2. Defendant, Dino Ross, is a private individual residing at 220 Vineyard Road, Harrisburg,
Dauphin County, Pennsylvania 17104.
3. Plaintiff is a company which provides an array of security products and services to area
businesses and private individU8\s.
4. By oral agreement between Plaintiff and Defendant, Plaintiff installed a home alarm
system on or about May 8, 1991.
5. Subsequent to the insta11ation of the a1ann system, Plaintiff and Defendant orally agreed
that Plaintiff would do certain repairs and maintenance on the system and provide a monitoring service
of the system.
6. On or about February 1, 1992, Plaintiff drafted and mailed Invoice No. 6818 to Defendant
which notified Defendant that $120.00 was due for burglar a1ann system monitoring from March 1, 1992
to February 28. 1993. A copy of the original invoice Is attached hereto and incorporated herein 88 Exhibit
"A."
7. On December 3. 1992, by check no. 451, the Defendant paid $89.14 on lI8id invoice leaving
a balance of $30.86.
8. On February 8. 1993. Plaintiff drafted and mailed invoice no. 7770 to Defendant which
notified Defendant that the sum of $280.50 was due and owing for a service call to repair lightning
damaged a1ann system and two circuit boarda. A copy of the original invoice ia attached hereto and
incorporated herein as Exhibit '13.'
9. Since February 8, 1993, Defendant has made no payment on invoice no. 7770.
10. On or about May 5, 1993, Plalntl1T drafted and mailed invoice no. 8069 which notified
Defendant that the amount of $35.00 W88 due and owing. The $35.00 amount encompa88ed a service call
which W88 to check an aJarm trip; clear spiders from motion detectors, and telt all detectors and door
window detectors.
11. Since May 5, 1993, Defendant has not paid any money on invoice no. 8069.
12. On January 25, 1994, Plaintl1T drafted and mailed invoice no. 8778 to Defendant, which
notified Defendant that a balance of $125.40 W88 due and owing to the Plalntl1T for burglar aJarm system
monitoring service at Defendant's home during the period of March I, 1994 to February 28, 1995.
Defendant has failed to timely pay this balance.
13. Plalntl1T continued to monitor Defendant's burglar aJarm system IUItll February 21, 1995.
14. Plalntl1T has performed all the above services In a timely and professional manner.
15. Defendant did not complain or object to the quality of performance or of any of the above
services provided by the Plalntl1T. In the alternative, Defendant accepted all of the work performed.
16. Plalntl1T requested payment from Defendant for the services rendered on numerous
occasions, however Defendant breached all contracts by refusing to pay invoice balances In a timely
manner.
17. The Plalntl1T has Incurred substantla1lega1 fees In an attempt to collect these past due
amounts.
18. The amount In controversy is less than $20,000.00 which requires mandatory referral to
arbitration.

Preliminary Objections to Plaintiff Full Service Security, Inc.'s
Complaint:
I. PRELIMINARY OBJECTION IN THE NATURE OF MOTION TO STRIKE FOR
FAILURE OF PLEADING TO CONFORM TO LAW OR RULE OF COURT
1. Plaintiff requests recovery of its attorneys' fees
from Defendant.
2. The well settled law of this Commonwealth is that
there can no recovery of attorneys' fees from an adverse party to
a cause in the absence of express statutory authorization or clear
agreement by the parties.
3. There is no express statutory authorization nor
clear agreement of the parties which would allow Plaintiff to
recover its attorneys' fees.
4. Plaintiff has not pled facts sufficient for its
recovery of attorneys' fees nor is Plaintiff entitled to the
recovery of attorneys' fees in the above-referenced action.

I, Dino A. Ross, hereby state that I am authorized to
make this verification on behalf of Defendant, and that the
statements made in the foregoing document are true and correct to
the best of my knowledge, information and belief. I understand
that the statements herein are made subject to the penalties of 18
