SHEIBLEY tla ) SLeibley's Construction Co., ) ) Defendant. ) WARRANT OF ATTORNEY PURSUANT TO CONFESSION OF JUDGMENT WHERE ACTION COMMENCED BY COMPLAINT Pursuant to the authority contained in the warrant of attorney, the original or a true and correct copy of which is attached to the Complaint filed in this action, I appear for the Defendant, DONALD R.L. SHEIBLEY tla Sheibley's Construction Co., and confess judgment in favor of the Plaintiff, PNC BANK, NATIONAL ASSOCIATION (successor by merger with First Eastern Bank, N.A. and its affiliate andlor subsidiary, First Eastern Equipment Leasing Co.), and against said Defendant as follows: Unpaid principal balance of Instrument Attorney's fees in the sum of 10% of total amount due Costs TOTAL $24,066.18 $ 2,406.62 ... < $ 14 .50 I $26,487.30 Pennaylvania, with an office located at PNC Bank Plaza, 60 Public square, Wilkes-Barre, Luzerne County, Pennsylvania. 2. Defendant, DONALD R.L. SHEIBLEY, is an adult individual, trading as Sheibley's Construction Co., having an address at Box 200, 123 McClure Street, New Bloomfield, Pennsylvania. 3. On May 15, 1990, First Eastern Equipment Leasing Co. entered into a Master Equipment Lease, along with attendant Acceptance Supplement, Agreement for the Collateralization of Surety, Guarantee, Pledge, Lease and Security Interest and UCC Financing Statements (hereinafter collectively "Lease"), with Defendant, for the leasing and/or purchase of a 1985 Case Model 1150 Crawler/Loader having a serial number of 7304350 as more fully set forth on Acceptance Supplement above referred to; said Lease providing for the payment thirty-six (36) monthly rental payments from Defendant to First Eastern Equipment Leasing Co. in the amount of $1,065.00 per month plus $63.90 per month on account of sales or use tax, for an adjusted total amount of $1,128.90 per month. A true and correct copy of said Master Equipment Lease with attendant Acceptance Supplement, Agreement for the Collateralization of Surety, Guarantee, pledge, Lease and Security Interest and UCC Financing Statements, are attached hereto, incorporated herein by reference, and collectively marked Exhibit "A". 4. Said Lease Agreement has not been assigned to any third party; and the terms of said agreement are governed by Pennsylvania law. 5. All conditions precedent to ripen Defendant's obligations have been complied with by the Plaintiff. 6. Defendant has committed a default under the requirements of the above referred to Lease Agreement due to its failure to make the monthly rental payments when due and due to its failure to make payment of the deficiency amount as demanded in Plaintiff's default notice dated AprilS, 1995 (a true and correct copy of which is attached hereto, incorporated herein by reference, and marked Exhibit "B"). 7. As of March 16, 1995, the amount of $26,066.18, plus reasonable counsel fees not to exceed ten percent (lot) of all monies due, plus interest at the rate of six percent (6t) annum and/or the legal rate of interest, are owing to Plaintiff by Defendant relative to the above referred to Lease. B. By virtue of the above referred to Lease Agreement (Exhibit "A" hereto), and, in particular, paragraph 11 thereof, Defendant, as Lessee, agrees that upon the occurrence of an event of default as more fully defined in said Lease, "the Lessee agrees and acknowledges and hereby authorizes and empowers any attorney of any court of record to appear for or in behalf of the Lessee and confess judgment(s) against Lessee in an amount calculated/computed in accordance with the provisions of these paragraphs and the supplements together with costs and ten percent attorney's commission for collection, hereby waiving all errors, stays, exemptions which are now or hereafter enforced or effectuated in this state or elsewhere. A copy of this agreement shall be sufficient warrant of attorney for the confession of any judgments hereunder". 9. Defendant has failed and refused and continues to fail and refuse to pay any of the liabilities as set forth herein. 10. As a result of the events of default set forth hereinabove, Defendant is liable for the amount of $24,066.18, plus reasonable attorney's fees in an amount of ten (10%) percent of the total amount due, plus costs and expenses, plus interest at the rate of six percent (6%) annum and/or the legal rate of interest; and, inasmuch as plaintiff has become obliged to institute suit and incur legal fees, said Defendant is alse liable to Plaintiff for the additional amount of $14.50 incurred or to be incurred in the costs of instituting the within action. 11. Judgment has not previously been entered upon the Lease Agreement. WHEREFORE, Plaintiff PNC BANK, NATIONAL ASSOCIATION (successor by merger with First Eastern Bank, N.A. and its affiliate and/or subsidiary, First Eastern Equipment Leasing Co.), demands judgment against the Defendant DONALD R.L.
