IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA CIVIL ACTION - DIVORCE 95-1659 CIVIL TERM DR 23.581 95-0148 SUPPORT IN RE: REQUEST EillLS.PillALREUfE ORDER OF COURT AND NOW. June 28, 1995, 3:50 p.m., having considered the evidence presented, we do direct that Edward J. Richards pay the sum of $4,720.00 in medical bills incurred by Lorenda Richards from the period she incurred them on December 22, 1994, through May 20, 1995. We find that Edward J. Richards hod medical coverage on Lorenda, his wife, through his employment and that he paid extra from his paycheck for this coverage for Lorenda and the parties child (DOB 1/16/94). Husband canceled this coverage on or about November 30. 1994, in spite of the offer of Lorenda to separately pay to the husband the amount of the coverage, so the coverage could continue. We also note that the husband was directed to furnish medical coverage to Lorenda and the child concurrent with an Order of Support entered on March 17, 1995. 4. On or about June 5, 1994, Respondent moved out of the marital residence and secured a residence independent of his wife and the parties' daughter Desiree Richards (DOB: 1/16/94). 5. In or around November 1994, Respondent unilaterally and without advance notice to Petitioner, terminated medical coverage on petitioner and the parties' child. 6. Thereafter, Petitioner was forced to apply for medical assistance through the Department of Public Welfare in order to provide medical coverage for herself and her daughter. 7. After Respondent's termination of Petitioner's medical coverage, Petitioner was hospitalized with a blocked kidney and incurred thousands of dollars in medical bills incident to that hospitalization and treatment. 8. Although medical assistance has paid a portion of Petitioner's medical bills as set forth in the preceding paragraph, there still are outstanding medical bills related to her medical condition. 9. The parties attended a support conference at the Cumberland County Domestic Relations Office on or about March 17, 1995. 10. Following the support co~ference, the court entered an order directing Respondent to reinstate medical coverage for both Petitioner and the parties' child. 11. Although Petitioner believes and therefore avers that Respondent has completed the application for reinstatement of 2 medical coverage, she nevertheless has incurred in excess of $4,000 in unpaid medical expenses as a direct result of Petitioner I s termination of her coverage last fall. 12. By letter dated May 1, 1995 and directed to Respondent's counsel, Petitioner's counsel requested Respondent to pay these expenses. 13. To date, Respondent has ignored this request. 14. The medical providers have been contacting Petitioner to make immediate payments on the unpaid medical bills. WHEREFORE, Petitioner requests the court to issue a rule upon Respondent to show cause, if he has any, why this court should not order him to pay: a) any and all medical bills incurred by petitioner as a result of Respondent's termination of her medical benefits in November, 1994 and b) any and all future medical bills which Petitioner will incur as a result of the change in coverage. Application of Law to Facts: In enacting the Divorce Code of 1980, Pennsylvania's legisla- ture sought, inter alia, to [m]itigate the harm to the spouses and their children caused by the legal dissolution of the marriage. ,. . [e] ffectuate economic justice between parties who are divorced or separated and grant or withhold alimony according to the actual need and ability to pay of the parties and ensure a fair and just determination and settlement of their property rights, 23 Pa,C,S,A, S 3l02(a) (4) and (6). In addition to its powers to equitably divide, distribute or assign marital property, the court may direct the continued maintenance of beneficiary designations of policies insuring the health of either party which originally were purchased during the marriage and owned by or within the effective control of either party. Id, S 3502(d), Moreover, the divorce court also has the authority "to direct that adequate health and hospitalization insurance coverage be maintained for the dependent spouse pendente lite," Id, S 3702. In the instant case, the evidence will establish that Husband completed a form in November, 1994 to remove the dependent health care coverage which he previously had maintained on his wife 2 Lorenda and the parties' then eleven month-old daughter Desire6, The evidence also will establish that: a. because Husband works for an employer who has less than twenty employees, Wife was unable to take advantage of any COBRA benefits at the time Husband unilaterally terminated her health care coverage and that of the child, b, wife could not afford to purchase private health care insurance because she was not employed at the time the parties separated, having been the primary caretaker for Desiree, c, after Husband's unilateral termination of her medical coverage, Wife became seriously ill and was hospitalized with a blocked kidney, for which she continues to receive treatment and ongoing medical care. d, between December 1994 and April 1995, wife incurred $4,959,51 in medical bills which otherwise would have been covered by medical insurance. e, to minimize the risk of no health insurance, Wife applied for medical assistance for herself and Desiree, f, Although most of Desire6' s medical needs between December 1994 and April 1995 were paid by medical assistance, most of Wife's claims were not, as evidenced by the medical bills which she has incurred and which are unpaid as of today's date. consistent with the court's legiSlative mandate to effectuate economic justice betwean the parties, the divorce court is a court 3 of equity, See Barrington v. Berrington, 534 Pa. 393, 633 A,2d 589 (1993) (divorce code has given courts responsibility for achieving equitable results). In the instant case, Husband's unilateral termination of medical coverage for Wife and child, which was occasioned by nothing other than the parties' separation, has worked an injustice to Wife. Husband has mitigated his damages only because the support court ordered him to reinstate medical coverage for Wife and child incident to the support complaint which Wife filed. The support court did not address, however, t~~ issue of the medical bills which remain unpaid and which Wife incurred only as a result of Husband's termination of her medical coverage, Thsrefore, Wife's only remedy for the $4,959.51 in outstanding medical bills and expenses is the court's power to fashion an equitable resolution to this matter, D, Conclusion: For all of the foregoing reasons, Defendant requests the court to grant her special relief in the nature of an order directing Plaintiff to pay those medical expenses which Wife incurred between December 1994 and April 30, 1995. We did prepare a letter for Edward to give to Lorenda in November of 1994, although I do not have a copy of that letter. 4.
