ANSWER TO COMPLAINT CONTAINING COUNTERCLAIM
AND NOW, comes Defendant, JONES MASONRY RESTORATION CORP., by
and through its attorney, Robert L. Buzzendore, Esquire, and in
support of its Answer to Complaint avers as follows:
1. Admitted.

It is admitted that one
of Defendant's employees may have indicated acceptance of the
agreement. It is specifically denied that the person had authority
as an agent to accept the agreement.
B. Admitted.

11. Admitted in part, denied in part. It is specifically denied
that certain items as identified in Plaintiff's allegations were
agreed upon as part of the contract.
a. Denied. Defendant did not agree to cover and seal all
windows and doors. To the contrary, Defendant only agreed to cover
the windows with tape, but this was not for the protection against
dust.
b. Denied. It is denied that Defendant agreed to cover the
flower beds and shrubs. To the contrary, although Defendant did not
agree to this provision, Defendant did cover the shrubs and some
tomato plants as a courtesy to Plaintiff.
c. Admitted.
12. Denied. It is specifically denied that Plaintiff discussed
the provisions mentioned in Paragraph 11 directly with Defendant's
representative.
13. Admitted.
14. Admitted in part, denied in part. It is admitted that
Plaintiff's Agent paid $1,500.00 to Defendant's representative, but
it is specifically denied that the agreement was sealed by a
handshake.
15. Admitted.
16. Denied. It is denied that Defendant failed to seal the
windows or protect the flower beds. To the contrary, the Defendant
sealed the windows with plastic to protect them from the chemicals
used in the restoration process. The plastic will not ensure
protection from dust but Defendant cleaned and rinsed the dust away
afterwards.
17. Denied. It is specifically denied that Defendant's
daughter arrived due to the complaints of Plaintiff's Agent. To the
contrary, the plastic was en route prior to the complaints.
18. Denied. After reasonable investigation, Defendant is
without sufficient knowledge or information to form a belief as to
the truth of the averment and therefore, strict proof thereof is
demanded.
19. Denied. It is denied that 538 bricks were damaged by
Defendant. To the contrary, Defendant may have damaged approximately
15 bricks during the course of work. However, Defendant repaired
approximately 20 bricks.
20. Denied. After reasonable investigation, Defendant is
without sufficient knowledge or information to form a belief as to
the truth of the averment and therefore, strict proof thereof is
demanded.
21. Admitted in part, denied in part. It is denied that
Plaintiff's Agent discussed concerns with Defendant's workers at the
job. Rather, Plaintiff's Agent harassed Defendant's workers and
refused to comply with Defendant's instructions to confer with the
office.

denied that Defendant completed the work in an unworkmanlike manner.
To the contrary, Defendant completed the work in a professional
manner. It is admitted that Plaintiff directed Dafendant to leave
the premises.

alleged in Paragraph 18 or that he caused irreparable damage as
detailed in this paragraph.
a. Admitted in part, denied in part. It is denied that
Defendant caused irreparable damage to the front and right side
flashing. It is admitted that Defendant caused an 1/16 inch nick in
the flashing.
b. Denied. It is denied that Defendant caused damages to
the aluminum trim in the windows and doors.
c. Denied. It is denied that Defendant caused damages to
the roof flashing on the porch.
d. Denied. It is denied that Defendant caused damages to
the aluminum carriage door.

COUNT I
BREACH OF CONSTRUCTION CONTRACT
29. Paragraphs one through twenty-eight are incorporated by
reference as though fully set forth herein.
30. Paragraph thirty is a legal conclusion to which no
responsive pleading is required. To the extent any facts are
averred, they are specifically denied and proof thereof is demanded.
31. Denied. It is specifically denied that Defendant directly
or indirectly caused damages to the premises. To the contrary,
Defendant completed the work in a professional manner. Strict proof
thereof is demanded.
WHEREFORE, Defendant requests this Honorable Court to enter
judgment in its favor and against Plaintiff.
COUNT II
BREACH OF CONSTRUCTION CONTRACT
UNWORKMANLIKE PERFORMANCE--FAILURE TO COMPLETE

33. Denied. It is denied that the Defendant failed to perform
items which were required by the contract. To the contrary,
Defendant performed its services in a workmanlike manner.
a. Denied. It is denied that protection of the flower beds
and shrubs existed as part of the agreement.
b. Denied. It is denied that Defendant failed to properly
clean the work area. To the contrary, Defendant cleaned the area as
work progressed on the project.
34. Paragraph thirty-four is a legal conclusion to which no
responsive pleading is required. To the extent any facts are
averred, they are specifically denied and proof thereof is demanded.
35. Denied. It is specifically denied that Defendant breached
the agreement and therefore, failed to cure any breach. To the
contrary, in an effort to satisfy the customer's concern, Defendant
offered to perform additional work at no charge to Plaintiff.
WHEREFORE, Defendant requests this Honorable Court to enter
judgment in its favor and against Plaintiff.
COUNTERCLAIM
Defendant further asserts that it has a cause of action against
the Plaintiff of the following nature and character:
1. On or about June 28, 1994, Plaintiff and Defendant entered
into a contract for the restoration of masonry.
2. The Plaintiff and Defendant agreed to a fee of $7,892.00 for
services to be performed in connection with the contract.
3. On or about June 28, 1994, Plaintiff paid $1,500.00 as a
down payment on the contract.
4. On or about June 28, 1994, Defendant commenced work on the
project in accordance with the terms of the contract.
5. On or about August 19, 1994, Plaintiff paid $1,964.00 toward
the balance of the contract price.
6. On or about September 6, 1994, Plaintiff paid $1,964.00
toward the balance of the contract price.
7. On or about September 21, 1994, Plaintiff requested that
Defendant leave the work location.

8. On or about September 21, 1994, Defendant sent a letter to
Plaintiff offering to repoint the mortar at no additional cost.
Defendant admitted no liability by this proposal and he offered it as
means of resolving the customer's concerns.
9. On or about September 26, 1994, Defendant submitted an
invoice to Plaintiff in the amount of $2,464.00 for the final balance
of the contract.
10. On or about October 13, 1994, Defendant sent a letter to
Plaintiff requesting payment of the balance and explaining the
moisture problem.
11. Defendant complied with the applicable terms of the
contract and performed the work in a workmanlike manner.

Bradford Orr, Esquirc, with the following Complaint:
1. GEORGIA L. LENTZ (hcreinafter refcrred to as Plaintift) is an individual and citizcn of
the Commonwealth of Pennsylvania with an address located at 1401 Arcona Road, Mechanicsburg,
Cumberland County, Pennsylvania, 17055.
2. JONES MASONRY RESTORATION CORP. (hcrcinaftcr rcfcrrcd to as Dcfendant) is a
corporation organized and existing under the laws of thc Commonwealth of Pcnnsylvania, with a
principal place of business located at 1370 Howard Strcet, Harrisburg, Dauphin County,
Pennsylvania, 17105.
3. Bruce Shuey (hereinaftcr refcrred to as Plaintiffs "Agent) is an adult individual also
residing at 1401 Areona Road, Meehaniesburg, Pennsylvania, 17055.
4. Venue is proper in eumbcrland County as Dcfendant regularly conducts business hcre
and as transactions and oeeurrcnces upon which Plaintiffs claims are based took place in
Cumberland County, Pcnnsylvania.
5. On or about Junc 28, 1994, pursuant to a wrlllcn proposal offercd by Dcfcndant, the
rcstoration of Plaintiffs masonry work, was cntcred into by the partics. (Sec Plaintiffs Exhibit A.)
6. Tbc agrecmcnt entered into on Junc 28, 1994, providcd: "Restoration of masonry, c1can
brick by chemical proecss, rcpoint restoration arca 100%, replaec damaged brick with brick to
match cxisting as c10sc as possible, repoint and rebuild chimney as necessary to makc structurally
sound."

7. On June 28, 1994, Plaintiffs Agent acecptcd thc agrccment via a telephonc authorization
by Plaintiff. At that tlmc, Defendant's reprcscntative verbally aeknowlcdged aeecptanee of thc offer
by Plaintiff in thc same phone conversation.
8. On June 28, 1994, Plaintirl's Agcnt submitted $1,500.00 cash as a downpaymentto
Defcndant's representativc, Ricardo TIlOmpson. (See Plaintiffs Exhibit A)
9. Although the original cstimate given by Dcfcndanttl Plaintiff was $6,892.00, the
agreemcnt entcred into 011 Junc 28, 1994, was for $7,892.00.
10. Thc additional $1,000.00, according to Defendant, was to reconstruct a chimney If
necdcd.
11. Plaintiffs Agcnt and Dcfcndant's company representativc did a walk-through of the
propcrty on Junc 28,1994, and the following Items were agreed upon as part of the contract:
A. All windows and doors would be covcred, taped and seal cd so as to prevent dust
and othcr dirt resulting from the grinding of the mortar joists from cntcring the housc.
B. AlIl10wer beds and shrubs wcre to bc covcred to proteetthcm from dirt and
dust.
e. Thc front porch roof would also bc eovcrcd to keep dust and mortar mix from
affecting thc one-ycar-old shingles.
12. In addition to the Plaintiffs Agent and thc Defcndant's rcpresentativc discussing the
itcms as sct forth in thc preecding paragraphs, thcy wcre also discussed dircetly bctween Plaintiff
and Dcfendant's rcprcsentative.
13. On June 28, 1994, a discussion bctwecn Defendant's rcpresentativc and Plaintiff
occurred whereby the Dcfendant's represcntative agreed to verbally accept Plaintiffs signature on
thc proposal by way of Plaintiffs Agent's executing Plaintiffs signaturc on said contract.
14. Plaintiffs Agent further scaled the deal with a handshakc and tendcrcd a downpaymcnt
of $1,500.00 cash to Defendant's agent.
15. On or about June 29, 1994, two employces from Defendant's Company arrived on the
prcmises and began IVork.
16. Employees of Defendnnt fniled to scnlnny windows or doors, fuiled to protect flower
beds, and failcd to protect other property in thc surrounding area.
17. After Plnintiffs Agcnt pcrsistently eomplnined, Defendant's daughter arrived at 1401
Areona Road, Meehaniesburg, Pennsylvania, with plastic and duct tapc, and bcgan covering up thc
prcviously agrced upon areas.
18. A~ work continued on the project, Plaintiffs Agent noticed numerous, unsightly grinder
marks on the old bricks.
19. Before the job was eomplcted, approximatcly 538 bricks wcre severely damagcd by
Dcfcndant's employccs.
20. Although Plaintiffs Agent allemptcd to monitor the work of Defendant's employces, hc
was unablc to bc constantly on thc job sitc.
21. Each and cvery time Plaintiffs Agent was on thc job site, howcvcr, he voiecd conccrns
to Defendant's cmployces regarding the poor job thcy were doing.
22. Many timcs throughoutthc masonry rcstoration process, Plaintiffs agent contaetcd
Dcfendant's reprcscntative, Rick Thompson, with concerns. Each and cvery time Defcndant's
rcprescntativc assurcd Plnintiffs agent that the job will "look good whcn it is finished."
22. On or about August 19, 1994, Plaintiff puid $1,964.00 as first paymcnt on rcstoration
contract to Dcfendnnt's rcpresentativc, Kathlecn L. Joncs. (See Plaintiffs Exhibit B.)
23. On or about Scptcmber 6, 1994, Plaintiff submillcd an additional payment of $1,964.00
to Defcndant's represcntativc, Ricardo Thompson. (See Plaintiffs Exhibit C.)
24. Due to continued shoddy and unworkmanlike performance, Plaintiff finally direetcd
DcfendantlO rcmovc himsclf and his employecs and matcrials from the job site. This oceurrcd on
or about September 21, 1994.
25. In addition to the significant damagc to thc older bricks rcferred to in paragraphs 18
and 19, supra, Dcfendant's employees did irreparable damage to the following:
A. Front and right side flashing housej
B. Aluminum window trim in all windows und doorsj
e. Roof tlashing on front porch and right roof porch;
D. Aluminum carriage door at right entranec of house.
26. Complaints and cross-complaints were tiled bcfore District Justice Ronald E. Klair and
a hearing was held on or about February 24, 1995.
27. The Complaint and cross-complaint rcfcrred to immediately above was dismissed
without prcjudiec by District Justice Klair.
28. A timely appeal was then filed in the Prothonotary's Office of the Cumberland County
Court of Common Pleas by Plaintiff.
COUNT I
BREACH OF CONSTRUCTION CONTRACT
29. Plaintiff incorporates by rcference paragraphs 1 through 28 in their entirety.
30. Thc actions of Dcfendant as aforesaid arc wilful and constitute a material breach of the
agreement cntered into bctween Plaintiff and Defcndant.
31. As a direct and proximatc rcsult of thc actions of the Dcfendant as aforesaid, Plaintiff
has suffered and continues to suffer serious injury, including but notlimlted to the loss of significant
valuc of her circa 1860 brick farm housc, which was thc sight of thc work pcrformed by Dcfcndant,
in an amount which has yet to bc detcrmincd.
WHEREFORE, Plaintiff demands that this Court enter judgment in her favor and against
Defendant in the amount of $16,488.00 togethcr with costs and interest and attorney's fees.
COUNT II
BREACH OF CONSTRUCTION CONTRACf
UNWORKMANLIKE PERFORMANCE. FAILURE TO COMPLETE
32. Plaintiff incorporates hy reference paragraphs 1 through 31 in their cntirety.
33. Dcfendant has wholly ncglectcd to do and pcrform certain things which wcre expressly
or by necessary implication requircd to bc done and performed by the agrecment, as follows:

B. Total failurc by Defcndant's cmployees to c1can up job sitc in a proper fashion as
work was completed.
34. Dcfendant bas performed in a poor, impropcr and unworkmanlike manner.
35. Defendant has failed, refused, and continues to rcfuse to cure the aforesaid breaches,
despite Plaintiffs repcaled demand. TIle reasonable cost of remedying the aforcsaid breaches Is in
excess of $16,000.00.
WHEREFORE, Plaintiff respectfully demands judgment against Defcndant in an amount of
not less than $16,488.00, togcther with costs and interest and attorney's fees.
