The aforesaid property is subject to a mortgage given by the Plaintiff, Kathie J. Ackalusky, to Central Pennsylvania Savings Association in the principal amount of $34,000.00 and dated July 1, 1987 and recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Mortgage Book 873, Page 53. A true and correct copy of said mortgage is attached hereto, marked exhibit "B" and incorporated by reference. 5. The aforesaid mortgage is still outstanding and is believed to have a balance of approximately $22,000.00. 6. On the same date the Plaintiff acquired title to the premises, the Plaintiff and the Defendant, Millie M. Ackalusky, and a third party, Deborah J. Henderson, entered into an agreement dated July 1, 1987 wherein the Plaintiff agreed to sell the premises to the Plaintiff, the Defendant and the said Deborah J. Henderson, thereby granting the said parties equitable title in the property, legal title to pass upon payment in full of the balance owed on the aforesaid mortgage. A true and correct copy of the July 1, 1987 agreement is attached hereto, marked Exhibit "C" and incorporated by reference. 7. On December 6, 1991, at the request of the said Deborah J, Henderson, the parties and the said Deborah J. 4 ff ,; 'J ! i I , , Henderson entered into a second Agreement dated December 6, 1991, wherein Deborah J. Henderson transferred all of her interest in the property to the Plaintiff and Defendant, thereby making them equal equitable owners thereof. A true and correct copy of said December 6, 1991 agreement is attached hereto, marked Exhibit "D" and incorporated by reference. 8. The aforesaid July I, 1987 Agreement attached as Exhibit "C" and as modified by the December 6, 1991 Agreement attached as Exhibit "D" required the Defendant to contribute equally to the payment of the mortgage on the property and to pay all of the electric and maintenance and repair bills for her share of the property outlined therein. 9. The Defendant has failed to make the payments required by the aforesaid Agreements as described in Paragraph 8 herein and as the result thereof Plaintiff has been required to make payments on behalf of the Defendant in the total amount of $10,446,04 as of January 13, 1995, as itemized and set forth on Exhibit "E" attached hereto and incorporated by reference. 10. The Defendant has promised to reimburse the Plaintiff for her expenditures as itemized on Exhibit "E", incorporated by reference hereto, but has failed and refused and is believed will in the future continue to fail and refuse to make said reimbursement. The Plaintiff believes she will be required to continue to make expenditures on behalf of the Defendant for the property until it is sold to preserve the property and the equity therein including, but not limited to, the mortgage payments, taxes, insurance, utilities and repairs and claim is made therefor. 12. The Plaintiff has requested that the Plaintiff and Defendant sell the property by listing it for sale with a realtor so that she may derive her equity share therein, but the Defendant has refused and continues to refuse to cooperate with said sale. COUNT II - PARTITION 13. The Plaintiff incorporates by reference the averments set forth in Paragraphs I through 12 of this Complaint. 14, No other person other than the parties to this action has an interest or claims to have an interest in the property which is described in Exhibit "A" incorporated by reference hereto. 15. Only the parties to this action are in possession of the property described in Exhibit "A", there being no other tenants or possessors thereof. 16. There has been no prior partition or division of the property. 6 17, The expenditures made by the Plaintiff on behalf of the Defendant as described in Exhibit "E" preserved the property and/or enhanced its value, were not gratuitously made and were necessary and reasonable expenditures. 18. The property described on Exhibit "A" cannot be divided between the parties without prejudice to or spoiling the whole property, 19. The Plaintiff is the only legal owner of the property. The Plaintiff and Defendant are each fifty (50%) percent equitable owners of the property by virtue of the aforesaid Agreements. WHEREFORE, the Plaintiff respectfully requests this Honorable Court to enter an Order or Decree: (a) partitioning the property described on Exhibit IIAIl; (b) declaring each party to be a fifty (50%) percent owner of the property; (c) directing the property to be sold and that each party shall execute all documents and assurances necessary to effectuate said sale; (d) directing that the net proceeds derived from said sale shall be equally divided between the parties subject, however, to deduction from Defendant' a share and addition to Plaintiff's share of an amount necessary to reimburse Plaintiff for the $10,446.04 in expenditures DIANE G. COUNT II - DECLARATORY RELIEF: TERMINATION OF AGREEMENT 20. The Plaintiff incorporates by reference the averments set forth in Paragraphs 1 - 19 herein. 21. The Defendant has materially and substantially breached the July I, 1987 Agreement attached as Exhibit "C" as modified by the December 6, 1991 Agreement attached as Exhibit "D" by failing to make her share of the payments for mortgage, taxes, insurance, utilities and repairs as itemized on Exhibit "E", incorporated hereto by reference. 22. As the result of the aforesaid breach the Defendant has forfeited all of her rights under the aforesaid Agreements and in and to the property described on Exhibit "A" covered thereby, 23. Ackalusky, to Central Pennsylvania Savings Association in the principal amount of $34,000,00 and dated July 1, 19B7 and recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Mortgage Book 873, Page 53. A true and correct copy of said mortgage is attached hereto, marked exhibit "B" and incorporated by reference, 5. The aforesaid mortgage is still outstanding and is believed to have a balance of approximately $22,000.00. 6. On the same date the plaintiff acquired title to the premises, the Plaintiff and the Defendant, Millie M. Ackalusky, and a third party, Deborah J. Henderson, entered into an agreement dated July 1, 1987 wherein the Plaintiff agreed to sell the premises to the Plaintiff, the Defendant and the said Deborah J. Henderson, thereby granting the said parties equitable title in the property, legal title to pass upon payment in full of the balance owed on the aforesaid mortgage. A true and correct copy of the July 1, 1987 agreement is attached hereto, marked Exhibit "C" and incorporated by reference. 7. On December 6, 1991, at the request of the said Deborah J. Henderson entered into a second Agreement dated December 6, 1991, wherein Deborah J. A true and ccrrect copy of said December 6, 1991 agreement is attached hereto, marked Exhibit "0" and incorporated by reference. 8. The aforesaid July 1, 1987 Agreement attached as Exhibit "C" and as modified by the December 6, 1991 Agreement attached as Exhibit "0" required the Defendant to contribute equally to the payment of the mortgage on the property and to pay all of the electric and maintenance and repair bills for her share of the property outlined therein. 9. The Defendant has failed to make the payments required by the aforesaid Agreements as described in Paragraph 8 herein and as the result thereof Plaintiff has been required to make payments on behalf of the Defendant in the total amount of $10,446.04 as of January 13, 1995, as itemized and set forth on Exhibit "E" attached hereto and incorporated by reference. 10. ' result of her alleged default on a real estate agreement of sale for a property where she, as well as the Plaintiff, her sister, resides In Cumberland County, 5. Petitioner has been Informed by Plaintiff's counsel that a separate action In mortgage foreclosure against the parties' residence Is pending, although Petitioner was unable to locate any mortgage foreclosure action In the prothonotary's computer Index, 6. Petitioner has been Informed by the client's caseworkers at the Stevens Center, Carlisle, Pennsylvania, that she suffers from two mental disorders which render her Incapable of taking responsible action on her own behalf or, In all likelihood, assisting Petitioner In her representation. Said mental disorders are known as "dissociative disorder" and "post-traumatic stress disorder," Copies of the diagnostic criteria for each of these disorders, copied from the Dlagnostical and Statistical Manuallll-R are attached hereto as Exhibit "B". 7. No guardian has yet been appointed for MIllie M. Ackalusky, and to Petitioner's knowledge, there are no pending actions requesting such an appointment. 8. As a result of the aforesaid mental disorders, MIllie M. Ackalusky not only failed to respond promptiy or appropriately to the Complaint seNed upon her until she had nearly forfeited her rights In the dispute; and while Petitioner believes that a negotiated settlement of the controversy may be In the best Interest of the client, petitioner does not consider that the client will be competent to consent to any such agreement nor to give him authority, absent court appointment of a guardian ad litem, to negotiate a settlement. 9. During Petitioner's telephone conversation with the client on June 16, 1995, she gave clear evidence of the emotional problems which are present. Petitioner Is not at this time suggesting any specific person to be the guardIan ad lIiem. The person selected, based on the Information received from client's therapist, will have to be someone, most probably a female, whom the client will perceive as compatible and non. triggering. WHEREFORE, Petitioner prays that the Court will grant a Rule upon PlaIntiff to show cause why a guardian ad litem should not be appointed for Millie M. The aforesaid mortgage is still outstanding and is believed to have a balance of approximately $22,000.00, 6. On the same date the Plaintiff acquired title to the premises, the Plaintiff and the Defendant, Millie M. Ackalusky, and a third party, Deborah J. Henderson, entered into an agreement dated July 1, 1987 wherein the Plaintiff agreed to sell the premises to the Plaintiff, the Defendant and the said Deborah J. Henderson, thereby granting the said parties equitable title in the property, legal title to pass upon payment in full of the balance owed on the aforesaid mortgage. A true and correct copy of the July 1, 1987 agreement is attached hereto, marked Exhibit "C" and incorporated by reference. 7. PA nOli Henderson entered into a second Agreement dated December 6, 1991, wherein Deborah J. The aforesaid July 1, 1987 Agreement attached as Exhibit "e" and as modified by the December 6, 1991 Agreement attached as Exhibit "0" required the Defendant to contribute equally to the payment of the mortgage on the property and to pay all of the electric and maintenance and repair bills for her share of the property outlined therein. 9. The Defendant has failed to make the payments required by the aforesaid Agreements as described in Paragraph 8 herein and as the result thereof Plaintiff has been required to make payments on behalf of the Defendant in the total amount of $10,446.04 as of January 13, 1995, as itemized and set forth on Exhibit "E" attached hereto and incorporated by reference. 10. The Defendant has promised to reimburBe the Plaintiff for her expenditures as itemized on Exhibit "E", incorporated by reference hereto, but has failed and refused and is believed will in the future continue to fail and refuse to make said reimbursement. 5 11. The plaintiff believes she will be required to continue to make expenditures on behalf of the Defendant for the property until it is sold to preserve the property and the equity therein including, but not limited to, the mortgage payments, taxes, insurance, utilities and repairs and claim is made therefor. 12. The Plaintiff has requested that the,p1aintiff and Defendant sell the property by listing it for sale with a realtor so that she may derive her equity share therein, but the Defendant has refused and continues to refuse to cooperate with said sale. COUNT II - PARTITION 13. The Plaintiff incorporates by reference the averments set forth in paragraphs 1 through 12 of this complaint. 14. No other person other than the parties to this action has an interest or claims to have an interest in the property which is described in Exhibit "A" incorporated by reference hereto. 15. Only the parties to this action are in possession of the property described in Exhibit "A", there being no other tenants or possessors thereof. 16.
