COMPLAINT
AND NOW comes Plaintiff Deborah Weaver, Executrix of the
Estate of John Weaver, by and through her attorney, Herschel Lock,
and files her Complaint as follows, to wit:
1. Plaintiff Deborah Weaver, Executrix of the Estate of
John Weaver, is an adult individual whose principal place of
business is 1710 Market Street, PO Box 153, Camp Hill, Cumberland
County, Pennsylvania 17011.
2. Defendant Connie Sardino is an adult individual residing
at 1710 Market Street, Apt. B-26 Camp Hill, Cumberland County,
Pennsylvania 17011.
3. Plaintiff as landlord and Defendant as tenant entered
into a written lease agreement dated May 1, 1993, under which
terms and conditions Plaintiff rented to Defendant the premises
known and numbered as 1710 Market Street, Apt. B-26 Camp Hill,
Cumberland County, Pennsylvania and Defendant agreed to pay rent
therefore in the amount of $336.00 per month, due and payable on
or before the first day of each month, and to perform certain
duties and obligations and abide by all other terms conditions
therein set forth. A true and correct copy of said lease is
attached hereto labeled Exhibit "A and made a part hereof.
"
4. Defendant, without cause, has failed to make the rental
payments due for the months of December, 1994 and January and
February, 1995 presently each in the amount of $350.00 as well a.
failed to allow Plaintiff entrance to inspect the subject premiss
or to allow repairmen into it as needed without permission and
changed the locks to the subject premises, all in violation of the
subject lease.
5. Under the terms of the aforesaid lease, a default occurs
upon the failure to pay any installments of rent when due or upon
failure to abide by all terms and conditions of said lease.
6. Despite demand by plaintiff, Defendant has refused to
pay rent due under said lease, to allow Plaintiffs or her Agent or
employees entrance to the subject premises or to reinstall the
original locks thereto, all despite repeated requests and demands
that she do so.
, WHEREFORE Plaintiff respectfully requests judgment for
eviction against Defendant Connie Sardina for the premises known
as 1710 Market Street, Apt. B-26 Camp Hill, cumberland County,
Pennsylvania along with a judgment for rent in the amount of
$1,050.00 as well for any monies due for the period thereafter,
until possession is returned to Plaintiff, at the rate of $350.00
per month, as well as other feee and costs as may be incurred

make rental payments for the months of December 1994 and January
1995, she avers that she and her former landlord, the now-
deceased John Weaver, agreed that she could forego these payments
(as well as the February 1995 rent, which she paid anyway) as
compensation for Mr. Weaver improperly disrosing of certain items
of her personal property, See Count III of Defendant's New
Matter, Defendant denies that she failed to allow Plaintiff to
inspect the premises or to allow repairmen into it as needed
without permission, or that she has violated the lease. She
admits that she changed the locks after John Weaver unlawfully
and without her consent entered her apartment at night on several
occasions, and watched her as she slept, See Count IV of
Defendant's New Matter, However, she denies that Changing the
locks under these circumstances constitutes a violation of the
lease,

Defendant denies that she is in default under the terms of the
parties' lease.

10, Because Plaintiff failed to comply with the notice
requirements set forth under 68 P.S, ~250,501 before commencing
eviction proceedings against Defendant, this Court lacks
Jurisdiction over the subject matter of this action.

11, In or about May 1994, Defendant's landlord, the now-
deceased John Weaver, wrongfully disposed of numerous arts and
crafts supplies, a persian rug and two wicker chairs belonging to
Defendant, which she was keeping in a storage area at Plaintiff's
apartment complex,
12, SUbsequently, as compensation for Defendant's losses
arising from this incident, the said John Weaver waived his right
to collect, and agreed that Defendant did not have to pay, rent
for a perlod of three months,

13. On three occasions from January 1994 through June 1994,
Defendant awoke at night and observed her landlord, the now-
deceased John Weaver, standing near her bed and starin9 at her,
14, The said John Weaver did not have any right or
authority whatsoever to enter Defendant's apartment on those
Uccasions, and did not have Defendant's permission to do so,
15, By entering Defendant's apartment on these occasions,
John Weaver violated Defendant's privacy, frightened her, caused
her stress and anxiety, interfered with her right to exclusive
possession of the apartment, and necessitated that she purchase
and i nsta 11 a new lock, in breach of the imp 1 i ed covenant of

16. In Paragraph 4 of the parties' lease, Plaintiff agreed
to repair "with due diligence" defects in the rental premises,
after being given notice of such defects by Defendant, See
Plaintiff's Exhibit "A", which is incorporated herein by
reference.
17, Despite being advised repeatedly that the rental
premises had broken bedroom windows, a severe mildew problem in
the bathroom and a dripping faucet, Plaintiff took no action to
correct these defects,
18, As a consequence of Plaintlff's failure to repair these
defects, Defendant's use and enjoyment of the nmtnl premis8fl, as
well as its habjtnbl 1 ity, WHO and continues to be sorlously
reducod.
19, By failIng to repair these defocts, Plaintiff has
committed a materIal broach of the parties' lease,

AND NOW comes Plaintiff Deborah Weaver, Executrix of the
Estate of John Weaver, by and through her attorney, Herschel Lock,
and files her Motion as follows, to wit:
1. Plaintiff Deborah Weaver, Executrix of the Estate of
John Weaver, is an adult individual whose principal place of
business is 1710 Market Street, PO Box 153, Camp Hill, cumberland
County, Pennsylvania 17011.
2. Defendant Connie Sardino is an adult individual formerly
residing at 1710 Market Street, Apt. B-26, Camp Hill, Cumberland
County, Pennsylvania 17011.
3. At all times relevant hereto, Plaintiff rented the
aforementioned apartment to Defendant in return for her payment of
monthly rent therefore.
4. Due to late payment and non-payment of rent, as well as
other violations of her lease, Plaintiff initiated an eviction
action against Defendant which, after a judgment being rendered in
favor of Plaintiff, Defendant appealed to the above term and
number.
5. As part of Defendant's appeal, she was allowed to place
her rent in escrow with the Office of the cumberland County

AND NOW comes Petitioner, Plaintiff Deborah Weaver, Executrix
of the Estate of John Weaver, by and through her attorney,
Herschel Lock, and files her Motion to Make Rule Absolute as
follows, to wit:
1. Petitioner, Plaintiff Deborah Weaver, is Executrix of
the Estate of John Weaver and as such represents an Estate whose
decedent rented an apartment to Respondent who agreed to pay rent
therefor.
2. Respondent failed to pay her rent with the result that
Petitioner initiated an ejectment action against her and was
awarded possession of said premises.
3. Respondent timely filed an appeal herein and, as part
thereof, an Order was entered which acted as a Supersedeas
directing that she escrow her rent with the Prothonotary's Office.
Respondent did this for a period of time, stopped doing so and
voluntarily vacated the subject premises, although not leaving her
forwarding address with Petitioner.
4. In this proceeding heretofore, Defendant waR represented
by an attorney, Philip Briganti, of Legal Services.
