SIMOKAT, Defendant No. 95-1777 Civil Term COMPLAINT AND NOW, comes the plaintiff, Members United Federal Credit Union, by and through its counsel Keefer, Wood, Allen & Rahal, and files this complaint averring as follows: I. Parties 1. Plaintiff, Members United Federal Credit Union ("Members United") is a business entity registered and licensed to do business in the Commonwealth of Pennsylvania, having a business address of 25 West Main Street, Shiremanstown, Cumberland County, Pennsylvania 17011. 2. Allen W. Simokat, defendant ("simokat"), is an adult individual residing at 30 Miller street, Apartment c-a, Lemoyne, Cumberland County, Pennsylvania 17043. II. Factual Backqround 3. On or about August 25, 1992, Simokat applied to Members United for a loan in the amount of $1,000 to payoff the balance he owed on a truck ($330.00) and to use the remainder ($670) for his wedding. A true and correct copy of the loan application is attached hereto as Exhibit "A" and incorporated herein by reference. 4. The loan applied for by simokat in the amount of $1,000 was approved by Members United and the funds disbursed. Payments were made on the loan until on or about November 14, 1994, at which time the outstanding balance was $87.21. 5. As of February 24, 1995, interest in the amount of $2.24 had accrued on the balance, leaving a total amount due of $89.45. True and correct copies of the loan account balances are attached hereto as Exhibit "B" and incorporated herein by reference. 6. Since November, 1994, no payments have been made by Simokat on the outstanding loan balance, despite repeated demands. 7. On or about October 1, 1992, Simokat applied for a Visa credit card with Members United. A true and correct copy of his application is attached hereto as Exhibit "e" and incorporated herein by reference. 8. Simokat used the Visa credit card to make various purchases and make cash advances such that the balance of his purchases and cash advances on the Visa card as of July 12, 1994, was $1,876.74. 9. In addition, cash advance finance charges of $16.12 and purchase finance charges of $3.61 were accrued as of July 12, -2- 1994. A true and correct copy of Members united record of account for Simokat's Visa card is attached hereto as Exhibit "D" and incorporated herein by reference. 10. Despite repeated demands, no payments were made by Simokat on the outstanding balance of his Visa card, which as of March 24, 1995, amounted to $2,085.12. A true and correct copy of the statement of account of Members United for Simokat's Visa is attached hereto as Exhibit "E" and incorporated herein by reference. COUNT I (Breach of contract) 11. Paragraphs 1 through 10 above are incorporated here by reference as if set forth in full. 12. Based on representations made by Simokat in his agreement to repay all sums due, Members united extended Simokat the $1,000 personal loan and provided him with a Visa credit card. 13. The Members United Visa loan had an outstanding balance owed by simokat in the amount of $2,085.12 as of March 24, 1995. 14.
