James J, Dipaolo never executed the Mortgage or Note at issue.
They have been named as Defendants in this action pursuant to Pa.
R.C.P. 1144 (a) (3) because they are the real owners of the subject
property.

AMENDED PLAINTIFF I S RESPONSE TO NEW MATTER
AND NOW COMES Plaintiff, York Federal Savings & Loan
Association, by and thruugh ite, attorney, Benjamin F. Riggs, Jr.,
and responds to the New Matter filed by the Defendants in the
above-captioned matter as follows:
1. It is admitted that Defendants, Colleen M, Dipaolo and
James J. Dipaolo never executed the Mortgage or Note at issue.
They have been named as Defendants in this action pursuant to Pa.
R,C.P. 1144 (a) (3) because they are the real owners of the subject
property.
The Mortgage was a valid lien of record when said
Defendants purchased the subject property.
This is a Mortgage
Foreclosure, or in rem action, not an in personam action for a
money judgment against the Defendants.

Denied,
No response is required as this is a legal
conclusion of law.
WHEREFORE, Plaintiff, York Federal Savings & Loan Association
asks this Honorable Court to dismiss Defendants' New Matter and
prays for a judgment in its favor and against Defendants in the
amount of Eight Thousand Six Hundred Seventy-Three and 46/100
Dollars ($8,673,46), with interest thereon until paid at such rate
or rates as established by Plaintiff pursuant to the terms of the
Note, currently $2.59550 per diem, from March 22, 1995, late
charges at 5\ of the monthly payment amount, currently $15.59 from
March 22, 1995, attorney's fees, costs of suit, and other charges
collectible under the Mortgage; for the foreclosure and sale of the
mortgaged premises; and for any and all other relief as the Court
deems appropriate.
