3. The UNITED STATES OF AMERICA is named as a Defendant In this action
by reason of privilege granted In an Act of Congress of the United States of America,
pursuant to the provisions of 28 U.S,C. 92410 and 26 U.S.C. 97425, as amended.
Federal Tax Liens
4. The names and address of the taxpayers whose liability created federal tax
liens on said Mortgaged Premises is as follows: Joseph H. Yinger and Andrea Yinger,
P.O. Box 53, Lemoyne, Pennsylvania 17043,
5. The nature of any interests and tax liens of the United States of America Is
based on the Notices of Liens duly filed by Defendant United States of America through
the District Director of Internal Revenue In Philadelphia, Pennsylvania, as follows:
(a). Lien Notice No. 238806617 dated June 17, 1981 and filed In the
Cumberland County, Pennsylvania, Prothonotary's Office,
Cumberland County Courthouse, Carlisle, Pennsylvania, on May 20,
1988, to Docket Number 4732-FTL-1988, In the amount of $1 ,694.69,
together with Interest to date, which lien is filed against taxpayers
"Joseph H. Yinger and Andrea Yinger".
A true and correct copy of said Federal Tax Lien Notice Is attached hereto, made
a part hereof, incorporated herein by reference, and marked "EXHIBIT A".
6. The lien of Defendant United Slates of America referred to In paragraph 5a
above, having been filed on May 20, 1968 Is subordinate In priority to the lien of the herein
described Mortgage, which Mortgage was recorded In the Cumberland County,
Pennsylvania, Recorder's Office on September 24, 1975, as more fully hereinafter
described; and by filing this Action, Plaintiff York Federal Savings and Loan Association
seeks a judicial sale of said Mortgage Premises herein described.
Mortgage
7. On orabout September 24, 1975, Defendant made, executed, and delivered
to Plaintiff a mortgage upon premises therein described, which Mortgage contains a
description of the premises subject to said Mortgage and was recorded on September 24,
1975 In the Cumberland County, Pennsylvania, Recorder's Office In Mortgage Book 595,
Page 214, A true and correct copy of said Mortgage is attached hereto, made a part
hereof, incorporated herein by reference, and marked "EXHIBIT B".
Assignments
8. There have been no assignments of said Mortgage.
Default
9. Said Mortgage is in default because Defendant has failed to make the
monthly payments of principal and interest due and owing on his loan from June 1, 1994
through the date of filing this Complaint as required by the terms of the Mortgage, Any
payments that may have been made during this period were applied to the delinquency
balance due and owing prior to June 1, 1994.
10, Plaintiff hereby exercises Its option to declare the entire amount owing upon
said Mortgage Immediately due and payable in accordance with Its terms and provisions.

12. Notice of Defendant's rights under Pennsylvania's Homeowne~s Emergency
Assistance Act, Act of December 23,1983, P.L. 385, No. 91 (35 P.S, s1680A01c ~ ~.),
as amended, was sent in accordance with said Act to Defendant Joseph H. Yinger on
February 22, 1995; and Defendant failed to exercise his rights under said Act. A true and
correct copy of said Notice is attached hereto, made a part hereof, incorporated
herein by reference, and marked "EXHIBIT C".

13. Notice of Intention to Foreclose and Rights Under Pennsylvania's Loan

PLAINTIFF'S RESPONSE TO NEW MATTER OF DEFENDANT. JOSEPH H. YINGER
AND NOW COMES PLAINTIFF, York Federal Savings and Loan
Association, by and through its attorney, Benjamin F. Riggs, Jr.,
Esquire, and responds to the New Matter filed by the Defendant,
Joseph H. Yinger as follows:
14. Admitted. However this Foreclosure Complaint is based on
significant arrears existing before June 1, 1994. Defendant was
asked to enter into an new Mortgage to cure these arrearages,
however Defendant has declined to do so.
15. Admitted.
16. Admitted in part, however, as of March, 1995, the
Defendant's property had been recommended for foreclosure.with a
Notice of Intention to Foreclose sent to the Defendant. Once this
is sent to the Defendant, the Plaintiff will only accept monies if
said monies bring the account current.
17. Admitted upon information and belief as communicated to
Plaintiff by Defendant's attorney, Ronald D. Butler, Esquire.
18. Admitted. Plaintiff is in the process of performing an
exhaustive analysis of the Defendant's account and will provide
same Defendant in the near future.
WHEREFORE,
Plaintiff,
York Federal Savings and Loan
Association asks This Honorable Court to dismiss Defendant Yinger'S
New Matter and prays for:
A. Judgment in its favor and against Defendant Yinger in
the amount of Forty-Three Thousand Five Hundred Forty and
72/100 ($43,540.72) with interest thereon at the rate of 9.5\
per annum ($9.2227 per diem, from March 30, 1995, late charges
at 5\ of the monthly payment amount, currently $20.41,
attorney's fees, costs of suit, and other charges collectible
under the Mortgage; for the foreclosure and sale of the
mortgaged premises; and for any and all other relief as the
Court deems appropriate; and
B. Judgment against Defendant, United States of America
in order that said federal tax lien of the United States of
America be discharged, and that the sale on said Mortgage may
have the said effect of a judicial sale as provided in 28
U.S.C. 5 2410, as amended; but said judgment against
Defendant, United States of
liability for costs.
