Dougherty, husband and wife. with a current address of 345 Kerrsville Road, West Pennsboro Township. Carlisle. Cumberland County, Pennsylvania 17013. 2. The Defendant, the Township of West Pennsboro. is a political subdivision of the County of Cumberland and Commonwealth of Pennsylvania. with a current address of 2150 Newville Road. Carlisle. Pennsylvania 17013-8957. 3. The Plaintiffs are the owners of certain real estate located at 345 Kerrsville Road, West Pennsboro Township. 4. The Plaintiffs purchased their property on February 13. 1989. A copy of the Deed to the Plaintiffs is attached hereto and made a part hereof as Exhibit "A". (e) Adversely affecting the use and function of the Plaintiffs well and septic system. 13. While the culvert may alleviate water problems presently experienced by the neighbors on the western side of Kerrsville Road, the practical effect will be to simply transfer the same water problems to the property of the Plaintiffs. 14. The Defendant's actions in installing the culvert. with the resultant increase in flow and volume of water onto the Plaintiffs' property. constitutes a continuing trespass and an unlawful taking of the Plaintiffs' property without just compensation. 15. The installation of the culvert, with the resulting increase in water flow and volume, will damage the property of the Plaintiffs as aforesaid. 16. Said damages will be continuing. indefinite, and are impossible of being quantified at the present time. 17. The Plaintiffs have no other adequate remedy at law. WHEREFORE. the Plaintiffs request this Honorable Court: (a) To issue an injunction restraining and enjoining the Defendant, its agents. servants and employees. from installing or otherwise constructing a culvert and drain pipe underneath Kerrsville . i " Road, directing water flow through the pipe from the western side of Kerrsville Road to the eastern side of Kerrsville Road; and (b) Such other general relief as the Court may deed just and proper.
