1. The Plaintiff Is Kenneth S. Thompson, who curfently resides at 9 North 29th Street, Camp
Hill, Pennsylvania, since on or about February 20, 1995.
2. The Defendant Is Donna M. Thompson, who resides at 4341 Carlisle Pike, Apt. 8.5,
Camp Hili, Pennsylvania, where she has resided fOf a period In excess of six months prior to the
filing of this Complaint.
3. The Plaintiff and Defendant both have been bona fide fesldents In the Commonwealth
of Pennsylvania fOf at least six months immediately priof to the filing of this Complaint.
4. The Plaintiff and Defendant were married on July 21, 1991, at New Jersey.
5. That there have been no prior actions of divorce or fOf annulment between the parties
in this or In any othef Jurisdiction.
6. The Plaintiff avers that he is entitled to a divorce on the ground that the mafrlage Is
irretrievably broken and Plaintiff Is proceeding undef Sections 3301 Cc) and/or Cd) of the Divorce
Code.

1. A Complaint in divorce under Section 3301(0) of the
Divorce Code was filed on

them before a divorce is granted.
6. I understand that I will not be divorced until a divorc
decree is entered by the Court and that a copy of the decree wil
be sent to me immediately after it is filed with the
prothonotary.
7. I have been ,advised of the availability of marriage
counselling and understand that I may request that the court
require counselling. I do not request that the court require
counselling.

Oear Ms. Lindsay and Ms. Thompson:
By order of Court of President Judge Harold E. Sheely
dated April 17, 1997, the full-time Master has been appointed in
the above referenced divorce proceedings.
A divorce complaint was filed on April 4, 1995, raising
grounds for divorce of irretrievable breakdown of the marriage.
No economic claims were raised in the complaint.
On April 25, 1995, the Oefendant filed an answer and
counterclaim. In the counterclaim the Defendant raised the
additional grounds for divorce of indignities and the economic
claims of alimony and counsel fees and expenses. The economic
issue of equitable distribution has not been raised in the
action.
I am going to proceed on the basis that grounds for
divorce are not an issue. I am directing counsel for the
Plaintiff and Ms. Thompson, who apparently is not represented by
counsel, to each file a pre-trial statement in accordance with
P.R.C.P. 1920.33(b) on or before Monday, May 19, 1997. Upon
receipt of the pre-trial statements I will immediately schedule
a pre-hearing conference with counsel for the Plaintiff and Ms.

3. DataTech Software Inc. Retirement Plan - On February 10, 1995, Plaintiff enjoyed
a vested amount of $3,361.26 in the Datatech Software Retirement Plan. A copy of the statement
Is attached hereto as Exhibit "B".
4. Personal Prooertv. Attached as Exhibit "C" is a list of personal property taken
from the marital home at the time of separation by the Plaintiff. The list is exhaustive. Attached as
Exhibit "0" Is a list of per~onal property which remained at the marital home with Defendant. Plaintiff
believes and therefor avers that the vast majority of the personalty remained with Defendant. If this
case cannot be settled prior to a hearing, Plaintiff reserves the right to obtain an appraisal on all
personalty. In the event that a hearing Is necessary, Plaintiff wishes to have returned to him those
items set out on Exhibit "0".
II. Non-Marital:
1. Defendant asserts an ownership of a 1985 Ford Fairmont at the time of
separation. The vehicle referenced was a 1982 Ford purchased by Defendant for $1,000.00 on May
9, 1989. A copy of the vehicle sales and use tax return indicating the purchase price of $1,000.00
prior to marriage is attached hereto as Exhibit "E". The vehicle was sold when it had 128,100 miles
on it for $400.00. Plaintiff asserts that the vehicle was a non. marital asset which did not Increase In
value during the term of the marriage.

II. LIABILITIES
None of which Plaintiff is aware, or has not paid on behalf of the parties.
III. PROPOSED RESOLUTION
Plaintiff proposes that each party retains the property currently in his or her possession. In
the event that appraisals are required and a hearing Is necessary on equitable distribution, Plaintiff
seeks those items set out on Exhibit "E".
With regard to alimony, if the equitable distribution issues and divorce issue can be resolved
without a hearing, Plaintiff would pay $76.00 per month for the support of Defendant for a period of
24 months from the date of entry of the Decree in Divorce.

A 1985 Ford Fairmont the parties paid $2,000,00 for, which
was sold by Husband and which he either kept proceeds for, or
traded it in for a new vehicle that he is driving.
3. Personal Property
It is believed that most items of personal property have
been exchanged by the parties; however, Wife wishes to receive
back the following items of personal property:
(a) 12 cups and saucers that were given to the parties by
Husband's Mother, who is prepared to teBtify that she gave
them to Wife;
(b) 3 or 4 longeberger basketB;
(C) Her son's dresser; and
(d) Speakers that belonged to Wife prior to the marriage.
III. PROPOSEO RESOLUTION
A. Equitable Distribution - It is proposed that the
parties share equally in the equitable distribution of the
property, which will likely require Husband to reimburse Wife
between $3,000.00 and $4,000.00 for amounts of marital funds that
he took at the time of separation.
B. Husband and Wife can keep all personal property
currently in each parties' possession, except Husband will return
to Wife the items as listed above; and
c. Alimony - Because of the large disparity between the
incomes of the parties, it is proposed that Husband pay to Wife
the sum of $186.00 per month for a period of twenty-four months,
which coincides with the current order for spousal support, and
will assist Wife in going through nursing school.

THE MASTER: Today is Friday, september 12, 1997.
This is the date set for a pre-hearing conference with counsel
in the above captioned divorce case. However, after counsel
appeared and we began discussions on the issues in this case,
counsel indicated that they would like to attempt to resolve the
issues, which they have done, having spoken to their respective
clients. Consequently, we are not going to do our usual
pre-hearing conference memorandum but instead are going to place
an agreement on the record.
As indicated, both counsel are present; however,
although the parties are not in the hearing room, we have
arranged for a conference call and they are both able to hear my
remarks and counsels' remarks through the telephonic
transmission.
We are going to put an agreement on the record and
the agreement as stated on the record will be the substantive
agreement of the parties. It will not be subject to any changes
or modifications after it has been stated on the record, and we
will not require the signatures of the parties by way of
affirmation of the terms of the agreement. The agreement will
,
be transcribed and sent to the Court, at which time the Court
will be asked to enter an order vacating the Master's
appointment. The agreement will be part of the file and will be
subject to enforcement as if it were an order of court.
Although husband initially proceeded to conclude
the divorce under Section 3301(d) of the Domestic Relations
Code, counsel have advised that the parties will now sign
affidavits of consent and waivers of notice of intention to
request entry of divorce decree so that the divorce can be
concluded under section 3301(C) of the code, the mutual consent
provision.
The Master also noted that an order was entered on
May 9, 1995, requiring the parties to engage in counseling
sessions. No report as required by the Rules of civil Procedure
has been filed by the counselor; however, counsel have indicated
that they are going to have the parties sign a waiver of the
requirement that a report of the counselor be filed and be made
part of the record. Ms. Deily.
MR. DEILY:
1. The parties agree that husband will pay the sum of
$186.00 per month, for the benefit of the wife, as
alimony, for a period of 24 months. The payment of
this alimony shall commence on october 1, 1997, and will
continue for a 24 month period. This alimony will be
nonmodifiable, but shall cease in the event of the death,
remarriage, or cohabitation, by wife within the 24 month
period.
2. The parties will retain all items of personal property
currently in the possession of each party; however,
husband will return to wife the following items of
personalty:
a) 12 cups and saucer set;
b) the Longaberger baskets;
c) the dresser belonging to the parties' son;
d) and the speakers that belonged to wife prior to the
marriage.
3. Wife will waive any interest she may have in the
retirement plan of husband, in the Data Tech Software
retirement plan.
4. Any vehicles currently in the possession of each party
shall remain the property of said party.
5. On the date of this agreement, September 12, 1997, the
parties will execute affidavits of consent and waivers of
notice as well as a waiver of notice of the filing of the
report of the marriage counselor. In the event that a
party fails to execute such a consent or any waivers,
this case shall proceed under section 3301(d) of the
Divorce Code without further involvement of the Master
and the Master may hereby vacate his appointment.
6. The parties do hereby waive counsel fees, costs, and
expenses, and each party will be responsible for paying
their own counsel fees, costs, and expenses.
7. Each party will be responsible for any debt that they
have incurred since separation.
8. Except as herein otherwise provided, each party may
dispose of his or her property in any way and each party
hereby waives and relinquishes any and all rights he or
she may now have or hereafter acquire under the present
or future laws of any jurisdiction to share in the
property or the estate of the other as a result of the
marital relationship including without limitation,
statutory allowance, widow's allowance, right of
intestacy, right to take against the will of the other,
and right to act as administrator or executor in the
other's estate. Each will at the request of the other
execute, acknowledge, and deliver any and all instruments
which may be necessary or advisable to carry into effect
,
this mutual waiver and relinquishment of all such
interests, rights, and claims.
MS. LINDSAY: Ken, did you understand that? That
was a general release of all claims that you all had, one
against the other. Is that acceptable to you?
MR. THOMPSON: Yes.
MS. DEILY: Donna, did you understand that; that
is, a waiver of any intestacy or any statutory rights that you
have just because you were the wife of Ken, and that you will
give up those rights at the time this agreement goes into
effect?
MS. THOMPSON: Yes.
MS. LINDSAY: Ken, did you understand all of that,
and that's the entire agreement; is that acceptable to you?
MR. THOMPSON: Yes, it is.
MS. DEILY: Donna, did you understand everything?
MS. THOMPSON: Yes.
MS. DEILY: Was that acceptable to you?
MS. THOMPSON: Yes.
MS. DEILY: And you will stop in and sign an
affidavit of consent today in our Camp Hill office?
MS. THOMPSON: Yes.
THE MASTER: Mr. and Mrs. Thompson, you understand
that the agreement now that has been placed on the record, in
your hearing, in the presence of your counsel, is not subject to
