On or about August 22, 1994, Defendant, by and through an authorized agent, officer and/or employer, entered into a contract with Plaintiff whereby Defendant agreed, inter AliA, to purchase certain construction equipment from Plaintiff and pay certain then outstanding rental invoices as set forth in said contract. A true and correct copy of the aforementioned contract dated August 22, 1994 is attached hereto and incorporated by reference herein as "Exhibit A". 6. Defendant materially breached the terms and conditions of the parties' contract by failing to pay rental invoice MR15635B in the amount of $1,574.10 as required by the contract. A true and correct copy of rental invoice MR15635B is attached hereto and incorporated by reference herein as "Exhibit B". 7. The current principal balance due Plaintiff by Defendant by reason of Defendant's failure to pay the rental invoice identified above is $1,574.10. 8. The price charged Defendant by Plaintiff under rental invoice Mr15635B was fair and reasonable and not objected to by Defendant. 9. Defendant has failed and refused to pay the rental invoice in spite of Plaintiff's repeated demand to do so.
