AND NOW, comes the Plaintill's. Earl H, Johnson. II and Kelli Johnson, by and through their
attorneys, MARTSON. DEARDORFF. WILLIAMS & OTTO. and hereby avers as follows:
I, The Plnintill's are adult individuals residing at III Fairview Drive. Camp Hill,
Pennsylvania 170 II.
2, The Defendant. Teresa Ann Kovach. is an adult individunl with an address of 517
Grandview Avenue. Camp Hill. Pennsylvania 17011.
3, On or about November 19, 1994. a 1988 Pontiac operated by the Defendant. Teresa
Ann Kovach. collided with a 1994 Mazda 323 owned by Plaintiff Earl H, Johnson. II. and operated
by Plaintiff Kelli Johnson,
4, The collision happened as the Plaintiff Kelli Johnson was traveling in the right hand
lane of Erford Road and hnd signaled for a right turn into the Uni-Mart Convenience Store,
5, As the Plaintiff. Kelli Johnson, started to turn into the Uni-Mart parking lot, her
vehicle was stnlck from behind by Defendant Teresa Kovach,
6, As a result of the collision between the front of the Defendant's vehicle and the right
rear of the PlaintiIl's vehicle, the PlaintiIl's vehicle was dnmaged in the amount of$I.889,19, A
copy of the appraisal in that amount is hereby attached as Exhibit" A,"
7, The collision occurred solely as a result of the negligence, recklessness and
carelessness of the Defendantnnd that the Defendant, il/terlllill:
a. operated her vehicle at a speed too fast for the condition existing on the
roadwny;
b, fililed to operated her vehicle so that she could stop within the assured clear
distance ahead;
