Dear Judge Hess:
This is to provide you with the relevant case law regarding
the issue of when a defendant files a pro se timely appeal with the
Clerk of Courts, however, innocently neglects to file an ancillary
appeal with the Prothonotary's Office regarding the civil
revocation of the Defendant's operating privileges, Subsequently,
the defendant through counsel filed an appeal Nunc Pro Tunc
requesting leave to appeal the civil revocation.
Pennsylvania law requires that an appeal be filed within 30
days after entry of the order from which the appeal is taken, That
applies to appeals from summary convictions, The only exceptions
are circumstances such as ineffectiveness of counsel, fraud or
breakdown in the Court's operations. Commonwealth v. Jarema, 404
Pa. Super, 121, 590 A.2d 310 (1991). Unfortunately there is a
plethora of caselaw generally denying an Appeal Nunc Pro Tunc when
there is an absence of a breakdown in the Court's operations, fraud
or counsel effectiveness, However, the facts in Petitioner's case
are distinguishable from this line of caselaw, thereby, allowing
this Court to grant the Appeal Nunc Pro Tunc.
The uncontradicted facts established at the hearing indicated
that the Petitioner was found guilty at a District Justice level
trial for Driving Under a Suspended License, 75 Pa. C,S,A. 1542(a).
Petitioner's father was advised he had 10 days to appeal the
conviction to the Cumberland County Court of Common Pleas. On
January 25, 1995, Petitioner received a license suspension notice
from Penn Dot notifying Petitioner he had 30 days to appeal the
license suspension. Thereafter, Petitioner's father contacted
counsel who advised Petitioner's father the appeal period was 30
days from the date of conviction of the underlying summary
conviction, On February 1, 1995, 26 days following the underlying
summary conviction and six days following receipt of Penn Dot's
notice, Petitioner filed a timely appeal with the Clerk of Court,
Cumberland County, believing that notice of appeal would stay the
license suspension. On February 10, 1995, Petitioner retained
counsel of record. This appeal follows,

In PennDot v. Beale, 18 D & C 4th 357 (1993), The Honorable
Robert C. Wright of Delaware County addressed the converse issue
before this Court, Judge wright granted the Appeal Nunc Pro Tunc
where the Defendant filed a timely appeal from a notice received
from PennDot, however, did not file a timely appeal of the
underlying conviction. At the hearing, Beale testified on December
2, 1991, a police officer stopped Beale for passing a school bus
and issued a citation. Beale subsequently checked the not guilty
plea and returned the citation with the full amount of the fine,
Thereafter, Beale received a notice from the Department of
Transportation, dated June 2, 1992, informing him that his license
was suspended due to a conviction on February 10, 1992. Pursuant
to the instructions in that notice, Beale filed an appeal on July
1, 1992, in Philadelphia Court of Common Pleas, the county of his
residence. The parties conceded Beale did not have notice of the
hearing or notice of the convictions until receiving notice of his
suspension.
In Beale, as in the case before this Court, there was a
breakdown in the Court's operations. In Beale, the defendant was
never notified of his summary hearing or conviction until receiving
the suspension notice. In the at bar, the Petitioner apparently
was misinformed at the conclusion of his summary appeal as to his
appeal rights, It was only after Petitioner received a notice of
suspension from PennDot did the Petitioner perfect his appeal,
albeit, only to one of the two proper court offices in this
jurisdiction.
Petitioner promptly followed the appeal instructions when
advised of the 30 day appeal period, Furtherm~e, as soon as
Petitioner discovered his license was under suspension due to the
mistaken belief one appeal to the Court of Common Pleas would act
as a stay to the civil suspension did he promptly assert his
request for relief.
In Commonwealth v, Korn, 467 A.2d 1203, 78 Pa Commonwealth 474
(1983), addresses an issue of defective appeal. In K2m the
petitioner filed a pro se appeal with the Court of Common Pleas of
Allegheny County, The case was docketed and set for trial. In
sustaining the appeal the Court, quoting Sherman v. Yoder 59 Pa.
Commonwealth Ct. 430 A2d 347 (1981) defined judicial discretion as:
"the Op:l.n10n which a judge may
exercise either to d~~r not to do
that which is proposed of him. As a
guide to judicial action, it means a
sound discretion exercised with due
regard for what is right and
equitable under the circumstances

and under the law. Abuse of
discretion is not merely an error of
judgment; however, if, in reaching a
conclusion, the law is overridden or
misapplied, or the judgment
exercised is manifestly unreasonable
or the result of partiality,
prejudice, bias, or ill will, as
shown by the evidence of record,
discretion is abused. II Sherman v,
Yoder. id.
It is apparent that the Defendant in K2m filed a -timely
appeal from the summary conviction underlying the revocation in a
criminal mater in which the Department would not be involved. The
~ decision, although not directly on point supports the
proposition that this Court has judicial discretion in affirming
the Appeal Nunc Pro Tunc when the petitioner file~ a timely appeal
from the Summary Conviction and justifiably relies on that appeal
to stay the ancillary civil licen~e ~uspen$io~.

DRIVERS'S LICENSE APPEAL
PETITION TO APPEAL NUNC PRO TUNC
AND NOW, comes the Petitioner, Chad W. Flasher, by and through
his attorney Austin F. Grogan, Esq. and aver the following in
support of this Petition:
1. Petitioner was found guilty of Driving While Operating
Privilege is Suspended or Revoked.
January 5, 1995.
2. Petitioner filed an pro se appeal with the Court of
75 Pa.C.S.A. 1543 (a) on
Common Pleas on February 1, 1995. (See attached appeal and
receipt).
3. Petitioner received civil notice of license suspension
dated January 25, 1995. (See attached).
4. Petitioner believed that filing a appeal of the
underlying conviction would act as a stay to the civil revocation.
5. Petitioner neglected to file an appeal with the
Prothonotary's Office for Cumberland County.
6. On or about February 10, 1995, Petitioner retained
Counsel to represent Petitioner in the underlying traffic
conviction.
7. Petitioner and Counsel did not address the civil
revocation until Petitioner was stopped while driving his car.
WHEREFORE, Petitioner respectfully request this Honorable

AND NOW, comes the Petitioner, Chad W. Flasher, by and through
his attorney Austin F. Grogan, Esq. and aver the following in
support of this Petition:
1. Petitioner was found guilty of Driving While Operating
75 Pa.C.S.A. 1543 (a) on
privilege is Suspended or Revoked.
January 5, 1995.
2. Petitioner filed an pro se appeal with the Court of
Common Pleas on February 1, 1995. (See attached appeal and
receipt).
3. petitioner received civil notice of license suspension
dated January 25, 1995. (See attached).
4. Petitioner believed that filing a appeal of the
underlying conviction would act as a stay to the civil revocation.
5. Petitioner neglected to file an appeal with the
prothonotary's Office for Cumberland County.
6. On or about February 10, 1995, Petitioner retained
Counsel to represent Petitioner in the underlying traffic
conviction.
7. Petitioner and Counsel did not address the civil
