The plaintiffs went to the place of business at 409 South Fayette Street of defendants,
Terry and Gloria Beecher. The plaintiffs went with defendants Gloria Beecher and Wendy Shatzer
on August 12, 1994.

The defendants oOered a mobile home for sale which was located on Lot #28, Town Mills
Mobile Home park. Said mobile home was alleged to be owned by defendants, Todd Shatzer and
Wendy Shatzer,

The parties agreed that the plaintiffs would purchase said mobile home for the sum of
Three Thousand Five Hundred and nollOO ($3,500.00) Dollars with the sum of One Thousand
Seven Hundred Fifty and nollOO ($1.750.00) Dollars paid on August 12, 1994, with the balance
due when the mobile home was vacant by defendants. Toby and Wendy Shatzer.

The plaintiffs gave the defendants a check payable to cash which represented the down
payment for said mobile home. A copy of the check is attached and marked as Exhibit "A". A
copy of the receipt is marked as Exhibit "B" and both Exhibits are hereby incorporated in this
complaint and are made a part hereof.

The defendants', Toby Shatzer and Wendy Shatzer, as well as defendants, Terry and Gloria
Beecher, failed to contact the plaintiffs or notify them when the trailer became vacant.

The defendants instead placed advertisements for the sale of the 1991 12x65, 2 bedroom
mobile home in a local newspaper. The Shatzer's called the plaintiffs in November of 1994 and
notified the plaintiffs that the mobile home had been sold to a third party.

When the plaintiffs requested the return of their down payment. defendant Shatzer
indicated that the down payment had been given to defendants Gloria and Terry Beecher, the
parents of defendant Wendy Shatzer, and that it would not be returned.

Despite the repeated requests by the plaintiffs, the defendants have refused to pay to the
plaintiffs the sum of One Thousand Seven Hundred Fifty and no/100 ($1,750.00) Dollars,

The actions by defendants, Toby and Wendy Shatzer, constitutes a breach of their contract
to sell the mobile home to the plaintiffs.

The actions by the defendants, Terry Beecher and Gloria Beecher, in accepting the funds of
the plaintiffs even though they were assisting the defendants. Toby Shatzer and Wendy Shatzer in
securing other buyers for the mobile home constituted fraud and conspiracy to commit fraud. The
defendants, Terry Beecher and Gloria Beecher have been unjuslly enriched by keeping the funds of
the plaintiffs.

7. Denied as stated. The plaintiffs gave Defendants Wende
Shatzer and Gloria Beecher said check.
B. Denied. Defendant Wende Shatzer contactod Plaintiff
Joyce Smith in october, 1994, and advised her that said mobile
home would be vacanct by the end of october, and that the
Plaintiffs could take possession as of November 1, 1994 upon
payment of the balance of the purchase price.
9. It is admitted that Defendant Wende Shatzer placed an
advertisement in a local newspaper for the sale of said mobile
home. TIlis was done, however, only after Plaintiff Joyce smith
informed her that the Plaintiffs did not intend to purchase said
mobile home and at the suggestion of Plaintiff Joyce Smith.
Defendant Wende Shatzer notified the Plaintiffs after the sale.
10. Denied as stated. Defendant Wende Shatzer advised the
plaintiffs that the downpayment had been given to Defendant
Gloria Beecher, and that it would not be returned.
11. Admitted.
12. The averments of Paragraph 12 are conclusions of law to
which no response is required.
13. The averments of Paragraph 13 are conclusions of law to
which no response is required.
14. Denied. The responses to Paragraphs Band 9 and
Paragraphs 15 through 21 below are incorporated herein by
reference.
WHEREFORE, the Defendants request that the Plaintiffs'
Complaint be dismissed.
NEW MATTER AND COUNTERCLAIM
15. In october, 1994, Defendant Wende Shatzer advised
Plaintiff Joyce smith that the Shatzers would vacate the mobile
home by the end of the month and that the Plaintiffs could begin
occupancy on the first day of November, 1994, and upon payment of
the balance of the purchase price.
16. Plaintiff Joyce smith informed Defendant Wende shatzer
that it would take a few days for the Plaintiffs to come up with
the balance of the money owed.
17. Several days later Plaintiff Joyce smith contacted
Defendant Wende Shatzer and advised her that the Plaintiffs no
longer desired to purchase the mobile home, but stated that the
Plaintiffs' son might be interested in buying it.
18. Defendant Wende Shatzer showed the mobile home to the
Plaintiffs' son, but was informed that he did not wish to
purchase it.
19. Defendant Wende Shatzer informed Plaintiff Joyce Smith
that Plaintiffs' son did not wish to purchase the mobile home.
20. Plaintiff Joyce smith suggested to Defendant Wende
Shatzer that Shatzer advertise the mobile home for sale in the
newspaper, which was done.
21. On November 18, 1994, Defendants Wende Shatzer and
Gloria Beecher sold the mobile home to a tuird party for
$1,800.00.
22. Defendant Wende Shatzer paid lot rent for November,
1994, of $135.00 which shu would not have incurred had Plaintiffs
purchased the mobile home effective November 1, 1994.
23. Defendant Wende Shatzer paid $10.00 to advertise the
sale of the mobile home in the newspaper which she would not have
incurred had the Plaintiffs purchased the mobile home effective
November 1, 1994.
24. The Plaintiffs breached their contract with Defendants
Wende Sh&tzer and Gloria Beecher by failing to pay the balance of
the purchase price on or about November 1, 1994.
25. Defendants Wende Shatzer and Gloria Beecher have
incurred a loss of $95.00 as a result of the Plaintiffs' failure
to pay the balance of the purchase price on or about November 1,
1994.
26. Defendants Toby Shatzer and Terry Beecher had no
ownership interest in said mobile home and had no involvement in
the agreement to sell said mobile home to the Plaintiffs.
WHEREFORE, the Defendants request that the Plaintiffs'
Complaint be dismissed and that judgment be entered in favor of
the Defendants Wende Shatzer and Gloria Beecher and against the
Plaintiffs in the amount of $95.00.

The averments of paragraph twenty-two (22) of the New Maller with Counterclaim are
specifically denied, On the contrary, the defendant never indicated the actual date of their
vacating the property. The plaintiffs were never given an opportunity to pay the balance of the
purchase price nor were they informed of the plans of the defendants to sell the home to a third
party, The plaintiffs have no obligation to pay the lot rent of the defendant under these
circumstances.

The averments of fact contained in paragraph twenty-three (23) of the New Matter with
Counterclaim are specifically denied. The decision to sell the mobile home to a third party
without notifYing the plaintiffs was made by the defendants and the plaintiffs have no obligation to
pay the advertising expenses,

The averments of fact contained in paragraph twenty-four (24) of the New Maller and
Counterclaim are specifically denied. On or about November I. 1994, the defendants never
infonned the plaintiffs that the trailer was vacated or that they expected the final payment from
the plaintiffs,

The averments of fact contained in paragraph twenty-five (25) of the New Matter and
Counterclaim are specifically denied. On the contrary, the plaintiffs were not responsible for any
expenses incurred by the defendants when the plaintiffs were never given an opportunity to
purchase the mobile home.
