menns of removing debris from the roof system which resulted in penetrntion of the roof
system and the entry of wnler,
13, If any dnmage occurred to Plnintiffs' property, it wns the result of Plaintiff
Brnndow's own nctions nnd not the result of improper conslruction,
14, Plnintiffs engnged Theodore Brnndow, n licensed nrchitect nnd fnther of
Plaintiff Brnndow. to prepare drnwings for the work, including, but not limited to, drnwings
for construction of the roof scuppers,
15, Defendant constructed the roof scuppers in nccordnnce with the drawings
prepnred by the Plaintiffs' ngen\.
16, Any deliciencies regarding the roof scuppers are the result of improper design
by Plaintiffs' own ngent, nnd not the nction of the Defendnnt,
17, Plaintiffs are estopped from c1niming that damnge to Plnintiffs' property
resulted from improper construction,

DEMOLITION
Interior walls in existing house will be moved to plans
dated 3/15/93.
Structures interfering with addition on outside will be
removed and disposed of.
All windows and walls of existing house that need to be
relocated will be moved in accordance with plans dated
3/15/93.
~ Steps going to second floor will be made larger.
All heating radiators will be removed and disposed of.
All other minor demolition will be in accordance with notes
on plans.
NOTE: Partition wall in dining/ living room is included.
Installing second window in girls bedroom
EXCAVATION
Footers will be dug in accordance with foundation plans
dated 3/15/93. Footer will be below frost line.
Once block is laid dirt will be back filled against the
foundation.
Area around outside will graded and seeded after
construction is finished.
FOUNDATION
Footer will be poured with 2500 PSI concrete mix.
8" block will be laid on top of footers and will be in
accordance with plans.
parged walls is deleted from specifications.
Straps or anchor bolts will be used to anchor the pressure
treated top plate to the block.
Foundation vents will be placed according to plans.

A 4" slab with 3000 PSI mix will be poured in the sunken
family room area. 4" of compacted 2B stone will be placed
under the slab.
NOTEI A floor joist system can be installed for the same

FRAMING
All framing will be in accordance to plans dated 3/15/93.
Notel 3/4" furring strips will be placed along exterior wall
of existing house in order to finish the wall off in the new
addition area.
2x10's will be used as headers above all now door and window
openings.
CHANGES TO THE FRAMING PLANS
2x10's placed 16"0.C. for floor joists.
2xB's placed 16"0.C. for construction of the roof.
2x10's placed 16"0.C. for construction of the cathedral
ceiling in "sunken family room."
2x10's used for the hip of the roof.

15lb felt paper will be placed over plywood.
Drip edge will be placed along perimeter of roof.
A 20 year Owen Corning shingle will be nailed to plywood
surface.
All flashing necessary to tie into existing house is
included.

INSULATION
R-30 batts of insulation will be placed in cathedral ceiling.
R-11 batts will be placed in newly framed exterior walls.
R-19 batts will be placed in newly framed floor areas(ground
level floor areas onlY).
R-30 will be blown in the ceiling areas.
DOORS
All new doors installed will be a hollow raised panel
pre-finished white door(see brochure).
All doors will receive standard knobs and hardware.
Doors will be placed according to plans.
WINDOWS
crestline windows will be used in all new window openings in
addition. Windows will have insulated glass and if low E
glass/grills are wanted, an additional amount will be added to
contract.
A new window will be installed above landing on steps.
Two 4'x4' Velux stationary skylights will be placed
according to plans.
One 2'x2' Velux skylight will be placed as to plans.
Note. If operating skylights are preferred add $150.00
dollars for each skylight.
Going with Crestline windows rather then Anderson windows
was a savings of about $400.00.

ELECTRICAL
A 200 AMP service will be installed.
The 200 Amp panel will be placed in location of eXisting
box.
Receptacles and switches will be placed according to code in
new addition area.
Any wiring that needs to be rerouted when interior walls are
being moved will be done.
All wiring in new addition will be inspected and to code.
PLUMBING
1/2" copper will be used for new water lines going to
kitchen sink and bathroom areas.
Schedule 40 PVC piping will be used for waste lines.
All piping will be tied into existing plumbing.
TRIM
~#2 pine will be used to case out new window and door
openings.
A #2 pine WEB 320 base mOUlding will be placed along floor
perimeter in new addition area. Will be used along floor
were openings are being filled.
Closet areas will receive a colonial base 3" in height.
A $400.00 allowance for shelving in the newly built closets.
HVAC
xn-illowance of $9,067.00 for the installation of a new
furnace and duct work.
KITCHEN
An allowance of $5,100.00 for the purchase of the kitchen
cabinets.
An allowance of $3,600.00 for the purchase and installation
of a Surrell counter top for kitchen.
Cabinets will be in accordance to layout provided by
contractor.(price attached with layout plus tax).

Installing glass block in front of shower will be $100.00
more then building wall and tiling it.
EXTERIOR
stocco will be placed on the exterior of new addition.
Gutter and downspouting will be placed according to plans
Aluminum fascia will be placed along rakes and face boards.
5/4 x4" 12 pine will be placed around outside of windows and
doors.
Back porch steps will be constructed with pressure treated
lumber.

· Add Joists 12" on center under bath tile and 19' kltchen span
· Specify entire bath floor to be tiled.

including other gutters installed by Defendant. If gutter blockage anywhere
on the house was a concern, Defendant should have, but didn't, recommend
placing an inexpensive scrsen oVer the scuppera. Further, the scuppere lead
from a thirty year rubber roof. The roof should be impermeable to sitting,
puddled water for an indefinite period, regardless of whether the sCUppers are
stopped up by foliage or anything else.
12. Denied. To the contrary, it is averred that Plaintiffs
regularly policed the rubber roof area with a broom but at all times wearing
sneakers or in bare feet.
13. Denied. The averments of Paragraph 13 constitute a conclusion
of law to which no reply is necessary. If a reply is deemed to be required,
then said averments are specifically denied.
14. Admitted in part and denied in part. It is admitted that
TheOdore Brandow, a licensed architect and father of Plaintiff Brandow,
prepared the draWings for the work. However, his drawings included the
direction to construct scuppsrs but no construction detail.
15. Denied. To the contrary, it is averred that the roof scuppers
were not installed by Defendant in a sound and workmanlike fashion and
resulted in leakage.
16. Denied. To the contrary, it is averred that neither Plaintiffs
nor any of their agents deSigned the roof scuppers.
