items of personal property. Because of the size of said items,
Defendant agreed to load said merchandise in <'laintiff Rickabaugh's
6. In the course of loading the merchandise in the rear of
Plaintiff Rickabaugh's vehicle Defendant, acting through its
agents, servants and employees, negligently failed to secure the
rear spare tire carrier which is affixed to the tailgate.
Plaintiff Rickabaugh subsequently exited the Defendant's premises
and travelled a very short distance when the spare tire rack which
is hinged to the tailgate of the car swung out striking the parked
vehicle of Todd Johnson, a Ford van, damaging the rear of the
vehicle in an amount of Three Hundred Eighty Three Dollars and

Seventy Seven Cents ($383.77). Proof of said damages is attached
hereto as Exhibit A and submitted pursuant to Pa R.C.P. 1305 (b).
7. The spare tire subsequently swung back damaging the
tailgate and breaking the rear window of Plaintiff Rickabaugh's
vehicle doing One Thousand Two Hundred Thirteen Dollars and Seventy
Cents ($l,2l3.70)in damage.
Proof of said damages are attached
hereto as Exhibit B and submitted pursuant to Pa R.C.P. 1305 (b).
8. The damages sustained to the vehicles of Plaintiffs' was
a direct and proximate result of the negligence of Defendant
Cochran and Allen, Inc., acting through its agents, servants and
employees in negligently failing to properly secure the tire rack
