code and, in connection therewith, to execute and acknowledge whatever consents or other documents that are necessary to accomplish this. Both parties agree to execute appropriate consent documents forthwith in order to prosecute said divorce to a prompt conclusion and final decree as soon thereafter as practicable. 14. Enforcement. If either party defaults in the due performance of any of the terms, conditions, and covenants of this Agreement of his or her part to be performed, the non- defaulting party shall have the right to sue for specific performance or damages for the breach of the Agreement, and the defaulting party shall pay the reasonable legal fees for any services rendered by the non-defaulting party's attorney in any judicial or arbitral determination of breach as well as costs to bring the action or proceeding of enforcement. 7 15. Execution of Documents. The parties agree to execute all documents, including but not limited to, deeds of title that are reasonably necessary to effectuate the purpose of this Agreement. In the event that either party shall refuse or fail to execute and/or acknowledge any such document, then the other party shall have, and is hereby granted, the right and power to appoint one or more times any person or persons of his or her choosing as attorney-in-fact for the other party to so execute and acknowledge such documents. 16. After-Acauired ProDertv. Each of the parties shall hereafter own and enjoy, independently of any claim or right of the other, all items of property, be they real, personal or mi~ed, tangible or intangible, which are acquired by him or her after execution of this Agreement, with full power in him or her to dispose of the same as fully and effectively, in all respects and for all purposes, as though he or she were unmarried. 17. Miscellaneous. A. This Agreement constitutes the entire agreement between the parties, being the final and complete settlement of all matters between them and supersedes any prior written or oral agreements between them respecting the within subject matter. There are no representations, agreements, arrangements or understandings, oral or written, between and among the 8 parties hereto relating to the subject matter of this Agreement which are not fully expressed herein. B. This Agreement may not be amended, modified, altered or revoked except in writing executed by both the parties hereto. C. This Agreement may not be assigned by either part~ without the prior written consent of the other party. D. This Agreement may be executed in multiple counterparts, each of which shall be deemed an original for all purposes, and all of which together shall constitute one and the same instrument. E. This Agreement shall be binding upon the parties hereto, their heirs, executors, administrators and assigns. F. This Agreement shall be interpreted under the laws of the Commonwealth of Pennsylvania. G. The failure to strictly enforce any part of this Agreement shall not be deemed a waiver thereof, and a waiver of any part of this Agreement shall not be deemed a waiver of any other part of this Agreement. H. C. files this Pretrial Statement pursuant to Pa.R.c.P. 1920.33(b) as follows: 1. ASSETS. LAW O....'CE& SNELBAKER & BRENNEMAN Almost all marital assets of the parties have been divided by mutual agreement of the parties. Among these assets was the marital home located at 72 South Pin Oak Drive, Boiling springs, which was sold by agreement of the parties June 23, '1995, at which time the mortgages and other outstanding debts (all marital debt) on the property were paid in full and the net proceeds - $35,910.70 ~ divided equally among the parties. The parties have further agreed to and already divided the personal marital property. Attached hereto and incorporated herein as "Exhibit A" is a tabulation of marital assets and property divided by the parties by mutual agreement, setting forth, inter slis, payment of debt and adjustments they made after sale of the marital real estate. An agreement entered into by the parties ~ se setting forth the basis of this understanding is attached hereto and LAW OI"I"ICE& SNELBAKER & BRENNEMAN incorporated herein as "Exhibit B". The only marital asset for which neither an accounting nor an agreement has been reached are the parties savings account and Defendant's pension benefit which he cashed in on February 3, 1994. Evidence will indicate the parties separated December 1, 1993 at which time Defendant left the marital residence. He supported himself through a $4,000 loan obtained from PNC Bank, N, A. and on February 3, 1994, he cashed in his 401K pension benefit and received $14,267.34, which he used to pay his living expenses until June, 1995 when the marital home was sold and he received proceeds from that sale. However, evidence will indicate that for the 19 month period of December 1, 1993 through June 23, 1995, Defendant deposited ~ his income from employment into the joint checking account which Plaintiff used exclusively. During this time, Defendant by direct deposit gave Plaintiff $46,138.88. The parties also had a marital savings account with a balance of $1,740.40 as of May 15, 1994. Plaintiff withdrew all but $10.57 for her use by April 14, 1995. Evidence will also show that Plaintiff received the parties' 1993 federal tax refund in excess of $3,000 and the 1994 federal tax refund of $2,707 and expended those funds as well. EXPERT WITNESSES. Defendant anticipates calling no expert witnesses at the earing to be scheduled in this case. . -2- 3. FACT WITNESSES. Other than the parties, Defendant intends to call no other witnesses at the time of the hearing, but reserves the right to call rebuttal witnesses depending on the testimony presented in Plaintiff's case. 4. EXHIBITS. As indicated above, Defendant on February 3, 1994 withdrew his 401K benefits in the amount of $14,267.34 and utilized that money for living expenses until the marital home was sold in June, 1995. PNC Bank statements will be used to confirm the value of the benefit withdrawn. 7. COUNSEL PEES. Neither party has made a claim for counsel fees in this case. 8. DISPUTED TANGIBLE PERSONAL PROPERTY. Defendant is not aware of any disputes involving tangible personal property requiring resolution by this Court. 9. MARITAL DEBTS. u,w a'PleEB SNELBAKER & BRENNEMAN The parties mutually paid most outstanding marital debt at the time the marital residence was sold. (See Exhibit A hereto.) Defendant paid after settlement in excess of $500.00 to extinguish various debts incurred by Plaintiff while she occupied the marital home prior to its sale. Defendant further paid most, if not all, expenses for the home, including the mortgage -4- r. payments, through his weekly deposit of his wages from December, 1993 through June, 1995. 10. PROPOSED RESOLUTION OF ECONOKIC ISSUES. The parties by mutual agreement have resolved almost all economic issues. Defendant proposes that formal resolution be upon the terms already agreed to and in addition, that Plaintiff receive no payment or benefit due to Defendant's use of the 401K funds. Based upon Plaintiff's earning capacity, receipt of the majority of personal property and the substantial cash she has received and used, Defendant makes no offer to pay alimony/, alimony pendente lite.. In essence, Defendant requests this Court only to confirm the distribution of marital assets and debts as already agreed to by the parties and enter a divorce decree based upon the parties' two year separation. The tax consequences of the sale should be distributed between the parties proportionate. (10) Proposed Resolution of the Economic Issues: The parties have already sold the marital residence and, with the proceeds therefrom, have paid the marital debts. Plaintiff has proposed that she waive any claim as to the remaining marital property, that Defendant continue to provide medical coverage for 60 months (or until Plaintiff remarries), and that Defendant pay alimony taxable to Plaintiff of $350.00 per month for 60 months (or until Plaintiff remarries).
