MEMORANDUM OPINION AND ORDER OF COURT Petitioner asks the court to issue an order stating that it has title to three (3) vehicles left in its custody for several years, and also directing the Departments of Transportation of several states to transfer title of the vehicles to petitioner. There has been no attempt to sell the vehicles to recover unpaid storage costs. There is no authority in the Vehicle Code that allows this court to order a Department of Transportation to transfer title to the three vehicles to petitioner. If petitioner acquires the vehicles based on a judgment for unpaid storage fees, the court will issue an order stating that petitioner is then the owner of any vehicle so acquired. We were not able to locate the Vehicle Code provision referred to in the petition. rORDER AND NOW, this ~ day of MARCH, 1995, because this court is without authority to issue the requested order, petitioner'S request is REFUSED. PERKINS, EILEEN HEBERLIG, and APPLIED PACKAGING TECHNOLOGY, Defendants PETITIO. 1. plaintiff, Robert Baish Auto Body ShOp, also known as Bob Baish Glass , Body ShOp is an automobile repair business with its offices located at 1249 Mt. Holly Pike, Carlisle, Cumberland County, Pennsylvania 17013. 2. Defendants, J. Bradford Perkins and Mary F. Perkins, are adult individuals with a last known address at 53 Stephen Matter Road, Darien, Connecticut 06821. 3. Defendant, Eileen Heberlig, is an adult individual with a last known address at 149 East Louther Street, Carlisle, Pennsylvania 17013. 4. Defendant, Applied Packaging Technology, is an entity with a last known address at P.O. Box 2480, Rock Hill, South Carolina 29731. 5. Jurisdiction in Cumberland county is proper in this matter because the property at issue is located upon the business premises of Plaintiff in Cumberland County. 3 COUNT I ROBIRT BAZSH AUTO BODY SHOP, a/h/a BOB BAISH GLASS, BODY SHOP v. J. BRADrORD PIRIINS and MARY r. PIRIINI 6. A 1983 Ford Thunderbird, VIN *lFAB4635DA159633, license number 588 FKB (conn.) is registered to Defendants, J. Bradford Perkins and Mary F. Perkins, 7. On or about February 13, 1992, the above-referenced 1983 Thunderbird was towed to Plaintiff's auto body shop by a third party, 8. Plaintiff made repeated attempts over approximately three years to have Defendant, J. Bradford Perkins or Mary F. perkins contact plaintiff relative to the repair and possession of the aforesaid vehicle. 9. On or about May 24, 1994, Plaintiff mailed notices to Defendants requesting that they remove the above-referenced 1983 Thunderbird and pay for the cost of storing the vehicle. (copies of notices are attached as Exhibit "A" and incorporated herein by reference) . 10. Defendants have neither paid the storage costs in full nor have they removed the above-referenced 1983 Thunderbird from Plaintiff's premises. 11. On or about November 1, 1994, Plaintiff notified the pennsylvania state Police Department that he deemed Defendants' above-referenced 1983 Thunderbird to be abandoned. (A true and correct copy of the notice mailed to the Pennsylvania state Police is attached as Exhibit "B" and incorporated by reference.) 4 12. The above-referenced 19B3 Thunderbird has not been removed from Plaintiff's business premises and Plaintiff has had no response of any nature from Defendants for more than two and one-half years. WHEREFORE, plaintiff, Robert Baish Auto Body Shop, a/k/a/ Bob Baish Glass & Body Shop, requests that judgment be entered in its favor against Defendants, J. Bradford perkins and Mary F. Perkins, and that the Court issue an order pursuant to 75 P.S. Sec. 7315, directing the Departments of Transportation of pennsylvania and connecticut to transfer title from Defendants to Plaintiff of the 19B3 Ford Thunderbird, VIN H1FAB4635DA159633. COUN'f II ROBERT BAISH BODY SHOP a/k/a BOB BAISH GLASS , BODY SHOP v. EILBBN HBBERLIG J.3. A 19B6 Buick somerset, VIN H1E4NJ27UOGN204738 is registered to Eileen Heberlig. 14. On or about October 31, 1991, the above-reference 1986 Somerset was delivered to Plaintiff's auto body shop for repairs by a third party. 15. plaintiff made repeated attempts over approximately three years to have Defendant, Eileen Heberling, contact Plaintiff relative to the repair and possession of the aforesaid vehicle. 16. On or about May 24, 1994, Plaintiff mailed to Defendant, Eileen Heberlig, a notice advising her that storage costs were accumulating, (A true and correct copy of notice is 5 attached hereto as Exhibit "C" and incorporated herein by reference. ) 17. Defendant, Eileen Heberlig, has neither paid the storage costs in full nor effectuated the removal of the above- referenced 1986 Somerset from Plaintiff's premises. 18. On or about November 1, 1994, Plaintiff notified the Pennsylvania State police Department that he deemed Defendant's vehicle to be abandoned. 19, The above-referenced 1986 Somerset has not been removed from Plaintiff's business premises and Plaintiffs had no response of any nature from Defendants for more than three years. WHEREFORE, Plaintiff, Robert Baish Body ShOp, alkla Bob Baish Glass & Body Shop, requests that judgment be entered in its favor against Defendant, Eileen Heberlig, and that the Court issue an order pursuant to 75 P.S. Section 7315, directing the Pennsylvania Department of Transportation to transfer title from Defendant to plaintiff of the 1986 Buick somerset, VIN H1E4NJ27UOGN204738. COUNT III ROBERT BAISH AUTO BODY SHOP a/k/a BOB BAISR GLASS , BODY SHOP v. APPLIED PACKAGING TECHNOLOGY 20, A 1988 Ford Thunderbird, VIN HlFABP61F9J1212205, license #JMC 142 (S. carolina) is registered to Applied paCkaging Technology. 6 21. On or about March 24, 1993 the above-referenced 1988 Thunderbird was delivered to Plaintiff's auto body shop for repairs by a third party. 22. Plaintiff has made repeated attempts to have Defendant, Applied Packaging Technology contact Plaintiff relative to the repair and possession of the aforesaid vehicle. 23. Defendant has filed Chapter 7 bankruptcy proceedings. 24. Plaintiff is an unsecured creditor of Defendant in Case No. 93-71595, united states Bankruptcy Court, District of South Carolina. <A true and correct copy of Amended Schedule F is attached as Exhibit "D" and incorporated herein by reference). 25. Neither Defendant, nor its trustees, have removed the above-mentioned vehicle from Plaintiff's business premises. 26. On or about November 1, 1994, Plaintiff notified the Pennsylvania state Police Department that he deemed the above- referenced 1988 Thunderbird to be abandoned. 27. The vehicle remains upon Plaintiff's premises.
