INTERFERENCES. Each party shall be free from Interference, authority and control by the other, as fully as If he or she were single and unmarried, except as may be necessary to carry out the provisions of this Agreement. Neither party shall molest or attempt to endeavor to molest the other, or in any way harass or malign the other, nor In any other way Interfere with the peaceful existence, separate and apart from the other, Each of the parties hereto completely understand and agree that neither shall do or say anything to the children of the parties at any time which might In any way influence the children adversely against the other party. 3, DIVISION OF PERSONAL PROPERTY, The parties have divided between them to their mutual satisfaction, personal effects, household goods and furnishings and all other articles of personal property which have heretofore been used In common by them, and neither party will make any " claim to any such Items which are flOW In the possession or under the control of the other. Should It become necessary, each party agrees to sign any title or documents necessary to give effect to this paragraph, upon request. An exception to the above distribution, are the Items listed on Exhibit "A", attached hereto, which shall be specifically the sole and separate property of Husband. Husband presently has In his possasslon, an antique desk which will become the sole and separate property of 2 . ' ~. Wife. Husband and Wife shall arrange to have the desk exchanged at a time mutually convenIent to the parties. 4, LIFE INSURANCE. Each of the parties are provided with life Insurance through theIr employer. Both Husband and Wife agree that they shall desIgnate theIr children as equal beneficiaries on seventy-five (75%) percent of the death benefit on the saId life Insurance policies. As each IndivIdual child attaIns the age of 18, the respective parent shall be entitled to delete that child from the desIgnated coverage with the remaining children desIgnated as equal beneficiaries In the total amount as set forth above. After the youngest child attains the age of 18, each party shall have a right to terminate the final beneficIary designation. Upon request, either party shall provide the other with confirmation of the beneficiary designation as set forth In this paragraph, 5. TAX ON PROPERTY DIVISION. Husband hereby agrees to pay all Income taxes assessed against him, If any, as a result of the division of the property of the parties hereunder. Wife hereby agrees to pay all Income taxes assessed against her, if any, as a result of the division of the property of the parties hereunder. 6, ASSUMPTION OF DEBTS, Wife shall assume sole responsibility for the car payment to Ford Motor Credit 3 " L Ii I: d " i !: ! Corp. with a balance of approximately $9,000,00. The said vehicle, a 1994 Ford Escort titled In tho name of Wife and her mother, Dorothy Thompson, shall remain Wife's sole and separate property. Wife shall also retain sole responsibility for the Joint Visa Orchard Bank account which has been closed with an approximate balance of $400,00, and Beneficial Consumer Discount loan which Is also Joint with a balance of approximately $3,000.00. Husband shall be solely responsible for the Bailey Diamond Center account balance, Each party shall Indemnify and hold the other harmless on the debts for which they have assumed sole responsibility. All further debts Incurred by the parties shall be their Individual responsibility. 7. PENSIONS, Each party shall retain as their sole and separate property without claim from the other, their pension and/or benefit plans through their employer. Wife Is an employee of the Pennsylvania Turnpike Commission and has a pension through the State Employees Retirement System. Husband Is an employee of AMP and has benefits through the AMP Savings and Thrift Plan as well as pension plan. As Indicated previously, each party shall retain solely their pension or benefit plans through each parties' respective employer. 8, BREACH, If either party breaches any provision of this Agreement, the other party shall 4 . ' , . have the right, at his or her election, to sue for damages for such breach. The party breaching this contract shall be responslbl'3 for the payment of legal fees and costs Incurred by the other In enforcing his or her rights under this Agreement, or seeking such other remedy or relief as may be available to him or her. 9, FULL DISCLOSURE, Husband and Wife each represent and warrant to the other that he or she has made a full and complete disclosure to the other of all assets of any nature whatsoever In which such party of every type whatsoever and all other facts relating to the subject matter of this Agreement. 10. ADDITIONAL INSTRUMENT, Each of the parties shall on demand execute and deliver to the other any deeds, bills of sale, assignment, consents to change of beneficiary on Insurance policies, tax returns and other documents and do or caused to be done any other act or thing that may be necessary or desirable to the provisions and purposes of this Agreement. If either party falls on demand to comply with this provision, that party shall pay to the other all attorneys' fees, costs and other expenses reasonably Incurred as a result of such failure. 11. WIFE'S DEBTS, Wife represents and warrants to Husband that since the parties' separation she has not and In the future she will not contract or Incur any debt or liability for which 5 . . , Husband or his estate might he responsible and shall Indemnify and save Husband harmless from any and all claims or demands made against him by reason of debts or obligations Incurred by her, 12. HUSBAND'S DEBTS, Husband represents and warrants to Wife that since the parties' separation he has not and In the future he will not contract or Incur any debt or liability for which Wife or her estate might be responslblA and shall Indemnify and save Wife harmless from any and all claims or demands made against her by reason of debts or obligations Incurred by him. 13, WAIVERS OF CLAIMS AGAINST ESTATES, Except as herein otherwise provided, each party may dispose of his or her property In any way, and each party hereby waives and relinquishes any and all rights he or she may now have or hereafter acquire, under the present or future laws of any Jurisdiction, to share In the property or the estate of the other as a result of the marital relationship, Including without limitation, dower, curtsy, statutory allowance, widow's allowance, right to take In Intestacy, right to take against the Will of the other, and right to act as administrator or executor of the other's estate, and each will, to the request of the other, execute, acknowledge, and deliver any and all Instruments which may be necessary or advisable to carry Into effect this mutual waiver and 6 . ' relinquishment of all such Interests, rights and claims. 14. REPRESENTATION. It Is recognized by the parties hereto that Paul A. Hibner Is represented by Gerald S, Robinson, Esquire and Brenda M. Hibner Is represented by John J, Connelly, Jr., Esquire, It Is fully understood and agreed that the parties have the right to have advice of counsel prior to the signing of this Agreement, By the signing of this Agreement, each party understands the legal Impact of this Agreement and waives his or her right to have this Agreement reviewed by an attorney of his or her choosing, and further acknowledges that the Agreement Is fair and reasonable and each party Intends to be legally bound by the terms hereof. 15, VOLUNTARY EXECUTION. The provisions of this Agreement are fully understood by both parties and each party acknowledges that this Agreement Is fair and equitable, that It Is being entered Into voluntarily and that It Is not the result of any duress or undue Influence. 16, ENTIRE AGREEMENT, This Agreement contains the entire understanding of the parties and there are no representations, warranties, covenants or undertakings other than those expressly set forth herein. 7 I 17, PRIOR AGREEMENT, It Is understood and agreed that any and all property settlement agreements which mayor have been executed prior to the date and time of this Agreement are null and void and of no effect. 18. MODIFICATION AND WAIVER, Any modification or waiver of any provision of this Agreement shall be effective only If made In writing and executed with the same formality as this Agreement, The failure of either party to Insist upon strict performance of any of the provisions of this Agreement shall not be construed as a waiver of any subsequent default of the same or similar nature. 19, GOVERNING lAW, This Agreement shall be governed by and shall be construed In accordance with the laws of the Commonwealth of Pennsylvania. 20, INDEPENDENT SEPARATE COVENANTS, It Is specifically understood and agreed by and between the parties hereto that each paragraph hereof shall be deemed to be a separate and Independent covenant and agreement. 21. Buzzendore, and Gerald S. Robinson of Robinson & Geraldo and answers Plaintiff's Complaint in Divorce and in support thereof avers: 1. Paragraph 1 is denied. Plaintiff currently resides at 3300 Union Deposit Road C206, Harrisburg, Dauphin County, pennsyivania 17109. 2. Paragraph 2 is denied. ASSUMPTION OF DEBTS. Wife shall assume sole responsibility for the car payment to Ford Motor Credit 3 Corp. with a balance of approximately $9,000.00. The said vehicle, a 1994 Ford Escort titled In the name of Wife and her mother, Dorothy Thompson, shall romaln Wife's sole and separate property. Wife shall also retain sole responsibility for the Joint Visa Orchard Bank account which has been closed wl1h an approximate balance of $400.00, and Beneficial Consumer Discount loan which Is also JoInt with a balance of approximately $3,000,00. Husband shall be solely responsible for the Bailey DIamond Center account balance. Each party shall Indemnify and hold the other harmless on the debts for which they have assumed sole responsibility, All further debts Incurred by the parties shall be their Individual responsibility. 7. PENSIONS. Each party shall retain as their sole and separate property without claim from the other, their pension and/or benefit plans through their employer, Wife Is an employee of the Pennsylvania Turnpike Commission and has a pension through the State Employees Retirement System. Husband Is an employee of AMP and has benefits through the AMP Savings and Thrift Plan as well as pension plan. Connelly, Jr., and present for the Defendant, Paul A. Hibner, was attorney Michelle B. Stokes. A divorce complaint was filed on April 10, 1995, raising grounds for divorce of irretrievable breakdown of the marriage. No economic claims were raised in the complaint. with respect to grounds for divorce counsel have advised that the parties will execute and file affidavits of consent prior to the hearing to be held in these proceedings. On September 19, 1995, the Defendant filed an answer with counterclaim raising the economic issue of equitable distribution. There are no claims in this action for alimony or counsel fees and expenses. The parties were married on November 18, 1978, and separated on August 14, 1995. They are the natural parents of three children, Syreeta V., age 17; Paulet Y., age 16; and Bart A., age 14. The children currently reside with the wife and husband is paying child support for the children in the amount of $150.00 per week. He is paying no spousal support. Wife is 37 years of age and resides at 2012 Green Street, HarriSburg, Pennsylvania 17102 with the children. She is a high school graduate with some business school training. currently she is a legal secretary with the Pennsylvania Turnpike commission and has a biweekly gross income of $1,229.60; a biweekly net income of $853.80. She has not raised any health issues. Husband is 37 years of age and resides at 163 West Maple Street, York, Pennsylvania, where he lives alone. He is a laborer with AMP. Husband is a high school graduate and has a gross monthly income of $2,166.00 and a net income of $1,668.00. Mr. Connelly has indicated that in the past, he believes, that Mr. Hibner has worked as a musical director at a church and does music for churches on a paid basis. That income has not been considered in the discussion today and Ms. stokes is going to inquire of her client as to whether or not he does have any additional income from music directing and performing. Husband has not raised any health issues. The assets that the parties have stated on the pre-trial statements include vehicles, savings bonds, checking accounts, and pensions with AMP and SERS. Counsel have advised that each party will keep the property presently in his or her possession and we will not use any values for any of that property in the equitable distribution computation. Separately considered is the distribution of the household furnishings. Wife wants to have returned to her an antique desk, an artificial Christmas tree with ornaments. Husband would like to have returned to him the Black Rose china, the piano, awards, computer, dining room chairs, video and movie collection, personal clothing and effects, color TV, and family pictures (duplicates). The real issue in this case involves the distribution and allocation of marital debt which includes the items listed on the pre-trial statement of wife, Items 1 through 5. In addition, Mr. Connelly has indicated there is a debt to Bailey'S Diamond center in the amount of approximately $1,000.00, united of pennsylvania phone bill of $472.06, and a Bell Atlantic phone bill of $196.03. The request made to the Master is that the total marital debt be allocated. Wife has been paying the debt and the intended resolution is for husband to reimburse wife for his share of that debt, The Master has inquired of counsel as to how husband intends to accomplish his contribution and counsel are working on that aspect of the resolution of this case. The Defendant is employed by AMP Incorporated, as a laborer. Defendant's Income and Expense Statement attached hereto and incorporated herein as Exhibit "A". VI. EXPENSES. Attached hereto and marked as Exhibit "A" is Defendant's Inventory and Appraisement and Income and Expense Statement. VII. RETIREMENT BENEFITS. There is no dispute between the parties as to their respective pensions. Defendant believes that the parties are in agreement that each party will keep his or her own retirement. VIII. COUNSEL FEES. Defendant has made no claim for counsel fees in this matter, but reserves the right to submit information about the expenses he has incurred in the litigation of this matter in response to any claim for counsel fees by Plaintiff. IX. MARITAL DEBTS. Marital debts known to Defendant are listed in his Inventory and Appraisement, attached hereto as Exhibit "A", X. PERSONAL PROPERTY. Defendant believes there may be a dispute over the division of the Parties personal property. Defendant desires to retain the personal property items listed in See Exhibit "B" attached hereto and incorporated herein. XI. PROPOSED RESOLUTION. Defendant proposes that the marital property be divided equally between the Parties. Specifically, Defendant proposes that each party retains the motor vehicle in his or her possession; each party retains the stocks or bonds held in his or her name; each party retains any and all employment-related benefits associated with his or her employment; Defendant shall be entitled to the personal property listed in Exhibit "B" attached hereto; and, each party shall be solely responsible for the debts currently in his or her name, with the exception that Plaintiff is solely responsible for debts associated with the residence located at 3300 Union Deposit Road after such time that Defendant was removed from the residence, specifically, Plaintiff shall be solely responsible for the Bell Atlantic telephone bill in the approximate amount of $196.03 and the PP&L bill in the approximate amount of $506.04.
