MIDDLETON, Defendant CUSTODY ORDER AND NOW, this l', day of ", n ", 1995, upon consideration of the within Motion, Stiplllation, and Complaint, it is hereby Ordered as follows: 1. That full legal and physical custody of DERICK JEFFREY SMITH, born October 19, 1979, shall be and remain in his custodial parents, ROBERT D. SMITH and ANN M. SMITH. 2. That said Custodial Parents shall have the right to secure a public education for the minor child, as well as authorize medical, dental, orthodontic, psychological and psychiatric treatment for the minor child. The Custodial Parents shall have all other rights and duties with respect to the minor child as if they were his natural parents. 3. That the mother of the minor child, CHERIE A. MIDDLETON, shall have such rights of temporary physical custody of the minor child as the parties shall from time to time agree. BY THE COURT: 56, IIJ I' (' . :\ .;1 'I:' Ii '- rt( / c_.- I J. March, 1995, with Defendant in Boston, Kentucky; from March, 1995, until the present, with Plaintiffs at 10 Poplar Street, Wormleysburg, Pennsylvania. The mother of the child is CHERIE A. MIDDLETON, who currently resides at the Budget Inn, Room 224, 6850 East 21st Street, Indianapolis, Indiana. She is married. The father of the child is unknown. 4. The relationship of the Plaintiffs to the child is that of aunt and uncle. The Plaintiffs currently reside with the child and with their two daughters, Candice Smith, age 15, and Jennifer Smith, age 13. 5. The relationship of the Defendant to the child is that of mother. She currently resides with her husband, GARY MIDDLETON. 6. The Plaintiffs have not participated as parties or witnesses, or in another capacity, in other litigation concerning the custody of the child in this or in another court. The Plaintiffs have no information of a custody proceeding concerning the custody of the child in this or in another court. Plaintiffs do not know of a person not a party to these proceedings who has physical custody of the child or who claims to have custody or visitation rights with respect to the child. 7.
