7. The negligence of nefendant Lesh consisted of the following:
A. Operating a motor vehicle without being attentive to the
conditions of traffic.
B. Operating a motor vehicle at an excessive rate of speed
under the circumstances.
C. Failure to bring her vehicle to a stop within the assured
cleared distance ahead,
D. Failure to keep said motor vehicle under proper and adequate
control.
E. Violating the statutes of the Commonwealth of Pennsylvania
and other local ordinances with regard to the operation of
motor vehicles and stopping at stop signs.
F. Failing to stop at a stop sign.
G. Failing to yield the right of way as required.
H. Being otherwise careless. reckless and negligent as the
circumstances may disclose.

LINDA L. MUMMERT v. WANDA LESH
8. The allegations contained in paragraphs I through 7 above
are incorporated herein as those set forth at length.
9. As a result of the accident aforementioned. Plaintiff Linda
L. Mummert has suffered a right shoulder impingement syndrome which
has required two involved operations without any significant relief
or success in treatment.
