Whereas, JAMES D. DYMSKI of , is about to execute
contemporaneously herewith, a contract, with JAMES D. DYMSKI of
Cumberland County, Pennsylvania, for the rehabilitation of a two
and one-half story brick building upon a lot of land situate
ALL THAT CERTAIN piece or parcel of land situate in North
Middleton Township, Cumberland County, Pennsylvania, and
described in accordance with the Preliminary/Final Subdivision
Plan for Lewis E. Stoneberger and Elizabeth A, Stoneberger dated
February 20, 1995 and recorded in the Office of the Recorder of
Deeds in and for Cumberland County, Pennsylvania, in Plan Book
69, page 122, more particularly bounded and described as follows,
to wit:
BEGINNING at a point at or near the centerline of Hoy Road (T-
498), which point is at the dividing line of the within described
tract of land and lands now or formerly of Gerald E. Cunningham
and Carolyn G. Cunningham;
THENCE in and along Hoy Road (T-498), the following three courses
and distances:
(I) South 01 degrees, 53 minutes 05 seconds West, a
distance of 137.40 feet to a point; thence
(2) South 01 degrees, 31 minutes 12 seconds East, a
diatance of 128.09 feet to a point; thence
(3) South 20 degrees, 31 minutes 11 seconds East, a
distance of 67.74 feet to a point at lands now or
formerly of Lewis E. Stoneberger and Elizabeth A.
Stoneberger;
THENCE along lands now or formerly of Lewis E. Stoneberger and
Elizabeth A. Stoneberger, the following six courses and
distances:
(1) North 82 degrees 59 minutes 03 seconds West, a distance
of 153.57 feet to a point; thence
(2) South II degrees 54 minutes 38 seconds West, a distance
of 83.78 feet to a point; thence
(3) South 47 degrees 19 minutes 39 seconds West, a distance
of 100.02 feet to a point; thence
(4 ) South 00 degrees 44 minutes 56 seconds East, a distance
of 192.87 feet to a point; thence
(5) North 77 degrees 50 minutes 04 seconds West, a distance
of 540.99 feet to a point; thence
(6) North IS degrees 59 minutes 05 seconds West, a distance
of 564.43 feet to a point at lands now or formerly of
Frank W. Linsenbach, Jr. and Beryl C. Linsenbach;
THENCE along lands now or formerly of Frank W. Linsenbach, Jr.
and Beryl C. Linsenbach and lands now or formerly of Girard E.
Cunningham and Carolyn G. Cunningham, South 89 degrees 45 minutes
00 seconds Eaot, a distance of 902.39 feet to a point at or near
the centerline of Hoy Road (T-498) the point and place of
BEGINNING.
BEING Lot No, 2 on the aforementioned Preliminary/Final
Subdivision Plan of Lewis E. Stoneberger and Elizabeth A.
Stoneberger.
CONTAINING 10.OOO acres (gross); O.l561 acres (dedicated r.o.w);
9.8439 acres (net area).
Now, IIfI~ :./!J- , 1995 at the time of and immediately
befo~~the execution of the principal contract, and before any
authority has been given by the said JAMES D. DYMSKI of to the
said JAMES D. DYMSKI to commence work on the said building, or
purchase materials for the same in consideration of the making of
the said contract with JAMES D. DYMSKI of and further the
consideration of One Dollar to them paid by JAMES D. DYMSKI of ,
it is agreed that no lien shall be filed against the building by
the contractor, or any sub-contractor, nor by any of the material
men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the erection
of said building, commonly call led a Mechanic's Lien, the right
to file such liens being expressly waived.
