COMPLAINT
AND NOW, this!, day of April, 1995, comes Plaintiffs
by their attorneys, Mancke, Wagner, Hershey & Tully, who
respectfully represent:
1. plaintiffs Richard A. Lyter and Katrina Lyter are adult
individuals residing at 261 Ridge Hill Road, Apartment 2,
Mechanicsburg, Cumberland county, Pennsylvania, 17055.
2. Defendant Richard E. Seibert is an adult individual
residing at 7417 Moyer Road, Harrisburg, Dauphin county,
pennsylvania.
3. Defendant United Parcel Service, Inc., is a corporation
having a principal place of business at 65 E. Elizabeth Avenue,
Bethlehem, Northampton County, Pennsylvania.
4. The facts and occurrences hereinafter related occurred on
or about April 26, 1993, at our about 1:04 p.m. on Simpson Ferry
Road in Lower Allen Township, Cumberland County, pennsylvania.

5. At the aforesaid time and place, Richard E. seibert was
operating a motor vehicle owned by United Parcel service, Inc. as
their agent, servant and/or employee.
6. At the aforesaid time and place Plaintiff Richard A.
Lyter was operating his motor vehicle eastbound on simpson Ferry
Road when the Defendant Richard E. Seibert as servant, agent,
and/or employee of united Parcel service, Inc., caused the motor
vehicle he was operating to crash into the rear of the motor
vehicle owned and operated by Richard A. Lyter.
7. The aforesaid accident was a direct and proximate result
of the negligence of the Defendant Richard E. Seibert and of United
Parcel service, Inc., since Richard E. Seibert was operating the
motor vehicle as an agent, servant, and/or employee as follows:
a. In failing to abide by the assured clear distance
ahead rule;
b. In failing to stop for vehicles lawfully stopped on
the roadway ahead;
c. In failing to and/or negligentlY applying his
brakes;
d. In failing to be highly vigilant and observe
vehicles stopped in the roadway ahead;
e. In failing to operate his motor vehicle at a proper
speed;
