In consideration of the attached Commonwealth's Petition, the defendant, JACK RUSSELL KNIPE, III, is directed to appear for trial on the charge of Indirect Criminal Contempt before the Court on the day of , 1995 at o'clock .m. in Courtroom # __ of the Cumberland County Courthouse, Carlisle, Pennsylvania. Placey, Senior Assistant District Attorney of Cumberland County, Pennsylvania brings the following Petition for a hearing on charges of Indirect Criminal Contempt: 1. A Protection from Abuse Order was issued by the Court. A true and correct copy of the Order is attached. 2. The defendant's violation of this Order is averred in the attached private criminal complaint. 3. The victim requests the filing of an Indirect Criminal Contempt charge upon information received. '.; 4. The District Attorney's Office approves the filing of this private criminal complaint. 5. The Commonwealth is requesting a trial on the charges of Indirect Criminal Contempt pursuant to 23 Pa.C.S.A. 56113. 6. The plaintiff and the defendant may seek modification of the Order based on the filing of this petition as the Court deems appropriate following the trial in addition to any other sentence. 23 Pa.C.S.A. 56117. JACK RUSSELL KNIPE, III, Defendant AND NOW, this TEMPOR~RY e.B9TECIJ OIL9RD.!'B _Z_~r4_ day of March, 1995, upon presentation and consideration of the within Petition, and upon finding that the plaintiff, SHANA LYNNE PENNER, now residing at 564 Mountain Road, Boiling Springs, Cumberland County, Pennsylvania, ie in immediate and present danger of abuse from the defendant, JACK RUSSELL KNIPE, III, the following Temporary Order is entered. The defendant, JACK RUSSELL KN I PE, I II, SSN: 182-56-2808 and OOB: 5/14/76, now residing at Caboose Lane, BOiling Springs, Cumberland County, Pennsylvania, is hereby enjoined from physically abusing the plaintiff, SHANA LYNNE PENNER, or placing her in fear of abuse. The defendant is ordered to stay dway from the plaintiff's residence located at 564 Mountain Road, Boiling Springs, Cumberland County, Pennsylvania, a residence which is owned by the plaintiff's mother and stepfather. The defendant is ordered to refrain from having any direct or indirect contact with the plaintiff including, but not limited to, telephone and written communications. The defendant is enjoined from harassing and stalking the plaintiff and from harassing the plaintiff's relatives. The defendant is enjoined from entering the plaintiff's I ~ ( ~ ~ 1 t , , I place of employment. A violation of this Order may subject the defendant to: i) arrest under 23 Pa. C.S. 66113; ii) a private criminal complaint under 23 Pa. C.S. 66113.1; iii) a charge of indirect criminal contempt under 23 Pa. C.S. 66114, punishable by imprisonment up to six months and a fine of $100.00-$1,000.00; and iv) civil contempt under 23 Pa. C.S. 66114.1. Resumption of co-residence on the part of the plaintiff and defendant shall not nUllify the provisions of the court order. This Order shall remain in effect until modified or terminated by the Court after notice or hearing and, can be extended beyond that time, if the Court finds that the defendant has committed another act of abuse or has engaged in a pattern or practice that indicates continued risk of harm to the plaintiff. The plaintiff, SHANA LYNNE PENNER, is an adult individual residing at 564 Mountain Road, Boiling Springs, Cumberland County, Pennsylvania 17007. 2. The defendant, JACK RUSSELL KNIPE, III, SSN:182-56-2808 and DOB: 5/14/76, is an adult individual residing at Caboose Lane, Boiling Springs, Cumberland County, Pennsylvania, 17007. 3. The defendant has had an intimate relationship with the plaintiff. 5. Since approximately February 1995, the defendant has attempted to cause and has intentionally, knowingly, or recklessly caused bodily injury to the plaintiff, or has placed thA plaintiff in reasonable fear of imminent serious bodily injury, and has knowingly engaged in a course of conduct or repeatedly committed acts toward the plaintiff under circumstances which have placed tho plaintiff in reasonable fear of bodily injury. This has included, but is not 1 imited to, the following speCific instances of abuse: a. On or about March 19,1995, the defendant became angry at the plaintiff who is two months pregnant, I I I grabbed her by the hair, pulled her across the floor to the stairs, punched the plaintiff in the jaw, grabbed her face with his hand and squeezed her, causing the plaintiff pain. The defendant then grabbed the plaintiff by her hair with one hand, grabbed the plaintiff's arm with his other hand, and pushed her up the stairs to the bedroom. Once inside the bedroom, the defendant threw the plaintiff onto the bed and punched the plaintiff in the head, causing her to become dazed and fall backwards. The defendant then jumped on the plaintiff, straddled her, and choked her with his hands, threatening to kill her. The defendant then grabbed the plaintiff's face and squeezed it so that the plaintiff could not speak. When the defendant left the room, the plaintiff called 911 and the Pennsylvania state Police arrived forty-five minutes later and made the defendant, who had passed out, leave the plaintiff's residence. The plaintiff suffered a bloody lip and brUising to her neck and arms. Later that morning, the plaintiff woke up when she heard the defendant come up the stairs. The defendant pushed the plaintiff, hit her- about the head and face, and strangled the plaintiff threatening her saying that if she did not drop the criminal charges, she would be sorry. The defendant the" unplugged the phone and told the plaintiff to go to sloep. When the defendant went downstairs and left, the plaintiff telephoned for help. Later that afternoon, the defendant called the plaintiff and when the plaintiff got angry at the defendant for calling her, he hung up and appeared in her driveway several minutes later causing her to fear. When the plaintiff telephoned the police, the defendant left the residence. The Pennsylvania state Police arrived again and later arrested the defendant for simple assault, terrorisic threats, intimidation of a witness, burglary, underage drinking, criminal mischief, and other various charges. b. On or about March 3, 1995, while the plaintiff and defendant were parked in the plaintiff's car, the defendant became angry, lunged at the plaintiff pushing her backwards, and choked her. The plaintiff struggled free and the defendant left the vehicle. c. On or about February 15, 1995, the defendant pushed the plaintiff backwards causing the plaintiff to fall and hit her back against the edge of the bed, causing bruising. d. Since February 1995, the defendant has threatened to kill the plaintiff, grabbed, threatened, shoved, and slapped the plaintiff, and restrained her from leaving. 6. The plaintiff believes and therefore avers that she is in immediate and present danger of abuse from the defendant, and that she is in need of protection from such abuse. 7. The plaintiff desires that the defendant be prohibited from having any direct or indirect contact with the plaintiff including, but not limited to, telHphone and written communications. 8. The plaintiff desires that the defendant be enjoined from harassing and stalking the plaintiff, and from harassing the plaintiff's relatives. 9. The plaintiff desires that the defendant be restrained from entering her place of employment. P~TTORNEY FEES 10.
